DOCTOR REQUIRES SEPARATE VOTE KRESS FOODS OF NORTHWEST EDMOND, LLC IS THE APPLICANT THERE PRESENT ITEM FIVE, A S K S S P TWO TWO DASH TRIPLE 0 1 4.

IT'S A PUBLIC HEARING CONSIDERATION FOR A SITE PLAN APPLICATION FOR CREST FRESH MARKET LOCATED ON THE WEST SIDE OF SOONER NORTH DAKOTA BELL.

MR. ANTS, WOULD YOU KINDLY INTRODUCE FIVE EIGHT? SURE.

AS YOU SAID, THE AFRICANS REQUESTING APPROVAL OF A COMMERCIAL SITE PLAN FOR A CREST FOR FRESH MARKET ON THE WEST SIDE OF SOONER NORTH COBELL AT THE GROCERY STORE HAD A SITE PLAN APPROVED IN 2017, BUT A BUILDING PERMIT WAS NOT OBTAINED AND THE SITE PLAN EXPIRED.

UH, THEY ARE NOW BACK AND READY TO GO ON THAT SITE.

UH, THE PLANS HAVE CHANGED ONLY SLIGHTLY.

UH, THE SITE WAS ZONED IN 2014 AS A PUD TO ALLOW FOR THE GROCERY STORE AND OTHER RETAIL USES THE BUILDING IS PROPOSED TO BE AT 101,000 SQUARE FEET, FOUR HUNDRED AND FORTY FOUR HUNDRED AND TWENTY TWO SQUARE FEET WITH, UH, IT WILL BE 33 FEET TALL AND PAINTED CONCRETE PANELS WITH BRICK VENEER.

UH, THE PRECAST PANELS DO NOT DO REQUIRE A VARIANCE TO TITLE 22 AND THE CORRIDOR STANDARDS, BUT A SIMILAR VARIANCE WAS APPROVED FOR THE CONFERENCE CENTER ACROSS THE STREET AND THAT THEATER, UH, ANOTHER VARIANCE IS BEING REQUESTED FOR THE REQUIREMENT OF A PARAPET WALL, UH, ALONG ALL SIDES OF THE BUILDING, WHICH IS THE WALL, WHICH HIDES THE MECHANICAL EQUIPMENT.

INSTEAD, THE OUTCOME IS REQUESTING TO USE LANDSCAPING ON THE WEST SIDE OF THE BUILDING, AS IT IS ELEVATED WITH A RETAINING WALL.

UH, THE LANCE LANDSCAPING WILL OBSCURE THE MECHANICAL EQUIPMENT.

ON TOP OF THE BUILDING.

THE SITE ALSO HAS 737 PARKING SPACES, AND THAT WILL HAVE FOUR ACCESS POINTS ON THE FAIRFAX BOULEVARD, ONE ON THE AND TWO ON THE SOONER ROAD.

UH, THE NORTH EASTERN MOST DRIVE ON THE FAIRFAX ALSO NEEDS A VARIANCE AS IT DOES NOT MEET THE 150 FEET SEPARATION REQUIREMENT.

UH, STAFF SUPPORTS THAT VARIANCE.

THAT IS THE DRIVE RIGHT THERE THAT I'M REFERRING TO.

AND THE LIGHTING LANDSCAPING SOLID WASTE AND ELECTRIC PLANS ARE ALL COMPLIANT WITH THE CODE STAFF RECOMMENDS APPROVAL SUBJECT TO APPROVAL OF THE VARIANCES.

UH, LIKE YOU HAD HEARD THAT WE WERE HERE IN FRONT OF YOU BACK IN 2017, WHEN THIS SITE PLAN WAS APPROVED AND DUE TO MARKET UNCERTAINTIES, WE DECIDED TO WAIT TILL THERE IS MORE TRAFFIC AVAILABLE ON THE SURROUNDING IS RATE.

SO WE FEEL LIKE IT NOW IS A TIME IMPROVEMENTS HAVE BEEN MADE ON SOONER AND CORVELLE ROAD.

UH, SO THAT'S DEFINITELY HELPFUL THERE AND LIKE WHAT YOU SEE ON THE SCREEN THERE, UH, I'LL JUST KIND OF GO THROUGH QUICKLY THE ORIENTATION OF THE BUILDING, HOW THIS IS, THIS BUILDING IS LAID OUT.

SO, UH, THE BUILDING PHASES SOONER ROAD, AND THEN YOU HAVE COLWELL ON THIS SIDE AND THEN FAIRFAX BOULEVARD RUNNING ALONG THE BACK IN 2017 ON THE PART OF FAIRFAX BOULEVARD WAS CONSTRUCTED, BUT LATER IN 2017, AS PART OF THE SITE PLAN FOR IMPROVEMENTS, FAIRFAX BOULEVARD WAS CONSTRUCTED ALL THE WAY UP TO SOONER OVER THE YEAR.

SO, UH, I HAVE MY TEAM OVER HERE.

UH, OUR TRAFFIC ENGINEER, OUR LANDSCAPE ARCHITECT AND OUR OWNERSHIP GROUP IS HERE AND ALSO OUR BUILDING ARCHITECTS.

SO THERE'LL BE HAPPY TO ANSWER ANY QUESTION YOU WILL HAVE ON IT.

UH, I'LL JUST QUICKLY GO THROUGH A FEW OF THE ITEMS WE DISCUSSED EARLIER.

AND, UH, WHAT YOU HAVE HEARD FROM YOUR PLANNING DIRECTOR, RANDY, UH, WE'RE REQUESTING THE, UH, VARIANCE ON THE LAND, UH, SCREENING.

UH, THERE IS A SUBSTANTIAL AMOUNT OF LANDSCAPING IN THE BACK AND WHAT YOU SEE ON THIS COLOR DIAGRAM OVER THE ORIENTATION OF IT.

UH, THESE ARE ALL EVERGREEN TREES WITH HEDGES AND SHRUBS AND, UH, WHEN THESE TREES ARE PLANTED, UH, THEY'LL BE UP TO EIGHT TO 10 FEET TALL WITH THREE INCH CALIBER SIZE.

AND OVER THE YEAR THEY MATURE HIGH, THEY'LL REACH UP TO 20 TO 30 FEET TALL.

AND AS YOU KNOW THAT, UH, WITH THE SPACING OF TREE, THERE'S ALWAYS CERTAIN GAP IN BETWEEN TREES.

SO WE WILL SCREEN THAT GAP BY PLANTING AIRPORT WITH A HEAD OR SHRUBBERY ALONG IT THERE.

SO THAT'S KINDA, YOU SEE, ALONG THERE, OR IN THE BIGGEST SCREEN, UH, ALONG THE BACKSIDE THERE, THE, THE B THE BUILDING SITS REALLY LOW.

UH, THERE IS AN EXISTING 14 PLUS FEET TALL RETAINING WALL BUILT ON THE WEST SIDE OF THE BUILDING, AS WELL AS ON THE PORTION OF SOUTH SIDE AND THE NORTHWEST SIDE.

SO THE PHYSICAL LOCATION OF THE BUILDING WITH REFERENCE TO HIS SURROUNDING ALLEVIATES ANY ISSUES ABOUT THE NOISE, WHAT IT MAY GENERATE, BECAUSE OUR TRUCK DOCKING OPERATION IS IN THE, UH, BACK OF THE BUILDING.

UH, YOU SEE, SO THAT AREA IS LIKE A 12 TO 14 FEET LOW.

SO IN CASE OF ANY DELIVERY TRUCKS OR ANYTHING, ALL OF THE NOISE, WHICH MAY USUALLY GENERATE FROM THAT WILL BE DEFLECTED INSTEAD OF TRAVELING IN A STRAIGHT LINE, IF IT WAS AN OPEN SITE, WOULD HAVE BEEN A CONCERN ABOUT THE NOISE POLLUTION THERE.

UH, BUT BECAUSE WE ARE SITTING LOW, OUR TRUCK DOCK IS IN A WELL, AND IT HAS A MASONRY WALL AS WELL AS THE CONCRETE WALL IN THE BACK.

AND ON TOP OF THE CONCRETE WALL, WE HAVE EXTENSIVE AMOUNT OF LANDSCAPING AND THAT LANDSCAPING ITSELF, UH, IS EXCEEDING MORE THAN WHAT CITY REQUIRES BY THE ZONING.

WE ARE ADDITIONALLY ADDING 10% OF LANDSCAPING ON TOP OF WHAT IS TYPICALLY REQUIRED FOR THE LANDSCAPE.

SO WE ARE IN COMPLIANCE WITH THE LANDSCAPE REQUIREMENT.

SO BACK TO THE NOISE THING THAT BECAUSE WE'RE SITTING SO LOW, SO WITH THE ENERGY AMOUNT OF GENEROUS NOISE GENERATION WILL BE DEFLECTED BY THIS LANDSCAPING SCREENING MASONRY WALL, AND THE CONCRETE WORLD, SAME GOES WITH, UH, UH, SIGHT LIGHTING AROUND THE SIDE.

UH, WE'LL BE PROVIDING LED LIGHTING FACING DOWN.

AND AS PART OF THE LED LIGHTING, THE PROJECTION WILL BE LIMITED WITHIN THE SITE AND THERE WILL BE NO OUTSIDE LIGHT POLLUTION.

WHEN I SAY OUTSIDE LIGHT POLLUTION MEANS THAT THERE WILL BE NO SPREAD OF LIGHT BEYOND THE PROPERTY AND BEYOND THE STREETS.

SO, UH, TH THAT HELPS US WITH THE LANDSCAPING IS SCREENING AND WITH THE LIGHT POLLUTION THERE, UH, THE OTHER VARIOUS, UH, WHICH WAS REQUESTED, UH, IS ABOUT THE EXISTING DRIVE, WHICH IS THAT, UH, RIGHT IN THIS AREA BACK IN 2017, UH, THE SITE IMPROVEMENTS AND FAIRFAX BOULEVARD WERE SUPPOSED TO BE DONE ALL AT ONE TIME.

SO THAT WAS PART OF THE VARIANCE REQUEST, BUT NOW THIS DRIVER IS ALREADY BUILT.

SO WE ARE MATCHING OUR DRIVER LOCATION.

WHAT IS CURRENTLY BUILT OVER THERE, UH, IN TERM OF ANY, UH, LANDSCAPING QUESTION OR THE, UH, ALL DEFERRED TO OUR LANDSCAPE ARCHITECT? UH, AS FAR AS THE TRAFFIC GOES, UH, I'LL JUST BRIEFLY STATED THAT WE ARE WORKING WITH THE CITY ON IMPROVEMENT OF THE SIGNALIZED INTERSECTION ALONG SOONER ROAD, AS WELL AS WIDENING OF THE, UH, SOONER ROAD THERE.

AND THEN AS THEY MATURE HIGH, THEY CAN GO UP TO LIKE THE 20, 20 FEET TO GET TO THE STORE.

WITH THE COMPLETION AND ADOPTION OF THE EAST EDMOND 2050 PLAN EARLIER THIS YEAR, STAFF AS THE BEGAN THE PROCESS OF IMPLEMENTATION.

THE FIRST STEP IN THAT IS TO ADOPT THE CHANGES INTO OUR COMPREHENSIVE PLAN OR EDMUND PLAN 2018, KIM BRIAN LONG RANGE PLANNER AND PROJECT MANAGER FOR THE EAST ED.

AND THE PLAN A IS HERE TO SHOW HOW THAT IS ACCOMPLISHED AS WELL AS A FEW OTHER AMENDMENTS TO THE PLAN ITSELF THAT I'LL TURN IT OVER TO KEN.

SO THAT INCLUDES, UH, BRINGING FORTH, UH, RECOMMENDED AMENDMENTS TO THE CITY'S COMPREHENSIVE PLAN.

SO THIS EVENING WE HAVE, UH, TWO, TWO BUCKETS OF, UM, PROPOSED REVISIONS, I GUESS, UM, THOSE ASSOCIATED WITH A EAST EDMUND PLAN THAT MR REFERRED TO, AND THEN A HANDFUL OF MODIFICATIONS OR AMENDMENTS, UM, THAT WE THINK MAY IMPROVE FUNCTIONALITY AND CLARITY OF THE COMPREHENSIVE PLAN.

SO LET'S DIVE RIGHT IN AND LOOK AT A FEW OF THE MAP CHANGES.

SO I'M REFERENCING HERE.

OF COURSE, THE, UH, THE PLAN CATEGORY MAP, WHICH IS THE ONLY, UM, THE MAJOR LAND USE MAP, UM, THAT WE USE FOR DEVELOPMENT EVALUATION.

SO EAST OF ARCADIA LAKE BETWEEN 15 AND 33RD, UM, THAT AREA RECEIVED A LOT OF ATTENTION DURING THE EAST ADMIN 2050 PLANNING PROCESS.

UH, CURRENTLY IT'S CATEGORIZED AS A RURAL NEIGHBORHOOD.

UM, BUT AS THE ADMIN PLAN UNFOLDED, UH, THIS BECAME, UM, AN, A LOCATION THAT GOT SOME ATTENTION WE'RE REFERRING TO A VILLAGE.

AND SO WE, WE CONCEPTUALIZE THE VILLAGE, UM, IN THREE MAJOR PLAN CATEGORIES.

SO A FAIRLY INTENSE TOWN SQUARE WE'RE PURPOSELY, UM, ARE USING THAT TERM BECAUSE OF THE, THE, KIND OF THE RURAL NATURE OUT HERE.

AND THE, I DON'T KNOW THE CONCEPTS THAT THE WORD TOWNSQUARE INVOKES ARE APPROPRIATE, UM, FOR THIS LOCATION, UM, VILLAGE MODERATE THAT IS STRONGLY ALIGNED WITH THE CURRENT PLAN CATEGORY OF VILLAGE.

UM, WE JUST HAD TO ADD A MODIFIER TO IT THERE SO THAT WE CAN STEP IT DOWN TO VILLAGE LOW.

SO THAT'S SIMILAR TO A VILLAGE, LESS INTENSE AND ALLOWS

US SMOOTH TRANSITION BACK TO THE RURAL CHARACTER.

SO THE SECOND AREA IS, UM, AS IT IS A SIMILAR SITUATION, BUT ONE WE'RE MORE FAMILIAR WITH THAT'S THE ROUTE 66 VILLAGE.

SO THAT'S BEEN PART OF THE PLANNING PROCESS HERE FOR MANY YEARS.

I MEAN, YOU CAN SEE HERE ON BOTH SIDES OF DOUGLAS NORTH OF SECOND STREET.

SO THAT'S AS, AS IT STANDS NOW IN THE, IN THE ADMIN PLAN.

SO AS WE, UH, AS WE DEVELOPED THE EAST EDMOND, UH, PLAN, UM, WE WERE ABLE TO TAKE THOSE SIMILAR, SIMILAR CONCEPTS REGARDING THOSE DIFFERENT KINDS OF LEVELS AND TRANSITIONS AS IT PERTAINS TO THE VILLAGE AND APPLY IT IN THIS AREA.

SO YOU CAN SEE HERE, WE'VE, WE'VE INCLUDED THAT MORE INTENSE TOWN SQUARE, AND THEN, UM, THE LESS INTENSE AREAS OUT TO THE AGRICULTURE AND THE RURAL AREAS.

ONE LAST MAJOR CHANGE TO THE PLANT CATEGORY MAP HERE, UH, ON DAN FORTH BETWEEN AIR DEPOT AND MIDWEST.

SO THAT AREA HAS BEEN SHOWN AS SOME TYPE OF MIXED USE FOR QUITE SOME TIME, AS WE WENT THROUGH THE EAST EDMUND PROCESS, UM, WE REALIZED THAT WE DON'T REALLY NEED TO ACCOMMODATE THAT TYPE OF DEVELOPMENT PATTERN IN THIS LOCATION, THAT WE WERE ABLE TO ACCOMPLISH THOSE SIMILAR THINGS IN, IN A VARIETY OF DIFFERENT WAYS.

AND IT ALLOWED US TO JUST KIND OF RECATEGORIZE THAT AREA AS A SUBURBAN, TOO.

SO WE WERE MORE FIT THE PATTERN, UM, THE PREVAILING PATTERN AROUND IT.

SO SPEAKING OF SUBURBAN TOO, THESE CHANGES ARE A DERIVED FROM THE EAST EDMOND WORK AS WELL.

SO KIND OF SIMPLIFYING THE DESCRIPTION OR REMOVING SOME, UM, MAYBE UNNECESSARY LANGUAGE DESCRIBING THE EXISTING CONDITION OF THAT SUBURBAN TO CHARACTER, AND THEN, UH, LEANING INTO THE, THE IDEA OF THESE AREAS, BECOMING MORE NEIGHBORHOOD LIKE, UM, PROVIDING A VARIETY, A WIDER VARIETY OF HOME TYPES, UM, SUPPORTIVE, UM, APPROPRIATELY SCALE COMMERCIAL AND CIVIC ACTIVITIES TO CREATE MORE OF A COMPLETE NEIGHBORHOOD.

UH, THE SECOND, UM, TALKING POINT THAT CAME OUT OF THE EAST EDMOND DISCUSSION WAS, UH, RELATED HERE ON THE BOTTOM, WHERE WE SHOW THAT A SINGLE FAMILY DISTRICT IN THE, IN OUR GREEN BUCKET.

UM, AND I GUESS THE, THE PLAN REVEALED THAT MAYBE A DOESN'T ACCOMPLISH ALL THE THINGS THAT WE NEED TO BE ACCOMPLISHING WHEN WE'RE BUILDING THESE NEW NEIGHBORHOODS.

SO, UM, THE BEST THING THAT WE CAN DO AS, AS OF NOW IS TO MOVE A BACK DOWN TO THAT YELLOW BUCKET, WHERE IT GETS RECEIVED MORE SCRUTINY, BOTH FROM STAFF REVIEW PLANNING, COMMISSION, AND CITY COUNCIL.

AND THEN, UH, LASTLY WE NEED TO, UM, BRING THE KEY INITIATIVES FROM THE EAST ADMIN PLAN INTO THE CITY'S COMPREHENSIVE PLAN.

UM, THERE'S SOME LEGAL REASONS THAT THAT THAT'S, UM, A RECOMMENDED PRACTICE.

AND THEN IT'S JUST EASIER TO KEEP TRACK OF WHEN ALL THOSE MAJOR ACTIONS AND RECOMMENDATIONS ARE IN ONE PLACE.

AND SO THOSE ARE, THOSE ARE THE FOLLOWING THERE'S SOME WORK TO DO ON THE CROSS TIMBERS FOREST.

UM, THERE'S SOME WORK ABOUT DEVELOPING OR UPDATING, EVALUATING OUR DEVELOPMENT CODES AND REGULATIONS.

WE HAVE A LOT OF WORK TO DO AND MODERNIZE THE CITY'S APPROACH AND ROLE IN THE DEVELOPMENT PROCESS.

AND THEN, UM, EVALUATION OF THE FEASIBILITY OF DIFFERENT KINDS OF TOOLS RELATED TO FISCAL RESILIENCE.

SO THEN A COUPLE OF REVISIONS RELATED TO JUST MAKING THE PLANE A LITTLE EASIER TO USE.

UM, THIS IS A CHANGE ON THE DOWNTOWN CORE PLAN CATEGORY.

WE ARE PROPOSING TO MOVE B DUPLEX AND C ONE LOAD, UH, LOW DENSITY FROM RED TO YELLOW, WITH THE CAVEAT THAT THEY CAN BE APPROPRIATE IF YOU'RE INCREASING THE INTENSITY OF YOUR ZONING, WHICH IS, UM, WE THINK IS APPROPRIATE IN THE DOWNTOWN CORE.

SO AN EXAMPLE OF THAT, UM, WOULD BE IF YOU'RE IN A AREA THAT'S A, YOU HAVE A SINGLE UNIT YOU WANT TO, FOR WHATEVER REASON, CHANGE THAT TO TWO UNITS, UM, AS IT STANDS NOW, WE WOULD SEND YOU THROUGH THE PUD PROCESS, WHICH IS MAYBE A LITTLE ONEROUS FOR A SINGLE LOT IN THE DOWNTOWN AREA.

UH, THEN IN THE IMPLEMENTATION CHAPTER, THAT'S CHAPTER NINE, WHERE ALL THE POLICIES AND RECOMMENDATIONS ARE, OF COURSE, THAT'S A FAIRLY LENGTHY AND INVOLVED TABLE, WHICH IS KIND OF THE DEFAULT POSITION FOR PLANNERS TO ORGANIZE THE DATA, UM, IN ORDER TO MAKE THAT JUST A LITTLE FRIENDLIER TO DEAL WITH.

UM, I WOULD LIKE TO KIND OF MOVE THE INFORMATION FROM THE TABLE, FROM THE ADOPTED, THE FORMERLY ADOPTED COMPREHENSIVE PLAN TO THE WEBSITE

AND LEE OF COURSE, LEAVING IN ALL THE POLICIES, ACTIONS AND RECOMMENDATIONS IN CHAPTER NINE, KIND OF ORGANIZING THEM BY CATEGORY.

UM, IF WE CAN DO THAT, IT'LL ALLOW ME TO KEEP THE STATUS UPDATED, UM, MORE EASILY, YOU KNOW, IT'S GOT INFORMATION IN THERE ABOUT LIKE LEAD AGENCIES AND ALLIED PARTNERS AND THINGS LIKE THAT, THAT MAY THAT GO WITH EACH OF THESE ACTIONS AND RECOMMENDATIONS, BUT AS THOSE CHANGE, UM, I CAN KEEP TRACK OF THOSE AND KIND OF AN INFORMAL WAY, BUT IN ORDER TO MAKE THAT CHANGE, BECAUSE THAT TABLE IS IN THE PLAN ITSELF, IT REQUIRES THIS AMENDMENT PROCESS TO DO THAT.

UM, SO I WOULD JUST REQUEST, UM, JUST FOR THE PURPOSES OF KIND OF MAINTENANCE AND SIMPLICITY, UH, THAT THE PLAN REFLECT THE POLICIES, ACTIONS AND RECOMMENDATIONS, AND THEN THAT THE, THAT MORE DETAILED DATA ABOUT THE STATUS OF ALL OF THESE, UH, BE KEPT ON THE WEBSITE AND, AND, UM, IN OTHER PLACES, UM, THEN WE HAD SOME MINOR REVISIONS OR WAS THERE A REQUEST TO ADD REFERENCES AND, UM, FOR APPROVAL DATES FOR DIFFERENT AMENDMENTS AND THINGS LIKE THAT.

THAT'S OF COURSE A GOOD RECOMMENDATION AND, AND SOMETHING THAT WE, UM, SHOULD EASILY BE ABLE TO ACCOMPLISH.

UM, WE WANT TO ADD COPY TO THE, OF THE APPLICABLE ADOPTING ORDINANCES AND AMENDING ORDINANCES TO THE DOCUMENT.

AND THEN WE WOULD LIKE TO ADD A NOTE ABOUT THE RED, YELLOW, AND GREEN BUCKETS TO EACH PLAN CATEGORY PAGE.

AND THE REASON FOR THAT IS THE INTERACTIVE MAP ONLINE.

IF YOU CLICK THAT AND GO TO THE PLAN, IT JUST TAKES YOU STRAIGHT TO THE PAGE FOR THAT PLAN CATEGORY.

AND THEN DOWN AT THE BOTTOM, OF COURSE, IT'S GOT THIS GREEN, YELLOW, AND RED WITHOUT ANY, NO DIRECTION TO THE USER THAT YOU HAVE TO SCROLL UP ONE OR MORE PAGES TO FIND THE DESCRIPTION, WHICH IS IN THE FIRST PAGE OF THE CHAPTER.

WE THINK THAT'S APPROPRIATE BECAUSE PUD REQUIRE A LOT MORE WORK ON THE PART OF THE APPLICANT AND THE PART OF CITY STAFF ON REVIEW OF THIS BODY AND REVIEW OF CITY COUNCIL.

SO THAT THE IDEA THAT, THAT, THAT YELLOW BUCKET IS SIGNALING TO PEOPLE THAT THERE'S MORE WORK TO DO.

UM, THEN, THEN THERE IS WITH BI-RITE ZONING, WE THINK IS APPROPRIATE.

UM, WE ALSO HAD A QUESTION IF THE PUD IS IN GREEN, DOES THAT THEN MEAN I CAN GO GET A USE THAT'S IN ONE OF THE RED ZONING DISTRICTS, PUT THAT IN A PUD AND GET A MORE FAVORABLE RECOMMENDATION? OF COURSE, NO, THAT WAS NEVER OUR INTENT.
