[00:00:38]

FIRST ORDER BUSINESS IS THE APPROVAL OF THE CITY COUNCIL MEETING MINUTES FROM NOVEMBER 28TH, 2022.

[2. Approval of City Council Meeting Minutes: November 28, 2022]

MOTION TO APPROVE.

SECOND WE HAVE MOTION.

SECOND, PLEASE CAST YOUR VOTE, THE MEETING MINUTES THAT HAVE BEEN APPROVED.

NOW

[A. City Manager's Progress Report ]

WE HAVE THE HONOR DISTINCTION.

YOU RECEIVE THE CITY MANAGER'S REPORT.

TOMER, BE KIND, WHAT YOU SAY, KIND AND THE PATIENT.

.

WE'LL BE ALL RIGHT THEN.

STAFF REMINDED ME TO SPEAK SLOWER.

DO WE USE MY WASHINGTON, DC FAST? MM-HMM.

MAYOR, HAPPY TO START HERE.

YES.

SO I JUST WANT TO START OFF WITH STEVENSON PARK.

PROG, UH, PROGRESSES IS THE PARK THE SOUTH OF HERE.

UH, THAT'S BEEN UNDERWAY SINCE EARLY THIS, UH, SUMMER.

THIS 6.5 MILLION PROJECT HAS THE PRIMARY GOAL OF UPGRADING AND ENHANCING THE PARK BY CREATING MORE OPEN SPACE, AS WELL AS UPGRADES TO THE PLAYGROUND AREA, EVENT SPACE, BASKETBALL COURT, PICNIC TABLES, AND RENOVATED PAVILION.

DESIGN ALSO INCLUDES UNDERGROUND RETENTION, DETENTION, THE STORMWATER RUNOFF, AS WELL AS STREETSCAPE PARKING AND LIGHT IMPROVEMENTS TO FOURTH AND FIFTH STREETS.

CONSTRUCTION, AS I MENTIONED, HAS BEEN UNDERWAY SINCE SUMMER, AND THE, AND THE LARGE YELLOW UNDERGROUND RETENTION STRUCTURES ARE BEING CURRENTLY ARE CURRENTLY BEING INSTALLED AS WELL AS EXTENSIVE CONSTRUCTION ON FIFTH STREET.

IT HAS ANTICIPATED THAT FIFTH STREET WILL BE ABLE TO BE REOPENED THIS WEEK, WHICH I KNOW HAS BEEN A CONCERN FROM SOME OF OUR BUSINESSES AND PATRONS.

WE ARE THANKFUL FOR THEIR PATIENTS OF THE BUSINESSES AND THEIR PATRONS.

THE COUNCIL ALSO RECENTLY APPROVED THE NEW SPACE AGE PLAYGROUND STRUCTURE FOR THE, FOR THE PARK AND THE EXISTING ROCKET SHIP, WHICH I THINK TODAY WA WAS REMOVED, UH, FOR REFURBISHMENT, UH, THAT WILL BE REFURBISHED, BROUGHT BACK AND BE PART OF THE NEW, UH, REOPENED PARK.

UH, THIS SPRING OF 2023.

IT'LL BE A PROMINENT SPACE IN A ICONIC ART PIECE.

THE PARK, THE PARK PROJECT IS EXPERIENCING NO, UH, SURPRISE TO MANY OF US, SOME DELAYS AND MATERIALS FOR THE NEW PAVILION.

THE STAFF AND CONTRACTOR ARE WORKING EARNESTLY ON OPTIONS TO, UH, MITIGATE THAT IMPACT.

THE PARK IS CURRENTLY ON SCHEDULE TO BE REOPENED LATE SPRING OF 2023.

UH, THE NEXT ONE IS THE STATE OF OKLAHOMA WATER 2060 EXCELLENCE AWARD, WHICH MAYOR, YOU WERE KIND ENOUGH TO BE THERE AS WELL IN 2020.

IN 2012, THE OKLAHOMA BECAME THE FIRST STATE OF THE NATION TO ESTABLISH A BOLD STATEWIDE GOAL OF CONSUMING NO MORE FRESH WATER IN 2 20 60 THAN WAS CONSUMED IN 2010.

THE SUPPORT OF RECOMMENDATIONS BY THE SPECIAL ADVISORY COUNCIL OF THE GOVERNOR AND LEGISLATURE, THE WATER FOR WATER FOR EXCELLENCE 2060 EXCELLENCE AWARD PROGRAM WAS DEVELOPED OR RECOGNIZED EXCEPTIONAL CONTRIBUTIONS TO PROMOTION AND IMPLEMENTATION OF WATER USE SUFFICIENTLY IN, IN CONSERVATION OF OKLAHOMA'S FRESHWATER RESOURCES.

THIS PAST WEEK, THE CITY RECEIVED A PRESTIGIOUS WATER TO, FOR 20 60TH EXCELLENCE AWARD.

THE AWARD RECOGNIZED EDMOND FOR SPECIFIC EX EFFORTS.

THE FIRST WAS THE ARCADIA LAKE WATER TREATMENT PLANT CONTROL BUILDING, AND SERVING AS AN EXAMPLE OF GREEN COST SAVING WATER, SAVING INNOVATIVE ELEMENTS THROUGH CAPITAL PROJECTS THAT CAN BE IMPLEMENTED IN BUSINESSES AND HOMES.

FACILITY INCLUDES WATER EFFICIENT PLUMBING NATIVE AND ADAPTIVE LANDSCAPING, GEOTHERMAL GROUND, UH, SOURCE HEAT PUMPS, L E D, LIGHTNING LIGHTING, NOT LIGHTNING SENSORS AND E EVA AND, UH, UH, EV CHARGING STATIONS.

THE SECOND EFFORT RECOGNIZED WAS A CITY'S WATER CONSERVATION OUTREACH EFFORT.

THE WATER DEPARTMENT OFFERS TOURS THE CITIZENS, OTHER GOVERNMENTAL BODIES, AS WELL AS THE SCHOOL CHILDREN OF THE, OF, OF EDMOND, OF THE WATER TREATMENT RECOVERY, UH, PLANT.

AND THAT DURING THAT PROCESS, THEY ARE ABLE TO SHARE INNOVATIVE PROCESSES IN INVOLVING QUALITY WATER TO OUR RESIDENTS.

THE DEPARTMENT ALSO PROVIDES CLASSES ON WATER SUSTAINABILITY AND CONSERVATION, UH, TO RESIDENTS AND CITIZENS WHO WANT TO, UH, USE EFFORTS TO USE LESS WATER AND SAVE MONEY.

ADDITIONALLY, THEY HAVE COLLABORATED WITH THE UTILITY SERVICES REPS TO PROVIDE IRRIGATION SYSTEM AUDITS, RESIDENTS, WHEN THE SMART METERS ARE ROLLED OUT.

AND SINCE THE START OF THESE EFFORTS, THE CITY HAS SEEN A 45% INCREASE IN TRAFFIC AND INTEREST IN OUR WATER CONSERVATION PROGRAM.

SPECIAL THANKS TO CHRIS NING, HIS TEAM, SPECIALLY JENNIFER BOWES ON THIS SUCCESS.

AND THANKS AGAIN, MAYOR, FOR YOU WILLING TO SAY

[00:05:01]

A FEW WORDS TO THE, TO THE CONFERENCE.

MM-HMM.

.

ALL RIGHT.

SOME, SOME GREAT NEWS FOR MANY OUT HERE AS IS REDUCTION IN CITY SALES TAX RATE.

IF YOU REMEMBER, BACK IN OCTOBER OF 21, THE CITIZENS OF EDMOND VOTED FOR A DEDICATED 0.25 CENTS SALES TAX TO FUND THE ACQUISITION OF APPROXIMATELY 22 ACRES OF LAND ADJACENT TO HAYFORD PARK.

THE COST TO ACQUIRE THE LAND RAISING OF THE BUILDING ON THE LAND, ASBESTOS REMOVAL, UH, OF THAT, UH, TO THAT HOUSE.

UH, AN INTEREST THAT WE ARE GONNA PAY FOR WATER RESOURCES AND LOANS OF THE MONEY WAS $4,007,909 AND 37 CENTS.

AS OF DECEMBER OF THIS MONTH, THE SALES TAX IS GENERATED IN EXCESS OF 645 THOU $646,815 OVER THAT 4 MILLION AMOUNT, UH, WHICH WAS NECESSARY TO PAY BACK.

CURRENT ESTIMATES PROJECT THAT THE ENDING TAX COLLECTION WILL RESULT IN AN EXCESS OF 1.44 MILLION OVER THAT 4 MILLION REPAYMENT AMOUNT.

WE HAVE NOTIFIED THE STATE TO SUNSET THE SALES TAX ON DECEMBER 31ST OF THIS YEAR.

MM-HMM.

.

AS A RESULT, THE CITY SALES TAX RATE WILL RETURN TO 3.75 EFFECTIVE JANUARY 1ST, AND BASED ON THE PREVIOUS COUNSEL DIRECTION, ADDITIONAL SALES TAX REVENUE GENERATED BY THAT, THAT QUARTER CENT SALES TAX WILL BE APPLIED TO FUTURE IMPROVEMENTS TO THE 22 ACRES, AS WELL AS THE OTHER IMPROVEMENTS TO CITY PARKS.

SO IT GOES ON TO THE NEXT ONE IS WITH THAT REDUCTION SALES TAX, WE ENCOURAGE EVERYBODY THIS HOLIDAY SEASON TO SHOP LOCAL.

UM, OUR, UH, EDMOND BUSINESSES GREATLY COUNT ON THIS HOLIDAY SEASON, AND, AND WE ENCOURAGE, EMBODY TO DO SO.

UM, THEY PROVIDE THAT IF YOU SHOP IN EDMOND, IT PROVIDES OUR RESOURCES FOR OUR PARKS, FOR OUR OPERATIONS.

AND SO, PLEASE, UH, TAKE A MOMENT TO SHOP IN.

EDMOND.

LAST COUPLE OF OF THINGS I WANNA HIGHLIGHTED MORE OF A, OF A PERSONNEL NATURE IS TONIGHT.

I'M JUST GONNA HAVE YOU STAND, STEVE, BUT I WON'T HAVE YOU DO THAT, STEVE, A MANIC WHO'S BEEN OUR CITY ENGINEER.

YOU WANNA RAISE YOUR HAND? STEVE, YOU WANNA WAVE TO EVERYBODY? , MAYBE YOU WANNA WAVE TO YOUR WIFE AND SAY, HEY, I'LL BE HOME NEXT MONDAY.

TONIGHT IS CITY MANAGER STEVE MANNOX, LAST CITY COUNCIL MEETING AFTER 22 YEARS OF DEDICATED SERVICES, DEDICATION, TAKE POSITION IN THE PRIVATE OR, OR THE DARK SIDE.

.

HIS LAST DAY OF EMPLOYMENT WITH THE CITY OF EDMOND IS DECEMBER 23RD.

WE WANT TO THANK STEVE FOR OVERSEEING THE DEPARTMENT THAT HAS BEEN ON THE FOREFRONT, UH, OF CHANGE, UH, AND ADJUSTING CITY SERVICE TO MEET THE DEMAND OF GROWING COMMUNITY OVER HIS TENURE.

THE COMMUNITY'S POPULATION HAS GROWN FROM 68,000 TO 95,000.

WE'RE, WE'RE NOT BLAMING YOU FOR THAT, BUT I'M JUST SAYING WE'RE HIGHLIGHTING AND THE ENGINEERING DEPARTMENT STAFF HAS NEARLY DOUBLED TO, UH, ENSURE, UM, GREAT CUSTOMER SERVICE AS AN INTEGRAL PART OF THE CITY COUNCIL AND PLANNING COMMISSION MEETING SINCE 2001.

THEY'VE CALCULATED THIS THAT STEVE HAS ATTENDED OVER 550 OF THOSE MEETINGS FOR EACH FIRST FOR PLANNING AND FOR CITY COUNCIL.

SO HE'S BEEN HERE FOR A LONG TIME.

STEVE TELLS ME, AND HE'S NOW LOOKING FORWARD TO QUIET MONDAY AND TUESDAY EVENINGS AT HOME, RATHER THAN GIVING AN UPDATE ON THE LATEST ROAD LIGHTING PROJECT OR WEIGHING IN ON A LAND USE ISSUE.

FOUR ROUNDABOUTS, RIGHT.

? NO.

WE JUST WANT TO TAKE A MOMENT, UH, TO THANK STEVE.

I KNOW WE KIND OF JESS, BUT IT'S BEEN A GREAT RUN FOR YOU.

UH, UH, WE'LL LOOK FOR YOU IN THE PRIVATE SECTOR AND, AND, UH, UM, I KNOW YOU'LL HEAR FROM MORE OF US THROUGHOUT THIS WEEK ABOUT YOUR EFFORTS.

SO I DON DUNNO IF I, IF YOU WANNA SAY ANYTHING OR, IT'S BEEN A PLEASURE TO WORK HERE.

MM-HMM.

.

OKAY.

NO CRYING.

OKAY.

SO THE LAST ITEM I WANNA HIGHLIGHT, AND I WANT TO THANK MANY COUNCIL MEMBERS THAT WERE THERE THIS PAST THURSDAY WAS OUR HO HOLIDAY GATHERING LAST THURSDAY WAS PROBABLY THE HIGHLIGHT OF MY FIRST YEAR SO FAR WITH EDMOND.

ON THURSDAY, WE HAD OUR ANNUAL HOLIDAY LUNCHEON TO CELEBRATE OUR GREAT STAFF AND PROVIDE THEM SOME GREAT TIME TO BE TOGETHER, EAT SOME GREAT FOOD, AND JUST VISIT WITH THEIR FELLOW CITY TEAM MEMBERS.

IT, IT WAS GREAT.

I HAD A FORTUNATE OPPORTUNITY TO, TO BOTH WELCOME THEM AS THEY CAME THROUGH THE DOORS AND AGAIN, AS THEY LEFT TO RETURN TO THEIR DUTIES.

UH, AND THE MAYOR WAS KIND ENOUGH TO JOIN ME ON THAT EFFORT.

IT WAS GREAT TO SEE THEIR SMILES, LAUGHTER, AND BIG APPETITES.

MM-HMM.

.

I DON'T THINK I'VE SEEN PLATES WITH AS MUCH FOOD AS I SAW.

THAT WAS GREAT.

UH, AND ONE THING I ALWAYS SAY, IT'S ALWAYS INTERESTING TO SEE SOME OF THE, THE TOUGHEST LOOKING PEOPLE WALKING THROUGH THE FRONT DOORS, CARRYING THE BIGGEST ARM FOLDS OF TOYS FOR THE CHILDREN IN THE COMMUNITY.

UH, PERHAPS TOUGH LOOKING ON THE OUTSIDE, BUT BIG HEARTED ON THE INSIDE.

UH, THESE ARE THE PEOPLE THAT TRULY MAKE THIS CITY GREAT SPECIAL THANKS TO THE HOTEL CONVENTION CENTER, SARAH LONDON AND BILL BAGLEY FOR THEIR EFFORT TO, FOR PUTTING THAT EVENT TOGETHER.

SO, UM, THAT'S TRULY THE HIGHLIGHT

[00:10:01]

FOR ME.

IT'S GREAT TO WORK WITH YOU, BUT EVEN GREAT TO WORK WITH.

WE PROBABLY HAD 400 PEOPLE COME THROUGH THE DOORS.

UM, NOW I WAS A LITTLE BIT WORRIED WHEN I STARTED TO SEE MUD BEING TRACKED IN, BUT I THOUGHT THAT'S HOW THIS THING WORKS.

I DON'T WANT ANY DIFFERENCE OF THAT.

SO IT'S SO GREAT TO HAVE HIM THERE.

THAT MAYOR IS YOUR CITY PROGRESS REPORT.

THANK YOU VERY MUCH.

THANK YOU VERY MUCH.

THOSE NOMINATIONS NOT OUR APPOINTMENT.

NOW

[5. General Consent Items: (Items listed under General Consent are usually approved as a group with the proper motion from a member of the Council. Members of the Council may request discussion or separate action on any item under General Consent.)]

WE HAVE OUR GENERAL CONSENT ITEMS JUST FOR EVERYONE'S KNOWLEDGE THAT THOSE ARE, UH, ITEMS ARE USUALLY APPROVED AS A GROUP WITH THE PROPER MOTION TONIGHT, WE DO HAVE, UH, A COUPLE OF STAFF COMMENTS THAT ARE GONNA BE PROVIDED.

AND

[1. Approval of the City Council Strategic Plan for 2023. (Citywide)]

THE FIRST ONE IS GONNA BE ON THE APPROVAL OF THE CITY COUNCIL'S STRATEGIC PLAN FOR 2023 J.

JAMIE, DID YOU WANNA SHARE ANYTHING MORE THAN WE'RE DOING IN THE WORKSHOP? UM, WE HAD A WORKSHOP EARLIER TODAY AT THREE 30 TO GO OVER THE RESULTS OF THE PRIORITIZATION FOR THE 2023 CITY COUNCIL STRATEGIC PLAN GOALS.

UM, HAD A GREAT DISCUSSION AND I THINK WE'RE GOOD WITH THE LIST, UM, WITH THE UNDERSTANDING THAT THE PRIORITIZATION OF THE GOALS IS GOING TO BE, UH, FLUID AS WE MOVE FORWARD THROUGHOUT THE YEAR.

AND, UM, STAFF IS GONNA DO, DO A LITTLE BIT MORE RESEARCH INTO, UM, OUR RESOURCE CAPACITIES AS IT RELATES TO THOSE GOALS.

SO, AND JANE, WHERE CAN I, ONCE IT'S APPROVED, WHERE CAN I FIND THAT? UM, THAT IS ON OUR WEBSITE.

IT'S ALSO, THAT LIST WAS ATTACHED TO THE COUNCIL ITEM FOR TONIGHT'S MEETING.

VERY GOOD.

AND ALSO THERE WILL BE A HARD COPY PRINTED.

YES.

THE BENCH THAT YOU ALL MADE, UH, PICK UP AT OUTSIDE OF POLICE COUNCIL CHAMBERS.

VERY THANK

[2. Approval of the City of Edmond State Legislative Agenda for 2023. (Citywide)]

YOU.

NEXT IS APPROVAL OF THE CITY OF EDMOND STATE LEGISLATIVE AGENDA FOR 2023.

WE'RE GONNA HAVE A SHORT PRESENTATION BY OUR, OUR CONSULTING PARTNERS, CSS, TO REVIEW THE STATE LEGISLATIVE AGENDA.

YEAH.

COMING OUT.

YEAH.

THANK YOU MR. MAYOR.

AND COUNSEL.

UH, SORRY, I'M GETTING OVER A COLD, SO IF I, UH, IF I SNEEZE AWAY, IT'S NOT CONTAGIOUS, SO I'M GOOD NOW.

UH, DAYQUILL AND NAQUI HAVE BECOME MY BEST FRIENDS LATELY.

.

SO, UH, BEFORE YOU ALL, YOU'VE GOT KIND OF THE LEGISLATIVE AGENDA THAT WE WORKED WITH CITY STAFF TO KIND OF PREPARE AS WE KIND OF MOVE INTO, UM, THE 59TH LEGISLATURE, WHICH BEGINS ON FEBRUARY 6TH.

UM, WE'RE LOOKING AT OBVIOUSLY A NEW LEGISLATURE COMING IN.

WE'VE HAD A LITTLE LESS TURNOVER THAN WE'VE HAD OVER THE LAST THREE KIND OF CYCLES, SO LITTLE FEW MORE FAMILIAR FACES THAT ARE BACK.

UM, WE KIND OF BASE THIS AGENDA BOTH ON SOME OF THE CITY COUNCIL'S HISTORIC PRIORITIES, UM, AND THEN ALSO KIND OF WHAT WE SEE AS THE LEGISLATURE MOVING FORWARD WITH THIS NEXT SESSION.

UH, BROOKS AND I HAVE BEEN KIND OF WORKING WITH, UH, SOME MEMBERS OF THE EDMOND DELEGATION ALREADY TO KIND OF PREPARE THEM FOR SOME OF THE CITY'S PRIORITIES AS WE LOOK INTO IT.

UM, AND KNOW WHAT'S COMING THIS SESSION.

UM, WE'VE HAD ALREADY SOME CONVERSATIONS IN THE LAST COUPLE WEEKS, PARTICULARLY ON SOME OF THE VAPING ISSUES LEFT OVER FROM THE LAST SESSION.

I THINK YOU'VE GOT A WAY TO GET THAT RESOLVED, UM, ALONG WITH SOME OF THE ISSUES DEALING WITH SOME OF THE LAND COVENANT RESTRICTIONS.

SO, UM, WE LOOK FORWARD TO A BIG SESSION.

UM, WE OBVIOUSLY HAVE GOT, UM, KIND OF ALL THREE LEADERS THAT ARE NOW TERM LIMITED BEING THE GOVERNOR OF THE SPEAKER AND THE PRESIDENT PRO TIM OF THE SENATE.

UM, SO WE HOPEFULLY WILL SEE SOME KIND OF LEGACY BUILDING TYPE ITEMS, UH, THAT OVERALL IMPROVE THE STATE RIGHT NOW.

UM, WE DO SEE A LOT OF CONVERSATIONS HAPPENING ON TAX REFORM AT LARGE.

UM, AND DEPENDING ON WHO YOU TALK TO THAT HAS DIFFERENT MEANINGS ON IT, UM, I KNOW WE'VE BEEN MONITORING THAT SITUATION FAIRLY CLOSELY, PARTICULARLY AS THE STATE'S HAD CONVERSATIONS ABOUT ELIMINATION OF THE STATE'S PORTION OF THE SALES TAX ON GROCERIES, UM, AND HOW THAT WILL MOVE FORWARD.

UM, RIGHT NOW WE HAVE NOT SEEN ANY PLANS RELEASED, ALTHOUGH BOTH THE SPEAKER OF THE HOUSE AND PRESIDENT PROTON OF THE SENATE LAST WEEK DID ANNOUNCE THAT THEY WANT TO CONTINUE TO EXPLORE, UM, SOME OF THOSE TAX REFORM ITEMS. UM, SO WE WILL CONTINUE TO WATCH THAT, UM, MOVING FORWARD FOR EDMOND PARTICULARLY.

AND, UM, WE'VE MET WITH, UH, THE OKLAHOMA DEPARTMENT OF TRANSPORTATION A COUPLE TIMES ALONG WITH THE OKLAHOMA AERONAUTICS COMMISSION.

UM, WE'RE REALLY WATCHING WHAT'S TAKING PLACE ON, UM, O OTS FUNDING LEVELS, UM, FOR THE EIGHT YEAR PLAN.

OBVIOUSLY THE CITY OF EDMOND HAS GOT A LOT OF PROJECTS, UM, BOTH WITHIN THE CITY LIMITS AND JUST OUTSIDE OF IT THAT ARE PRETTY IMPORTANT, UM, AS WE BEGIN SOME OF THE CONSTRUCTION WORK ON I 35.

[00:15:01]

UM, SO WE WANT TO SEE OBVIOUSLY THAT FUNDING, UM, MAINTAIN LONG-TERM TO GET THOSE PROJECTS DONE AND LOOK AT SOME OF THE GROWTH ISSUES IN EDMOND.

ONE OF THE THINGS THAT WE DON'T HAVE AN ANSWER ON RIGHT NOW, AND WE'LL KNOW ON DECEMBER 29TH AFTER THE STATE BOARD OF EQUALIZATION MEETS TO DO THE FIRST REVENUE ESTIMATE IS HOW MUCH MONEY WILL GO INTO THE ROADS FUND, WHICH IS THE PRIMARY DRIVER OF, UM, HIGHWAY CONSTRUCTION PROJECTS IN THE STATE.

AND SO WE'LL BE WATCHING THAT.

LAST YEAR WAS THE FIRST YEAR THAT THAT FUND EVER WAS CAPPED OUT, UM, AND HIT ITS MAXIMUM ALLOWED BY STATUTE.

SO WE'LL SEE HOW THAT ADJUSTS OVER THE NEXT YEAR.

UH, PARTICULARLY FOR THAT.

WE ALSO THINK, UM, THE CONTINUED CONVERSATION, AND I KNOW THIS SOUNDS LIKE A LITTLE BIT OF A BROKEN RECORD, UM, ON OPEN MEETINGS ACT REFORMS TO KIND OF PERMIT SOME OF USE OF VIRTUAL TECHNOLOGIES.

UM, THAT CONVERSATION DEFINITELY WILL BE COMING BACK IN THE NEXT SESSION.

AND SO, UH, I THINK WE KNOW KIND OF WHERE THE CITY COUNCIL STANDS ON THAT AND SO WE'LL BE WORKING WITH THAT.

AND THEN OBVIOUSLY SUPPORTING, UM, SOME OF THE UCO PRIORITIES.

THE OTHER THING I WANTED TO HIGHLIGHT ON THIS DOCUMENT, UM, AND IT'S MUCH MORE, WE'VE JUST GOT IT RELATED TO MONITORING THE LEGISLATION ON MARIJUANA BUSINESSES.

UM, OKLAHOMA VOTERS WILL BE PRESENTED WITH STATE QUESTION EIGHT 20 ON MARCH 7TH, WHICH WOULD AUTHORIZE, UM, ADULT USE FOR RECREATIONAL USE OF MARIJUANA.

UM, WE ARE MONITORING THAT VERY CLOSELY AS THERE IS GONNA BE PROBABLY IF THAT PASSES A LARGE CHANGE IN MARIJUANA POLICY AT THE STATE LEVEL, UM, IF THAT IS IMP IF THAT IS VOTED ON AND APPROVED BY VOTERS, UM, BOTH IN THE MEDICAL AND THE RECREATIONAL SIDE.

AND SO WE'LL BE MONITORING THAT VERY, VERY CLOSELY AS SESSION PROGRESSES.

SO THAT'S ALL I'VE GOT.

IF THERE'S ANY QUESTIONS OR ANY OTHER DETAILS YOU'D LIKE TO PROVIDE.

NO, WE APPRECIATE THE SERVICE THAT YOU PROVIDE, PROVIDE FOR US.

THANK YOU SO MUCH.

UH, A LOT OF PEOPLE DON'T REALIZE THAT WE ARE INVOLVED WITH, UH, GIVING OUR VIEWS TO THE LEGISLATOR THROUGH VIA YOUR, YOU ALL, UM, TO HELP EDMOND BECOME A BETTER PLACE.

WE APPRECIATE EDMOND.

IT'S A, IT'S A PLEASURE TO REPRESENT YOU ALL AND YOU KNOW, WE REALLY ARE, UH, I THINK BLESSED TO HAVE A GREAT SET OF LEGISLATORS FROM THE EDMOND AREA, UM, BOTH IN THE STATE AND FEDERAL DELEGATION.

UM, YOU KNOW, I KNOW AS WE'VE TALKED OVER THE SUMMER, UM, AND KIND OF LOOKED AT IT, THERE'S A LOT OF POTENTIAL TO, TO HAVE A TEAM BUILT AROUND US THAT IS A, IN LEADERSHIP POSITIONS AND B IS WILLING TO GO THROUGH AND KIND OF GO OUT ON THE LINE TO HELP EDMOND THROUGH SOME OF THE DIFFERENT PROJECTS THAT WE'VE KIND OF BROUGHT TO 'EM.

SO WE'RE VERY THANKFUL FOR WHAT WE'VE GOT AND LOOK FORWARD TO WORKING WITH THEM MOVING FORWARD.

VERY GOOD.

THANK YOU VERY MUCH.

THANKS SO MUCH.

THE REMAINDER OF THE ITEMS ARE COUNSEL, DO YOU WANNA PULL ANY OF THOSE FOR THIS, FOR DISCUSSION? WE'RE DOING THAT FINE.

THIS IS THE PROJECT.

OKAY.

THAT'S, WE HAVE TWO OPTIONS.

WE CAN DO IT NOW OR IT'S LATER ON THE, IN THE AGENDA.

LET'S DO IT IN THE PURCHASE.

OKAY, VERY GOOD.

SO COUNSEL, WE HAVE ITEMS, UH, FIVE A ONE THROUGH FIVE.

THERE ARE GENERAL CONSENT ITEMS, MOVE TO APPROVE SECOND MOTION.

SECOND, PLEASE CAST YOUR VOTE IN THE PAST.

WE'RE GONNA HAVE A, AND

[10. Discussion and Consideration of Agreement with Flintco LLC for Construction Manager at Risk Services for the City Hall project; $75,000 (pre-construction services) (Ward 1)]

THEN I'M JUST GONNA MENTION IT.

SO YOU, SINCE YOU'RE GONNA BE UP HERE, UH, NEXT WE'RE GONNA HAVE THE DISCUSSION AND CONSIDERATION OF AGREEMENT WITH FLINTCO LLC FOR CONSTRUCTION MANAGEMENT AT RISK SERVICES FOR THE CITY HALL PROJECT FOR 75,000.

THESE ARE FOR THE PRE-CONSTRUCTION SERVICES.

THANK YOU MAYOR ANDY CONYERS, ASSISTANT CITY MANAGER OF ADMINISTRATION.

I APPRECIATE THE WAITING TILL THE PURCHASE.

I WAS TRYING TO BUILD UP THE SUSPENSE A LITTLE BIT .

SO, UM, I'M GONNA TALK IN A VERY MONOTONE GOVERNMENT E VOICE, BUT IT PLEASE DON'T LET THAT DISTRACT YOU FROM HOW, HOW EXCITING I BELIEVE THIS EVENING IS FOR THIS PROJECT TO CONTINUE TO MOVE FORWARD.

AND SO WHAT I'M GONNA DO IS, UM, TALK ABOUT THE AGREEMENT WITH FLYN CO FOR THE CONSTRUCTION MANAGER AT RISK AGREEMENT, UH, FOR THE CITY HALL PROJECT.

AND TO ME, REALLY THE WHOLE BASIS TO THIS IS TO FORM THE THREE-WAY PARTNERSHIP TO CONSTRUCT THE PROJECT.

SO OVER THE LAST SIX MONTHS, THE TWO-WAY PARTNERSHIP HAS EXISTED BETWEEN THE CITY OF EDMOND AND THE DESIGN TEAM WITH RECENT ASSOCIATES AND APPROVING THIS TONIGHT WOULD ALLOW FLINTCO TO COME ON BOARD AND I'LL TALK MORE ABOUT THAT DETAIL.

SO TO ME, A PROJECT OF THIS MAGNITUDE NECESSITATES A STRONG COLLABORATIVE TEAM WORKING TOGETHER.

AND THE EARLIER IN THE PROJECT THE BETTER.

UM, SO EVIDENCE OF THAT PARTNERSHIP IS HERE TONIGHT AND THE FORM OF RACHEL BUNDY AND FARRU CARE WITH REESE AND THEN AS WELL WITH KIRK MAMAN WITH FLINTCO.

SO APPRECIATE THEM BEING HERE THIS EVENING.

SO, UH, AN OUTLINE OF WHAT I WANNA VISIT WITH YOU ALL TONIGHT ABOUT IS, SO THE ITEM ON YOUR AGENDA AND THE ONLY VI THE ONLY IT, UH, VOTING ITEM ON THE AGENDA THIS EVENING IS THE APPROVAL OF THE AGREEMENT WITH FLINTCO FOR SEYMOUR SERVICES.

I'LL GET INTO THAT, BUT WE THOUGHT IT WAS A GOOD OPPORTUNITY.

WE'RE ABOUT 30% DONE WITH DESIGN TO GIVE A PROJECT OVERVIEW AND UPDATE, UM, AS WELL AS GO INTO A FEW DETAILS ABOUT WHAT THE CMAR PROCESS IS, UM, OF WHAT THE ACTUAL AGENDA ITEM IS, THE PATH FORWARD, AS WELL AS THE PROJECT BUDGET AND FUNDING.

AND THEN LAST BUT NOT LEAST, I THINK PROBABLY THE MOST FUN PART OF THE EVENING IS SOME FEEDBACK FROM YOU ALL.

I'D LIKE TO GET ON SOME CONEC CONCEPTUAL IMAGES HAVE BEEN DEVELOPED.

SO, AND PLEASE AT ANY POINT DURING THIS STOP, ASK QUESTIONS, HAPPY, HAPPY TO ANSWER THOSE AND HAVE A CONVERSATION.

SO, UM, SO JUST A LITTLE BIT ABOUT THIS PROJECT.

UM, SO SOME OF THE JUSTIFICATION FOR THIS REALLY, UM, THE JUSTIFICATION PRIMARILY IS, UH, THE GROWTH OF THE CITY AS CITY MANAGER HAD MENTIONED, UH, 20, 22 YEARS AGO WHEN OUR CITY ENGINEER STARTED THE COMMUNITY WITH 68,000, NOW WE'VE GROWN TO 95,000.

SO CORRESPONDING WITH THAT, WE'VE HAD A GROWTH IN OUR EMPLOYEES AND ALSO PLAN FOR THIS PROJECT AS WELL IS A NEW COUNCIL CHAMBERS, WHICH AS YOU CAN SEE BEHIND ME ON AN EVENING WHEN WE HAVE QUITE A FEW PEOPLE HERE, IT GETS A LITTLE TIGHT AND I KNOW IT'S GOTTEN TIGHTER THAN THIS BEFORE AND WE'VE HAD OVERFLOW SEATING.

AND SO YOU KIND OF KNOW THAT DRILL ALSO, RIGHT NEXT TO HERE AND AND TIED TO THIS BUILDING IT IS, IS OUR MUNICIPAL COURT, WHICH A NEW SPACE IS PLANNED FOR THAT.

AND AGAIN, IT'S TOO SMALL FOR A COMMUNITY OF 95,000.

UM, ALSO THIS PROJECT WAS IDENTIFIED, THE CITY HALL PROJECT WAS IDENTIFIED AS ONE OF THE PROJECTS IN THE 2017 REPURPOSED CIP P SALES TAX.

AND THEN AS YOU ALL TALKED ABOUT EARLIER ON, PRIORITIES FOR YOU, WHICH COME FROM CONVERSATIONS WITH THE COMMUNITY ON YOUR STRATEGIC PLAN, UH, BOTH COMPONENTS OF THIS PROJECT, BOTH THE CITY HALL AND THE ECONOMIC DEVELOPMENT, WHICH I'LL TOUCH ON, ARE TWO OF YOUR TOP FIVE PRIORITIES.

SO IT'S IMPORTANT TO HIGHLIGHT THAT.

AND CURRENTLY, UM, THE INDIVIDUALS IN THESE ARE IN THREE DIFFERENT BUILDINGS.

AND HAVING BEEN DOWN HERE NOW FOR EIGHT PLUS YEARS, WHAT THAT LEADS TO IS PUBLIC CONFUSION ABOUT WHAT BUILDING AM I SUPPOSED TO GO TO FOR WHAT.

AND THEN ALSO, UM, I BELIEVE THAT EMPLOYEE COLLABORATION SUFFERS WHEN YOU HAVE EMPLOYEES SCATTERED OVER THREE DIFFERENT BUILDINGS.

THE CHANCES OF HAVING WHAT I LIKE TO CALL COLLISIONS, WHETHER IN THE BREAK ROOM TO SAY, HEY, HAVE WE EVER THOUGHT ABOUT THIS? HAVE WE EVER THOUGHT ABOUT THAT? UM, SUFFERS WHEN YOU'RE NOT IN THE SAME SPACE.

AND ALSO I THINK IT'S IMPORTANT TO TALK ABOUT THE SECOND COMPONENT OF THIS, WHICH WILL BE A FUTURE COMPONENT OF THIS, IS THE ECONOMIC DEVELOPMENT AFTER THE OFFICE IS CONSOLIDATED.

AND I'LL HAVE A VISUAL HERE IN JUST A MINUTE TO HELP BETTER ILLUSTRATE THAT.

SO THE LOCATION, WHERE EXACTLY IS THIS GONNA BE? SO THIS IS DOWNTOWN.

SO CURRENTLY RIGHT NOW AND WHAT'S PROPOSED AS A FUTURE REDEVELOPMENT SIDE IS WHERE WE'RE AT RIGHT HERE.

UM, EARLIER WE VISITED WITH THE LEADERSHIP EDMOND CLASS IN THE DOWNTOWN COMMUNITY CENTER.

SO THAT SITE RIGHT THERE IS GOING TO BE OUR FUTURE CITY HALL.

AND I'LL GET INTO MORE OF THE DETAILS OF EACH OF THESE THINGS, BUT I THOUGHT IT'S HELPFUL TO HAVE A VISUAL OF EXACTLY WHERE THIS IS GONNA BE.

SO

[00:25:01]

THE CITY HALL WILL BE A TWO-STORY STRUCTURE CURRENTLY WHERE THE DOWNTOWN COMMUNITY CENTER IS AS YOU MOVE, UH, A LITTLE FURTHER TO THE EAST.

SO THIS IS LITTER RIGHT HERE.

PLANS ARE NOW IS FOR THAT TO BECOME ONE BIG GREEN SPACE AND TO BE CLOSED TO VEHICULAR TRAFFIC.

SO THINK OF A PLACE FOR PEOPLE TO GATHER.

AND THEN AS YOU MOVE FURTHER TO THE EAST, CURRENTLY WHERE OUR PLANNING AND PUBLIC WORKS BUILDING IS, THERE WILL BE A PARKING GARAGE BUILT THERE.

THAT WILL BE FIVE STORIES.

AND AGAIN, I'LL GO INTO MORE DETAILS ABOUT EACH OF THESE COMPONENTS AS WE MOVE FORWARD.

AND THEN AS YOU MOVE A LITTLE FURTHER TO THE EAST, THE FINAL COMPONENT OF THIS PROJECT IS A NEW MUNICIPAL COURT.

AGAIN, BECAUSE THE SPACE WE HAVE NOW IS NOT LARGE ENOUGH TO, UH, FULFILL THE NEEDS OF THE COMMUNITY.

SO THIS PART WILL BE ALONG BOULEVARD OVER HERE TO THE EAST.

AND THEN OUR STREET HERE ON THE NORTH, SOUTH ON THE NORTH SIDE IS MAIN.

AND ON THE SOUTH SIDE HERE IS FIRST, AND THEN OVER HERE IS BROADWAY.

SO JUST TO HELP ORIENTATE WHERE WE'RE AT.

SO A LITTLE BIT ABOUT THE PROJECT OVERVIEW AND UPDATE.

SO THE CITY HALL PROJECT IS PLANNED, UM, TO BE TWO STORIES AND 59,000 SQUARE FEET.

AND SO FOR THE PAST SIX MONTHS, WE'VE SPENT LOTS OF TIME WITH THE HIGHER DESIGN CONSULTANT, REESE, VISITING WITH CITY STAFF AS WELL AS THE OVERSIGHT COMMITTEE TO FIGURE OUT THE PROGRAMMING AND HOW MANY SQUARE FEET NEEDS TO BE IN EACH OF THESE SPACES.

SO THAT'S HOW WE ARRIVED AT 59,000 SQUARE FEET.

SO THE DEPARTMENTS THAT ARE BEING INCLUDED ON THE FIRST FLOOR ARE THE PLANNING AND ZONING DEPARTMENT, THE ENGINEERING DEPARTMENT BUILDING AND FIRE CODE SERVICES.

AND THEN ON THE SECOND FLOOR, THE OFFICE SPACE FOR THE MAYOR AND CITY COUNCIL, THE CITY MANAGER, CITY ATTORNEY, RISK MANAGEMENT, CITY CLERK, MARKETING URBAN FORESTRY AS WELL IN THIS BUILDING WILL BE A CITY COUNCIL CHAMBERS THAT'S PLANNED TO BE ABOUT THREE TIMES THE SIZE OF THIS SPACE TO AGAIN, ACCOMMODATE THE NEEDS OF A GROWING COMMUNITY.

AND ALSO THE PLAN IS, UM, FOR IT TO BE FLAT FLOORED AND TO HAVE DETACHED SEATS.

SO THINK HAVING MORE FUNCTIONALITY AS A SPACE.

SO THIS SPACE IS A BIT HARDENED AND THE ONLY THINGS THAT CAN REALLY OCCUR HERE ARE PUBLIC MEETINGS.

SO WE'RE VERY INTENT ON MAKING SURE THAT, UM, IT'S NOT JUST A SPACE FOR PUBLIC MEETINGS, BUT IT'S ALSO A SPACE FOR OTHER THINGS AS WELL.

UM, AND THEN WE'LL ALSO BE IN THIS BUILDING WILL BE PUBLIC MEETING SPACE.

SO THERE IS PUBLIC MEETING SPACE CURRENTLY AVAILABLE IN THE DOWNTOWN COMMUNITY CENTER.

SO WHEN THAT IS, UH, DEMOLISHED, THAT WILL GO AWAY.

SO THERE'S PLANS TO ACCOMMODATE FOR THAT, UM, AS WELL.

AND THIS BUILDING IS PLANNED FOR ABOUT 3,300, UH, SQUARE FEET OF SHELL SPACE.

SO FOR FUTURE GROWTH.

SO THAT 59,000 IN WORKING WITH DEPARTMENTS, THE QUESTIONS THAT WE ASK WERE, WHAT ARE, HOW MANY EMPLOYEES DO YOU HAVE TODAY? WHERE DO YOU SEE THAT GOING OVER THE NEXT 10 YEARS? AND THEN IN ADDITION TO THAT, WE ALSO THOUGHT ABOUT, LET'S LOOK A LITTLE FURTHER IN THE FUTURE.

AND SO WE ADDED 3,300, UM, SQUARE FEET OF SHELL SPACE.

SO ROUGHLY THAT WOULD, UM, ADD 40 ADDITIONAL OFFICES OR WORK STATIONS.

SO LOTS OF FLEXIBILITY BUILT IN THERE.

SO, UH, THE SECOND, UH, THE OTHER PART OF THIS, SO REALLY I LIKE TO THINK OF THIS IS THREE LARGE STRUCTURES.

SO YOU HAVE YOUR CITY HALL AND YOU HAVE YOUR PARKING DR PARKING GARAGE, WHICH IS PLANNED TO BE FIVE STORIES, UH, 350 PARKING STALLS.

AND IT WILL MEET THE NEEDS IN NOT ONLY THE CITY HALL IN MUNICIPAL COURT, THE EMPLOYEES IN THEM AND THE RESIDENTS THAT COME TO INTERACT, BUT ALSO PROVIDE PUBLIC PARKING.

SO IT'S LARGE ENOUGH TO HELP AREA-WIDE PARKING.

UM, AND THEN ALSO AS YOU'LL SEE IN THE RENDERINGS, CURRENTLY WE'RE SHOWING THE POTENTIAL FOR RETAIL SPACE ON THE FIRST FLOOR OF THAT.

SO WE REALLY LIKE THE IDEA OF, UM, AGAIN, THERE'S NOTHING DEFINITIVE, BUT LIKE THE HAVING THE OPTION AND MORE CONVERSATIONS AS THE PROJECT PROGRESSES.

AND THE RENDERINGS WILL HELP SHOW KIND OF HOW IT BREAKS UP THE PARKING GARAGE A LITTLE BIT AND ADDS A LITTLE MORE, UM, CHARACTER TO, TO THE SPACE.

AND THEN DIRECTLY TO THE EAST OF THAT WILL BE MUNICIPAL COURT, WHICH IS THE FINAL BUILDING IN THIS, WHICH IT'LL BE ONE STORY EXPANDED COURTROOM AND LOBBY AND ADDITIONAL OFFICE SPACE.

CURRENTLY THE STAFF DEALS IN VERY SENSITIVE CASES OF A VERY SENSITIVE NATURE AND THE EMPLOYEES JUST DUE TO SPACE ARE RIGHT ON TOP OF EACH OTHER.

AND SO THIS'LL PROVIDE A LITTLE MORE PRIVACY WHEN WE'RE DEALING WITH THOSE CASES, UM, TO INTERACT WITH THEM.

SO, SO THE CONSTRUCTION MANAGER AT RISK PROCESS, AND I REALIZE THAT IS A LOT TO PUT ON A SLIDE, SO I'LL JUST TRY TO KIND OF BRIEFLY GO THROUGH IT JUST A LITTLE BIT.

SO THIS IS A NEW PROCESS FOR US.

SO THE CITY TRADITIONALLY HAS JUST DONE DESIGN BIDIL AND I'LL TALK MORE ABOUT THAT IN THE SECOND BULLET POINT, BUT KIND OF WHY WE FEEL LIKE, UM, THIS IS THE BEST, UM, PROJECT DELIVERY METHOD FOR THIS PROJECT.

SO THERE'S TWO COMPONENTS IN THE CONSTRUCTION MANAGER AT RISK PROCESS.

SO THERE'S PRE-CONSTRUCTION SERVICES AND THEN THERE'S CONSTRUCTION SERVICES.

SO SOME OF THE THINGS THAT, UH, WE'RE AGREEING WITH FLINT CODE THAT THEY WILL PROVIDE IN THE PRE-CONSTRUCTION SERVICE, WHICH IS ON THE AGENDA DENIED TO APPROVE FOR $75,000 IS COST ESTIMATES, LEAD TIME ANALYSIS, VALUE ENGINEERING.

AND THEN ALSO FINALLY WHEN WE NEAR THE END OF THE DESIGN PHASE FOR THEM TO SET A GUARANTEED MAXIMUM PRICE.

SO THAT WILL BE THE PRICE THAT THE PROJECT WILL COME IN AT.

SO WORKING IN CONJUNCTION WITH US, THE CITY, THE OWNER AND REESE, THE DESIGN TEAM, UM, FLINTCO WILL

[00:30:01]

WORK TO SET THAT GUARANTEED MAXIMUM PRICE.

AND THEN WE'LL TALK ABOUT WHAT THE PROJECT BUDGET YOU HERE IS IN.

SECOND, I THINK IT'S ESPECIALLY IMPORTANT THIS WHY WE'RE CHOOSING THIS DELIVERY METHOD WHEN YOU TALK ABOUT LEAD TIME ANALYSIS.

SO YOU HEARD FROM GLEN FISHER, THE EDMOND ELECTRIC DIRECTOR EARLIER ABOUT ISSUES WITH GETTING CERTAIN THINGS RELATED TO ELECTRICAL INFRASTRUCTURE.

SO ALL THE MORE REASON TO HAVE YOUR GENERAL CONTRACTOR ON BOARD DURING THE DESIGN PHASE CUZ THEN THEY CAN IDENTIFY THOSE AND THEN WE CAN ORDER THOSE TO KEEP THE PROJECT ON TASK AND ON TIME.

UM, DURING THE CONSTRUCTION PHASE, THE GENERAL CONTRACTOR, UH, PUTS THEIR GC HAT ON AND THEN LE THEY DO THE PROCUREMENT OF SUBCONTRACTORS, COST MANAGEMENT STATUS REPORTS, QUALITY CONTROL AND PROJECT CLOSEOUT.

SO EVERYTHING RELATED TO THE CONSTRUCTION OF THEY MANAGE THAT.

UM, SO, UH, A LITTLE BIT ABOUT, SO TRADITIONALLY DESIGN BID BUILD HAS WORKED VERY WELL FOR US.

IF, SAY FOR EXAMPLE, WE'RE WIDENING AN INTERSECTION, SO THINGS THAT MAYBE DON'T HAVE NEARLY AS MANY COMPONENTS AND WE'RE STILL COMMITTED TO THAT PROCESS.

BUT THINGS THAT ARE SO, UH, DETAILED AS BUILDING BUILDINGS, WE FEEL LIKE IT'S REALLY ADVANTAGEOUS TO HAVE SOMEBODY THAT HELPS ACQUIRE ALL THESE SUBCONTRACTS THAT COME WITH THAT.

AND AGAIN, HELPS US, HELPS US ESPECIALLY IDENTIFY WHERE WE COULD GET STUCK AND NOT MEET SCHEDULES DURING THE PRE-CONSTRUCTION PHASE.

WE FEEL LIKE THIS IS THE BEST PROJECT DELIVERY METHOD FOR THIS.

UM, SO MOVING DOWN THE LIST JUST A LITTLE BIT, AGAIN, JUST A REMINDER, I HAD TO PUT IT IN HERE LIKE THREE OR FOUR TIMES CUZ OUR CITY ATTORNEY ASKED ME A FEW TIMES TO MAKE SURE IT WASN'T IN HERE.

JUST ONE OR TWO TIMES WHENEVER HE SPEAKS UP AND SAY, HEY, DO THIS, IT'LL HELP KEEP YOU OUTTA TROUBLE.

I USUALLY TRY TO LISTEN MM-HMM.

.

SO I THAT'S, I LEARNED A FEW THINGS , SO YEAH, THERE YOU GO.

UM, SO HOW FLINTCO WAS SELECTED, WE HAD A REQUEST FOR QUALIFICATION PROCESS.

WE HAD 11 VERY QUALIFIED TEAM SUBMIT.

WE INTERVIEWED FOUR.

AND THEN THE OVERSIGHT COMMITTEE, UH, SELECTED FLINTCO.

SO AGAIN, THIS AGENDA ITEM IS JUST FOR PRE-CONSTRUCTION SERVICES, THE 75,000.

IT ALSO IS THE CM R FEE THAT IS 3.95%.

SO OF THE GUARANTEED MAXIMUM PRICE, WHICH I'LL GET TO THE PROJECT BUDGET IN A SECOND, THEN FLINTCO FOR PERFORMING THESE SERVICES WILL RECEIVE 3.95% OF THAT.

AND THEN ALSO WHAT'S IN THERE IS THE CONDITIONS AND THE PROCESS FOR HOW THIS WILL WORK.

SO FOR THIS PROJECT, WHAT WE ANTICIPATE IN FUTURE AGENDA ITEMS, THIS PROJECT WILL BE BUILT WITH THREE TO FOUR SUB, UH, SUBPAGES TO CONSTRUCT THE PROJECT.

SO EACH TIME WHAT THIS WILL LOOK LIKE, UH, FOR EXAMPLE, UM, THEY'LL ALL BE COMPETITIVE, BE BID UNDER TITLE 61.

AND THEN IN CONJUNCTION WITH THE ARCHITECT'S CONSTRUCTION DOCUMENTS, THE RECOMMENDATION WILL BE FR BROUGHT BEFORE CITY COUNCIL AND THEN FUNDS WILL BE ENCUMBERED.

FOR EXAMPLE, WHAT THAT LOOKS LIKE FOR THIS PROJECT.

THE FIRST SUBPAGE IS GONNA BE THE DEMONIZATION OF, UM, THE DOWNTOWN COMMUNITY CENTER AND THE PLANNING AND PUBLIC WORKS BUILDING.

SO FLINT CO WILL WORK HAND IN HAND WITH US AND WITH THE ARCHITECT TO PUT TOGETHER THAT PACKAGE.

THEY'LL GO OUT, SOLICIT BIDS ON THAT, AND THEN THEY'LL WRITE A RECOMMENDATION.

AFTER THOSE BIDS COME IN, WE WILL COME TO THE CITY COUNCIL AND SAY, HERE IS STAFF'S RECOMMENDATION ALONG WITH THE SMAR, AND THEN WE ENCUMBER THOSE FUNDS FOR THAT.

SO THAT'S EXACTLY HOW THE PROJECT, THAT'LL WORK FOR ALL THREE, ALL THREE TO FOUR OF THOSE SUBPAGES.

AS WE GET INTO IT WITH FLINTCO AND REESE, WE'LL TALK ABOUT IF THERE'S THREE, IF THERE'S GONNA BE FOUR, BUT THAT'S HOW THE PROJECT WILL BE CONSTRUCTED.

SO THE ONLY FUNDS THAT ARE BEING ENCUMBERED DENIED ARE THE $75,000 FOR FREE SERVICES AND THEN THE PROJECT BUDGET.

UM, SO NOW THAT DESIGN IS 30% COMPLETE, WE FEEL IT'S APPROPRIATE TO SET UP THE NUMBER.

UM, SO REALLY WANTED TO MAKE SURE THAT WE WERE PROPERLY DEFINING EXACTLY WHAT THIS PROJECT IS.

SO AGAIN, NOW WE KNOW IT'S 59,000 SQUARE FEET FOR THE CITY HALL.

WE ESTIMATE IN WORKING WITH FLINT CO AND REESE THAT THIS WILL COST 23.6 MILLION.

SO THE TOTAL PROJECT BUDGET TO CONSTRUCT THIS PROJECT IS 44 MILLION.

AND IT'S A BREAKDOWN OF EACH OF THOSE.

UH, SO THE COURT, YOU CAN SEE THAT'S 6 25, THE PARKING GARAGE, A LITTLE UNDER 9 MILLION.

AND THEN THE FF AND E TO EQUIP THE SPACES AND THE COURT AND CITY HALL AND FOR THE DEMO AND ABATEMENT OF THE TWO BUILDINGS AND THE LANDSCAPING AND FOR THE PROJECT.

AND SOMETHING I DIDN'T TALK ABOUT A LITTLE BIT IS WE KNOW THAT THERE'S GONNA HAVE TO BE SOME STREET IMPROVEMENTS ASSOCIATED WITH THIS PROJECT TOO.

SO MAIN STREET, SO MAKING BETTER USE OF THE LANES THAT ARE OUT THERE NOW TO MAKE SURE PEOPLE CAN ACCESS IT THE MOST EFFICIENTLY.

SO THAT'S, WE, WE ESTIMATE THAT AT CURRENTLY TO DESIGN AND THEN ALSO MAKE THOSE IMPROVEMENTS AT $500,000.

SO THAT'S IN, THAT'S IN THE SCOPE AS WELL.

ADDITIONALLY, WE'RE ALSO, WE KNOW IN A FUTURE PHASE THERE'S GONNA BE A LIGHT REQUIRED AT BOULEVARD IN MAY.

SO WE WILL, THE DESIGN OF THAT WILL BE IN THIS, BUT WE DON'T ANTICIPATE THAT BEING WITHIN THIS PROJECT BUDGET.

UM, WE'RE CONCERNED ABOUT LEAD TIME ISSUES, BUT AGAIN, IT'S WHY IT'S VERY HELPFUL TO HAVE FLINT CO ON BOARD TO HAVE YOUR GC ON BOARD.

SO WE CAN TALK ABOUT THOSE THINGS.

TALK ABOUT DO WE WANT TO DO THE LIGHT? WHY ALL THIS IS UNDER CONSTRUCTION, CAN WE ACTUALLY GET THE LIGHT IN HERE ON TIME? CAN WE NOT? SO WE'LL, WE'LL MAKE THOSE DECISIONS AS WE GO.

SO THAT IS ALL THE THINGS UNDERNEATH THE PROJECT BUDGET.

UM, COMPONENTS THAT

[00:35:01]

ARE OUTSIDE THAT PROJECT BUDGET THAT WE'RE CURRENTLY LOOKING FOR ADDITIONAL SOURCES FOR ARE THE GREEN SPACE THAT I MENTIONED.

SO AGAIN, THAT COMMUNITY GATHERING SPACE THAT'S BETWEEN THE BUILDINGS, WE ANTICIPATE THE BUDGET FOR THAT TO BE $1 MILLION.

AND THEN THE TRAFFIC LIGHT AT BOULEVARD AND MAINE WOULD BE ANOTHER MILLION DOLLARS AS WELL.

SO, AND THEN SOURCE OF FUNDS.

SO CITY MANAGER ALWAYS MAKES SURE THAT I ADD SOME SLIDE ABOUT HOW WE'RE ACTUALLY GONNA PAY FOR THIS, WHICH I THINK IS AN IMPORTANT THING.

UM, SO AS WE HAD MESSAGED TO YOU ALL DURING YOUR STRATEGIC PLANNING SESSION ON NOVEMBER 4TH, UM, TO COMPLETE THIS PROJECT AS WELL AS THE SECOND LIBRARY IN Y M C A, WE'RE GONNA HAVE TO BORROW FUNDS.

SO CURRENTLY WHAT WE'RE PROPOSING IS TO BORROW 80 MILLION, THAT'S OVER 15 YEARS.

AND THE INTEREST RATE THAT WE'RE LOOKING AT RIGHT NOW IS FOUR AND A HALF PERCENT, UM, WITH REPAYMENT COMING FROM THE 2000 CIP P SALES TAX.

SO STAFF RE RECENTLY MET WITH OUR FINANCIAL ADVISOR AND BOND COUNCIL AND TALKED ABOUT, UM, MECHANISMS TO ACCOMPLISH THIS, AGAIN WITH THE GOAL OF $80 MILLION 44 FOR THIS, AND THEN 30 MILLION TO CONSTRUCT THE SECOND LIBRARY IN Y M C A.

UM, AND JUST A REMINDER, WE'VE ALREADY ENCUMBERED 3 MILLION FOR THE DESIGN OF THAT PROJECT.

WE PAID FOR THAT OUTTA CASH AND 4 MILLION FOR THE LAND.

SO THE INTENTION WOULD BE IS TO REPAY OURSELVES, UH, FROM THE BORROWED MONEY AND THEN WE'LL FREE UP SOME CASH THAT WE'VE ALREADY PAID FOR OR THE DESIGN.

SO THAT'S WHERE THE 80 MILLION COMES FROM.

AND IT'S NOT JUST FOR THIS, BUT IT'S ALSO TO ALLOW US TO CONTINUE FORWARD ON THEIR CAPITAL PROJECTS.

SO PLAN MOVING FORWARD IS FOR THE BOND COUNCIL AND THE FINANCIAL ADVISOR TO COME TO THE JANUARY FINANCE COMMITTEE MEETING AND THEN TO OBTAIN THE FUNDS IN MARCH, APRIL.

SO THAT WOULD ALL COME BEFORE THE CITY COUNCIL.

UM, AND THEN REPAYMENT OF THIS PLUS EXISTING OBLIGATIONS, WHICH, UM, 40 MILLION WERE BORROWED IN JULY OF 2021.

ONE OF THE BIG PROJECTS WITH THAT, WHICH IS NEARING COMPLETION, IS THE KI BIRD GOLF COURSE.

UM, I WANTED TO DO A COMPARISON OF WHAT THIS LOOKED LIKE TO BORROW ALL, TO BORROW THIS MONEY.

WHAT DOES IT LOOK LIKE COMPARED TO OUR CASH FLOW? SO FROM, AS A REMINDER, WE HAVE TWO, TWO PRIMARY SOURCES OF FUNDS FOR THIS.

SO TWO DEDICATED SALES TAX, THE 2000 CIP P IN THE 2017 CIP P.

SO THE C CURRENTLY THE CIP, THE 2017 CIP P IS SCHEDULED THE SUNSET MARCH 31ST, 2027.

SO WE LOOKED AT BOTH OF THIS.

IF IT'S EXTENDED, UM, BASICALLY IT TIES UP 26% OF THE CASH FLOW.

IF IT'S NOT EXTENDED, THEN IT TIES UP 35% OF THE CASH FLOW OVER THAT 15 YEARS THAT THIS $80 MILLION IS, UM, LOOKING AT BEAN BAR.

AND THEN ALSO WE'RE LOOKING AT REPAYMENT TO THOSE FUNDS OF THE SALE OF THE LAND THAT SURROUNDS THIS, THAT ONCE THE CITY VACATES, THEN WE WILL SELL.

AND THEN FUTURE TIF REVENUE BY CURRENTLY THE CITY HOLDING THIS, HOLDING THESE PROPERTIES THAT ARE GONNA BE REDEVELOPED.

THERE'S NO PROPERTY TAX THAT COMES IN ON THAT CUZ THE CITY'S, UH, EXEMPT FROM PAYING PROPERTY TAX.

BUT ONCE THOSE ARE SOLD TO PRIVATE DEVELOPMENT, THEN THERE WILL BE TIF REVENUE GENERATED OVER THE LIFE OVER THE 20 YEAR LIFE OF THE TIF.

UM, SO THE FUN PART, SO THANKS FOR BEARING WITH ME A BIT.

WE GOT SOME CONCEPTUAL IMAGES, SO BIG THANKS TO REESE AND WORKING WITH THE OVERSIGHT GROUP OVER A NUMBER OF ONE OTHER, A NUMBER OF MONTHS TO COME TOGETHER ON THESE.

UM, SO WE'RE INTERESTED IN YOUR FEEDBACK JUST TO KIND OF TO KNOW ARE WE ON THE RIGHT TRACK WITH SOME OF THESE AND KIND OF WHAT DO YOU THINK? SO WHAT YOU'RE GONNA SEE ARE THREE DIFFERENT VERSIONS AND FIVE PICTURES OF EACH VERSIONS.

SO THERE'S LOTS OF DIFFERENT COMPONENTS TO EACH SET.

UM, REALLY FOR US THOUGH, THE PROJECT GOALS WHEN WE SAT DOWN WITH REESE MANY MONTHS AGO TO DO THIS WAS BUILDINGS AND SPACES THAT THE COMMUNITY AND OUR EMPLOYEES CAN BE PROUD OF.

AND WE FEEL LIKE WITH THESE IMAGES, UM, THAT WE'RE CREATING THOSE SPACES.

SO IS THIS WHERE WE SHOULD SAY, OOH, YEAH, I THINK SO.

YOU SHOULD, YOU SHOULD DEFINITELY DO THAT.

SO HERE'S, HERE'S THE FIRST IMAGE.

AGAIN, THERE'S, THERE'S FIVE PICTURES OF EACH VERSION.

SO THIS IS, THIS IS MAIN STREET RUNNING ALONG HERE.

AND SO WE'RE LOOKING BACK TO THE SOUTH RIGHT HERE AGAIN, A TWO STORY BUILDING.

UM, AND HERE'S FROM THE COURTHOUSE LOOKING SOUTHWEST.

SO HERE'S MAIN STREET RIGHT HERE, AND THEN HERE'S BOULEVARD RIGHT HERE.

SO AGAIN, ONE STORY, UM, AND HERE'S WHAT THIS LOOKS LIKE IN THE EVENING.

SO WE WANTED TO HAVE A NIGHT VIEW OF KIND OF WHAT THIS MIGHT LOOK LIKE.

AND THEN HERE'S THE GARAGE.

SO AGAIN, THE GARAGE WILL BE FIVE STORIES AND THIS, UH, THIS LITTER THAT WILL BE CLOSED TO, UH, VEHICULAR TRAFFIC IS RIGHT HERE.

WE'RE STILL EARLY ON IN THE DEVELOPMENT OF WHAT MIGHT GO IN THERE.

AND SO WE DIDN'T HAVE IMAGES TO SHOW THIS EVENING, BUT, UM, WE'RE WORKING, UH, WITH THE ARCHITECT ON THAT AND THE LANDSCAPE ARCHITECT'S BEEN HIRED.

SO FIVE STORIES FOR US.

WHAT'S A MUST ON THIS IS THAT IT'LL BE SCREENED ON ALL SIDES.

SO WE REALLY WANNA MAKE SURE THAT IT'S NOT SOMETHING THAT'S JUST UTILITARIAN AND SERVING THE USE OF PARKING CARS, THAT THEY'LL BE SCREENING ON ALL SIDES AS WELL.

SO HERE WE GO.

AND THERE'S JUST AN OPTION WHAT THAT MIGHT LOOK LIKE IN THE EVENING.

CURRENTLY, HERE'S WHERE THE RETAIL SPACE IS SHOWN RIGHT HERE.

AND AGAIN, WE'RE

[00:40:01]

TALKING ABOUT IS THAT, UH, WE BELIEVE THAT'S A COMPONENT WE WOULD LIKE TO KEEP, BUT WE WANT TO MAKE SURE, UM, THAT IT'S SOMETHING THAT COMES WITHIN THE PROJECT BUDGET.

SO FOR THE, FOR PARKING GARAGES, I LEARN A LOT AND EVERY PROJECT I DO, SO ROUGHLY IT'S $25,000 PER SPACE FOR, FOR A PARKING GARAGE.

SO START DOING THE MATH THAT ADDS UP TO JUST UNDER $9 MILLION FOR 350 SPACES.

SO ANY, ANY THOUGHTS ON IMAGES IN THE ONE OR ARE WE ON, ARE WE ON THE RIGHT TRACK? I DON'T KNOW IF MAYOR SERVED ON THE OVERSIGHT COMMITTEE, AS HAS COUNCIL MEMBER CHAPMAN.

ANY ANY THOUGHTS OR THINGS YOU'D LIKE TO DISCUSS AT THIS POINT? BRILLIANT LEADERSHIP.

YOU HAND GOOD LEADERSHIP? YES, SIR.

CAN WE TALK ABOUT FUNCTIONALITY FOR A SECOND? YEAH, YOU BET.

DID YOU DO, DID I HEAR THAT YOU DID SOME SURVEYING OF EMPLOYEES AND MM-HMM.

KIND OF HIERARCHY OF NEEDS AND CAN YOU TALK ABOUT THAT? YEAH, ABSOLUTELY.

SO WHAT WE MADE SURE THAT WE DID IS, AND I DIDN'T HAVE THE FLOOR PLANS FOR EACH OF THE FLOORS, BUT WHAT WE REALLY WANTED TO MAKE SURE THAT WE DID IS, UM, SO REESE HAS SPENT MANY HOURS WITH DIFFERENT DEPARTMENTS TALKING ABOUT WHO, WHO DO YOU NEED ADJACENCIES TO? AND SO WE TALKED, FOR EXAMPLE, PLANNING, ENGINEERING AND BUILDING SERVICES DOES A LOT OF WORK TOGETHER.

SO WE WANTED TO MAKE SURE THERE WAS ADJACENCY.

THERES, SO ONCE YOU'RE, ONCE YOU'RE BEHIND SORT OF THE, THE FOB ACCESS OR SECURITY DOORS, THEN THERE'S, WHICH SECURITY WAS KIND OF HIGH ON THE LIST, SECURITY WAS HIGH ON THE LIST.

I CAN, I CAN TOUCH ON THAT IN A MINUTE TOO.

BUT WE WANTED TO MAKE SURE THAT THERE'S FLOW WITHIN THE DEPARTMENTS.

AND SO IT DOESN'T SEEM LIKE YOU'RE SILOED WITHIN YOUR DEPARTMENT.

THAT, AND WE MAKE IT MUCH EASIER.

AND MEETING SPACES AREN'T NECESSARILY DESIGNATED TO DEPARTMENTS.

THEY'RE BASED UPON THE FLOOR.

SO EACH, EACH AREA WILL HAVE DIFFERENT COLLABORATIVE SPACES WHERE THEY CAN, WHERE THEY CAN MEET CURRENTLY NOW IN OUR BUILDINGS TOO, AND I SORT OF, I, I DIDN'T TOUCH ON THIS, I SHOULD HAVE, I KIND OF SKIPPED OVER IT.

WE, WE HAVE MADE THE MOST EFFICIENT USE OF OUR CURRENT OFFICE SET UP.

UM, I THINK IT'S PRETTY REMARKABLE.

WE TALKED ABOUT WINNING A WATER QUALITY WARD.

WE NOW HAVE EMPLOYEES IN , FORMER CLO ADAPT THINGS THAT USED TO BE CLOSETS, THINGS THAT USED TO BE COPY ROOMS, UM, THINGS THAT WERE STORAGE ROOMS, BASEMENTS.

AND SO I THINK, UM, NOT MANY WINDOWS NOT, YES.

SO WINDOWS NATURAL LIGHT IS DEFINITELY SOMETHING THAT WAS A HUGE GOAL WHEN WE SAT DOWN WITH RISA THIS, AND YOU'LL READ STUDY AFTER STUDY OF WHAT LEADS TO EMPLOYEE HAPPINESS AT WORK IS NATURAL LIGHT.

SO WE WANTED TO MAKE SURE WE COULD INCORPORATE AS MUCH OF THAT AS WE COULD WITH IT.

BUT YES, DEFINITELY, UH, COLLABORATIVE SPACES CURRENTLY NOW WHAT WE HAVE, I WOULDN'T CALL THEM BREAK ROOMS OF ANYTHING, THEY'RE MORE LITTLE KITCHENETTES.

SO WE WANTED TO MAKE, UH, INVITING SPACES WHERE EMPLOYEES WOULD GATHER AND THEN IDEAS CAN BE FOSTERED FROM.

SO YEAH, VERY INTENTIONAL ABOUT THAT.

SO THE, YOU KNOW, WHERE WE'VE GOT PUBLIC SPACES AND THEN THINKING ABOUT SECURITY MOVING INSIDE, WHICH I KNOW IS HIGH ON THE LIST MM-HMM.

AND THEN, UH, WINDOWS.

A LOT OF WINDOWS, A LOT OF LIGHT HAS, HAS COME INTO THAT AND HELPED KIND OF FORM YEAH.

FORM THE, THE SH THE THE FORM AND FUNCTION YEAH.

OF THE BUILDING.

YEAH, YOU BET.

SO BASICALLY THERE'LL BE, THERE'LL BE LAYERS OF SECURITY.

SO THERE'LL BE SECURITY TO GET IN, GET IN THE BUILDING, NOT ONLY FOR THE PUBLIC, BUT ALSO FOR EMPLOYEES.

BUT THEN THEY'LL BE FOB ACCESSED, SO THE PUBLIC WILL BE ABLE TO BE IN CERTAIN SPACES, THE MEETING ROOM SPACES, THE COUNCIL CHAMBERS AFTER THEY GO THROUGH THE FIRST LAYER.

BUT THEN AFTER THAT TO GET SOMEWHERE ELSE, THEN YOU'RE GONNA HAVE TO HAVE SECURITY ACCESS, YOU'RE GONNA HAVE TO HAVE STAFF COME OUT AND GET YOU TO, TO LEAD YOU BACK INTO THAT SPACE.

WE TRIED TO DESIGN A LOT OF THE MEETING ROOMS ALSO THAT ARE IN, UM, OUTSIDE OF THE DEPARTMENT SPACE TOO.

SO IF AN APPLICANT FOR A PLANNING PROJECT WANTS TO COME IN AND TALK TO OUR CITY PLANNER, THEN THEY CAN DO THAT AND NOT HAVE TO GO BACK INTO THE CITY PLANNER'S PRIVATE SPACE IN THE OFFICES.

SO, UM, SO AGAIN, JUST SOME DIFF REALLY THE, THE SOME OF THE BIGGEST, UH, CONTRAST IN THE IMAGES IN SETS ONE, TWO, AND THREE ARE THE, ARE THE FINISHES THAT WE'VE BEEN WORKING WITH A LITTLE BIT.

UM, SO AGAIN, SAME VIEWS FROM THIS, LOTS OF NATURAL LIGHT, UH, A NICE BIG INVITING BREEZEWAY.

UM, AND THEN QUART, YOU CAN SEE THE FINISHES ARE A LITTLE DIFFERENT IN THIS.

UH, AND THEN HERE'S THE NIGHTMARE OF THAT.

UM, LOTS OF DIFFERENT OPTIONS THAT WE COULD PLAY WITH WITH COLOR, JUST SHOWING THIS AS DIFFERENT THINGS AND IT'S NOT, NOT CERTAINLY NOT ASKING PICK ONE, TWO, OR THREE THIS EVENING, BUT THESE ARE JUST DIFFERENT, DIFFERENT IDEAS AND THERE'LL BE LOTS MORE PUBLIC CONVERSATIONS.

WE REALLY DIDN'T WANT, WANT TO TALK TOO MUCH BECAUSE I THINK IT'S HARD.

I KNOW FOR ME, I'M A VERY VISUAL PERSON.

UNTIL WE HAD THESE IMAGES, I THINK IT'S DIFFICULT TO TALK TO THE PUBLIC.

SO WE'LL HAVE LOTS, LOTS MORE PUBLIC CONVERSATIONS AFTER THIS EVENING, ASSUMING THINGS CONTINUE TO MOVE FORWARD.

SO, UH, AND THEN FINALLY THE, THE THIRD, UM, JUST SHOWING JUST A LITTLE MORE, UH, VARIATION ON SOME OF THE SAME PICTURES.

SO ANY, ANY FEEDBACK ON ANY OF THE IMAGES, REMEMBER

[00:45:01]

I'M IMPRESSED.

MM-HMM.

, THEY'RE NICE.

ONE OF THE THINGS THAT ON THE COMMITTEE ONE, IT IS THREE DIFFERENT BUILDINGS BASICALLY.

YEAH.

YOU HAVE THE CITY HALL TYPE BUILDING, YOU HAVE THE PARKING LOT, THEN YOU HAVE THE, UM, COURTHOUSE COURT, MUNICIPAL COURT MM-HMM.

AND WANTED TO SHOW THEM, SHOW DISTINCTION BETWEEN 'EM INSTEAD OF ONE LONG RIGHT BOX, HOW DO WE BREAK IT UP SO THAT THERE'S THIS, YOU CAN REALLY LOOK AT 'EM AND SEE THAT THERE'S THREE DISTINCT ENTITIES THERE AND WE, AND, AND TO BE WELCOMING FOR THE COMMUNITY.

MM-HMM.

, UH, FOR TODAY'S COMMUNITY AND THE COMMUNITY WHEN WE ARE NO LONGER HERE, 50 YEARS FROM NOW, I'VE, I'VE HEARD ONE MEMBER OF OUR OVERSIGHT COMMITTEE SAY THAT, UH, YOU ONLY BUILD THE CITY HALL EVERY 100 YEARS, SO WE BETTER GET IT RIGHT? MM-HMM.

.

SO, AND I, I FEEL THAT THE PROCESS THAT WE'VE SET UP, UM, WITH THE OVERSIGHT THAT'S BEING SAT ON BY THE MAYOR, COUNCIL MEMBER CHAPMAN, CITY MANAGER, UH, CITY ENGINEER, I DON'T THINK WE CHASED HIM OFF BY PUTTING THEM ON THIS COMMITTEE, BUT I'M NOT SURE.

I HAVEN'T ASKED HIM THAT DIRECTLY IN OUR CITY PLANNER, UH, WORKING HAND IN HAND WITH REESE, ALONG WITH ALL THE COLLABORATION WE'VE HAD WITH DEPARTMENTS SITTING DOWN AND BETTER UNDERSTANDING, UH, WHAT THEIR NEEDS ARE TODAY AND WHAT THEY THINK THEIR NEEDS ARE GONNA BE MOVING FORWARD.

SO I REALLY FEEL GOOD ABOUT THE PROCESS.

UM, NEXT STEPS, UM, SO AS I MENTIONED, THIS WILL, THIS WILL INVOLVE, UM, LOTS OF PLANNING, WHICH IS ANOTHER REASON WHY GETTING THE, UM, CONSTRUCTION MANAGER AT RISK, UM, ONBOARD FOR PRE-CONSTRUCTION SERVICES IS, IS SO IMPORTANT.

THEY'LL WORK WITH US TO SET SCHEDULES AND TO MAKE SURE WE'RE HITTING THE TARGETS THAT WE WANT TO, TO BE OPEN IN LATE 2024 IS SCHEDULED FOR THE PROJECT COMPLETION.

SO ONE OF THE FIRST THINGS WE'VE, WE NEED TO DO, AND WE'VE BEEN DOING LOTS OF WORK BEHIND THE SCENES, IS MAKING SURE THAT ALL THE DEPARTMENTS THAT ARE IN FUNCTIONS IN THE DOWNTOWN COMMUNITY CENTER, UH, FIND A NEW HOME.

SO WE'RE VERY CLOSE TO BEING ABLE TO ANNOUNCE THAT.

AND ALSO, UH, THE, THE TWO DEPARTMENTS THAT ARE IN THE PLANNING AND PUBLIC WORKS BUILDING, THEY HAVE A TEMPORARY HOME.

SO WHAT WE LIKE TO SAY IS WE'RE LOOKING FOR SWING SPACE FOR THEM.

SO PLACES TO GO WHILE THIS IS ALL IN THEIR CONSTRUCTION.

HAVE YOU COME THAT PLACE YET? UH, WE'RE VERY, WE'RE VERY CLOSE.

YEAH.

SO BETWEEN SEVEN NORTH BROADWAY, WHICH IS WHERE, UH, OUR HUMAN RESOURCES DEPARTMENT MM-HMM.

FINANCE AND UTILITY CUSTOMER SERVICES, UH, YOU ALL TOOK AN ACTION A FEW MONTHS AGO TO EXTEND THAT LEASE WITH THE OWNER OF THAT PROPERTY.

SO WE WILL UTILIZE SEVEN NORTH BROADWAY FOR SOME OF THOSE FUNCTIONS.

AND THEN THE, UH, RECENTLY PURCHASED, UH, FORMER FRANCIS TUTTLE BUILDER AT I 35 IN COVET, WHICH WE NOW CALL NORTH TIMBERS.

WE'LL SERVE AS SWING SPACE FOR SOME OF THIS AND THEN PERMANENT SPACE FOR SOME.

SO WE ARE MOVING OUR EMPLOYEE HEALTH CLINIC THAT IS CURRENTLY IN THE DOWNTOWN COMMUNITY CENTER OUT TO NORTH TIMBERS.

SO IT'LL BE A LARGER SPACE FOR THEM.

AND A LOT OF OUR EMPLOYEES THAT, UM, DO THEIR WORK OUT OF THE FIELD, THEY'RE BASED IN THAT AREA OF TOWN AND IT MAKES A LOT OF SENSE TO US TO GIVE THEM GREATER ACCESS TO THAT.

UM, FOR ADMIN STIFFS LIKE ME, IT'S A LITTLE EASIER TO GET TO THE CLINIC, SO WE WANNA MAKE IT A LITTLE CLOSER FOR THOSE FOLKS.

IT'S A LITTLE DIFFICULT TO GET THERE.

AND I DID NOTICE WHEN YOU SAID LATE 2024, I LOOKED BACK THERE AND THE RE AND FLINT CO REPRESENTATIVES WERE GOING, WERE THEY, I COULDN'T, I DON'T HAVE DID THEY? GOOD? YEAH, WELL, THEY'RE ALL IN AGREEMENT WITH, ACTUALLY, I THINK I SAID AUGUST OF 24 IS WHAT MY DAY WAS.

THAT SOUNDS LATE.

24.

YEAH.

YEAH.

WHAT DO YOU KNOW ABOUT, CAN YOU TALK ABOUT DMV AND THE COUNTY OFFICE? YEAH, SO THE, THE DMV AND COUNTY OFFICE, UH, WE FOUND TEMPORARY SPACE FOR THEM OR SWING SPACE FOR THEM AT SEVEN NORTH BROADWAY.

GREAT.

YEAH.

SO WE, SO ARE THEY COMING INTO, UH, ARE THEY COMING INTO CITY HALL BUILDING OR YOU OR PARKING GARAGE? WE HAVEN'T HAD THOSE CONVERSATIONS WITH THEM YET.

UM, BUT WERE THEY, AND THIS, WE DON'T HAVE THE BEST, SO THE RETAIL SPACE THAT I TALKED ABOUT, RIGHT ON THE FIRST ON THE GROUND FLOOR, UM, THAT'S UNALLOCATED SPACE AT THIS POINT.

OKAY.

SO WE NEED TO HAVE THE CONVERSATION WITH THEM.

OKAY.

UM, THEY, THEY SERVE A LOT OF CUSTOMERS IN, IN OUR COMMUNITY.

UM, BUT WE ARE, AS YOU ALL KNOW, UM, WE'RE MAKING A HUGE INVESTMENT HERE, SO WE WANNA MAKE SURE THAT THEY'RE ABLE TO, TO PAY PERCENT OF THAT LEASE BASE AS WELL.

SO WE'LL WORK, WE'LL WORK WITH THEM.

YEAH.

UM, SO, SO SORRY.

NEXT STEPS.

SO WE'RE NEARING THE END AGAIN.

I SAID WE'RE ABOUT 30% COMPLETE WITH DESIGN, SO WE'RE NEARING THE END OF WHAT'S CALLED SCHEMATIC DESIGN.

SO WE'LL CONTINUE MOVING FORWARD AND AS WE GET A LITTLE CLOSER, WE'LL HAVE SOME MORE IMAGES TO SHOW.

SO SOME 3D MODELING OF THE INTERIOR EXTERIOR TO GIVE IT A LITTLE MORE FEEL.

UM, LOTS MORE PUBLIC CONVERSATIONS.

I KNOW.

UM, I WILL BE GOING TO THE URBAN BOARD IN JANUARY TO TALK ABOUT THIS AS WELL.

SO I'M HAPPY TO SPEAK TO ANY AND EVERYBODY ABOUT THIS PROJECT AND DO A, DO A, DO A ROADSHOW OF ASK.

SO, UM, AND SPEAKING OF THAT, FOR COMMITTEE, UM, THE, THE KIND OF THE FINANCING ANGLE IS THAT, THAT'S GONNA BE RUNNING THROUGH FINANCE COMMITTEE, RIGHT? YEAH.

JANE, YES.

SO THEY, THEY WILL BE THE RECOMMENDING BODY TO YOU ALL ON THAT.

SO IN JANUARY WE'LL TALK ABOUT THAT.

UM, SO WE'LL HAVE CHRIS GANDER HERE WITH U K FINANCIALS TO WALK THROUGH THAT AND NOW LOOKS AS WELL, SO ANSWER.

SO MAYOR, IF I CAN ADD A COUPLE THINGS.

SO THANK YOU ANDY.

[00:50:01]

UM, GREAT JOB.

AND HE'S OUR, OUR DAY-TO-DAY PROJECT MANAGER ON THIS.

COUPLE THINGS.

OF NOTE IS HE MENTIONED THE 44 MILLION THAT IS DIFFERENT THAN WHAT OUR HOPE IS FOR THE GMP GUARANTEE MAXIMUM PRICE.

OUR GOAL IS THE CAP FOR THIS PROJECT'S 44 MILLION.

NOW THE GMP MAY COME IN BELOW THAT, BUT IT WILL DEFINITELY NOT EXCEED THAT.

UM, AND THAT'S OUR EFFORT.

THE OVERSIGHT COMMITTEE WORKING WITH OUR PARTNERS IS CONSTANTLY VALUE ENGINEER, LOOK AT THE PROCESS, DETERMINING, HEY, THIS COSTS A LITTLE BIT MORE THAN WE ANTICIPATED.

DO WE NEED TO OFFSET IT OVER HERE? THE OVERALL GOAL IS BY APPROVING THIS BUDGET OF CAP OF 44.

WE'RE NOT COMING BACK AND SAY IT WAS 44, NOW IT'S 45, NOW IT'S 48.

IT'S, IT IS WHAT IT IS.

THE SECOND PART IS THIS IS, UH, I THINK IT'S A BIG STEP FORWARD FOR THE CITY TO, TO MOVE TO THE SEYMOUR PROCESS.

I KNOW SEVERAL OF THE CITIES IN THE METRO HAVE BEEN DOING IT.

I KNOW OUR PARTNER, OUR BIGGER PARTNER, UH, OKLAHOMA CITY IS EXPLORING IT.

THEY CURRENTLY DON'T DO THAT.

I KNOW THEY HAVE AN INTEREST IN EXPLORING HOW THAT IS DONE.

UM, I THINK IT'S A NOVEL APPROACH FOR US TO CONSIDER.

I THINK IT PROVIDES TIMING AS WELL AS VALUE.

AND THE OTHER PROCESS IS THIS OVERSIGHT COMMITTEE.

IT'S GRATEFUL THAT THE MAYOR AND COUNCILOR CHAPMANS INVOLVED, BUT WE OWE OTHER PROJECTS.

AND THE ONE COMING UP IS THE Y M C A, UH, LIBRARY PROJECT.

SO THAT WOULD BE AN OVERSIGHT COMMITTEE THAT, NOT JUST REPRESENTATIVES FROM COUNCIL, BUT REPRESENTATIVE FROM BOTH THE Y M C A AND THE LIBRARY.

AND THAT BY THEN HELPS TO MAKE DECISIONS OR RECOMMENDED DAY STUDENTS THAT ULTIMATELY COME BACK TO EITHER US OR THEIR RESPECTIVE BODIES.

SO IT'S A VERY INTERACTIVE, UH, PROCESS THAT COUNCIL MORE.

YOU MENTIONED THE KEY THING AS WE'VE DONE OUR EMPLOYEE SURVEY, ONE OF THE THINGS THAT CAME BACK REALLY FOR THE FIRST TIME IN OUR EMPLOYEE SURVEY WAS SAFETY FOR OUR EMPLOYEES.

UM, AND SO THAT'S A KEY FACTOR.

WE LOOKED AT DIFFERENT THINGS.

FOR EXAMPLE, AT CITY HALL, WHEN THIS IS DONE, EVERYBODY WILL COME THROUGH THE SAME ENTRANCE.

THERE WON'T BE LITTLE SIDE ENTRANCES, BE SOME FORM OF SECURITY, DON'T KNOW WHAT THAT IS.

COULD THAT INCLUDE SOME, YOU KNOW, METAL DETECTORS, WHATEVER IT MAY BE.

BUT IT'S A WAY THAT WE CAN PROVIDE ADDITIONAL COMFORT TO OUR EMPLOYEES THAT WHEN THEY LEAVE TO GO TO WORK, THAT THEM OR THEIR FAMILIES FEEL COMFORTABLE THAT THEY'RE GONNA COME BACK THAT EVENING.

WE HAVE A DISPERSED CAMPUS TODAY THAT CREATES INTERESTING CHALLENGES FOR US FOR SECURITY.

AND IT WAS AN, IT WAS A PRIORITY FOR ME AND FOR THE OVERSIGHT COMMUNITY TO MAKE SURE WHATEVER WE DESIGN IS CRITICAL FOR THAT.

UM, AND THEN IT'S RECRUITMENT.

THIS BUILDING'S A RECRUITMENT EFFORT FOR FUTURE EMPLOYEES, BUT IT'S ATTRACTIVE AND INVITING AS WELL AS FUNCTIONAL AND AND HEALTHIER ENVIRONMENT.

WE THINK IT'S AN OPPORTUNITY FOR US TO CONTINUE TO BE THAT EXCEPTIONAL PLACE TO WORK.

I THINK, I THINK THE LAST THING IS, IS WE WANNA, I'LL CALL IT WALK THE WALK OF WHAT WE TALK ABOUT.

SO IF WE ARE ENCOURAGING OUR DEVELOPMENT COMMUNITY, THE DOWNTOWN OR ELSEWHERE, TO DESIGN TO CERTAIN LEVELS.

MM-HMM.

, WE NEED TO BE WILLING TO DO IT OURSELVES.

SO, YOU KNOW, SOMEBODY COULD SAY, WELL, THAT'S A REALLY FANCY CITY HALL OR WHATEVER IT MAY BE, IS IF WE'RE NOT WILLING TO, TO PRODUCE A PRODUCT WHERE, WHERE WE SAY WE'RE GONNA HOUSE OURSELVES, HOW CAN WE TELL HER DEVELOP COMMUNITY TO DO SOMETHING WE'RE NOT WANTING TO DO? SO I THINK THE LAST THING IS, IS WE ALSO WANT TO TAKE AN OPPORTUNITY TO, CAN WE BE A DEMONSTRATION FOR SOME OF THE TECHNOLOGIES? WE TALK ABOUT THE WATER CONSERVATION ASPECTS.

IS THERE ALTERNATIVE ENERGIES? WE TALKED ABOUT GEOTHERMAL, WE TALKED ABOUT SOLAR, WE TALKED ABOUT THAT GREEN SPACE.

IS IT AN OPPORTUNITY FOR US TO DEMONSTRATE LOW FLOW WATER PLANTS OR WHATEVER IT MAY BE? SO I GUESS MORE THAN JUST A BUILDING, IT'S AN EXAMPLE OF HOW WE ENVISION OR HOPE OUR CITIZENS ENVISION THE FUTURE OF EDMOND.

AND JUST ANDY, THE OTHER THING, IT'S, UH, WE'VE CHOSEN TO USE DATA ON THESE PROJECTS, THESE SPECIFIC TWO PROJECTS.

I ALSO THINK IT'S IMPORTANT THAT THE CITIZENS UNDERSTAND THAT WE WENT THROUGH, WE HAD A CONSULTING FIRM PRESENT TO US.

WAS IT LAST MEETING? OUR FINANCES? MM-HMM.

.

YES.

WILL.

AND WE HAVE TRADITIONALLY AND R RIGHT NOW, SORT OF AN UNDERLEVERAGED MUNICIPALITY WHEN COM WHEN COMPARE TO OTHER, UH, OTHER CITIES.

SO THIS WILL ALLOW US TO USE LEVERAGE, UH, IN A BIT.

THAT WILL PUT US CERTAINLY CLOSER TO OTHER MUNICIPALITIES.

MM-HMM.

, UM, TO YES, HOPEFULLY FOR ECONOMIC DEVELOPMENT IN OUR COMMUNITY TOO.

SO.

OKAY.

YOU BET.

YEAH.

I DIDN'T, JUST REAL QUICK, I'LL JUST, I'LL, I'LL, I'LL HIT ON A LITTLE BIT CUZ I, I, I JUST KIND OF SKIPPED OVER A LITTLE BIT.

SO THE PLAN IS, IS ONCE, ONCE EMPLOYEES THAT WERE IN THREE TO SEPARATE BUILDINGS ARE THEN HOUSED IN THE CITY HALL AND MUNICIPAL COURT, THERE'S REDEVELOPMENT SI THERE'S FOUR REDEVELOPMENT SITES.

SO WE'LL GO THROUGH A REQUEST FOR QUALIFICATION TO, UH, TO WORK WITH A PRIVATE DEVELOPER TO REPURPOSE AND REDEVELOP THOSE TO HIGHER AND BETTER USE.

SO THE SPACE WHERE WE'RE CURRENTLY AT RIGHT NOW, UH, THE SPACE THAT WE CALL WHITTLER LAWN RIGHT HERE, WHICH IS WHERE THE FORMER, UH, POLICE STATION WAS, AND THEN JUST DIRECTLY SOUTH AND WEST, UH, WHERE OUR CITY

[00:55:01]

FIRST BUILDING IS, WILL ALSO BE SOLD.

SO THESE WILL BE SOLD ONE BY ONE.

SO THE CITY WILL SAY, WE'RE TRYING TO ACHIEVE X, Y, Z OFFICE, RETAIL, SOME SORT OF MIXED USE.

UM, PLEASE LET US KNOW WHAT YOU THINK ABOUT THAT.

TELL US IF YOU HAVE A PROVEN TRACK RECORD OF DOING THIS.

AND THEN WE'LL VET THOSE AND THEN WE'LL BRING THOSE IN FRONT OF THE CITY COUNCIL IN THE FORM OF DEVELOPMENT AGREEMENTS.

AND THE FINAL PARCEL IS WHAT'S SURFACE PARKING RIGHT HERE TO THE NORTH.

THAT'S DIRECTLY ACROSS FROM THE DOWNTOWN COMMUNITY CENTER RIGHT NOW.

SO I FORGOT TO HIT ON THAT A LITTLE BIT.

SO AGAIN, IT'S REALLY TWO PHASES TO THIS.

IT'S THESE THREE STRUCTURES AND THEN IT'S THE SELLING OF THE PARCELS AFTERWARDS FOR ECONOMIC DEVELOPMENT AND FOR HIGHER AND BETTER USES.

AND WE REALLY FEEL LIKE THE GREEN SPACE, ADDING THIS GREEN SPACE WILL ONLY LEAD TO BETTER PROJECTS.

AND THIS, THIS, THIS, AS WELL AS THIS.

CAUSE IT'S NOT VERY FAR AWAY.

SO I THINK IT'S QUITE AN I AMEN.

NOT ONLY FOR THE COMMUNITY, BUT ALSO FOR A DEVELOPMENT OF COMMUNITY AFTERWARDS AS WELL.

SO, AND ANDY REMIND THE PARKING GARAGES IS STRICTLY FOR CITY USE, CORRECT? NO, WE ARE, WE ARE BUILDING THAT LARGE ENOUGH TO NOT ONLY HOUSE OUR EMPLOYEES, BUT FOR PUBLIC USE AS WELL.

SO YEAH, YOU COULD SEE A POTENTIAL OF IF SOMETHING IS BUILT HERE AND THEY NEED, RATHER THAN SURFACE PARK IT, OUR PREFERENCE WOULD BE THAT WE WORK OUT AN AGREEMENT WITH THEM TO LEASE SPACE POTENTIALLY IN HERE, IN THE GARAGE.

SO WE'VE GOT 20 SPACES TO LEASE YOU AND THEN, SO YEAH.

MORE EFFICIENT USE OF LAND.

SO THAT WAS, THAT WAS A LOT.

I'M GETTING THE EYE.

MM-HMM.

.

SO AS A REMINDER THIS EVENING, WHAT THE ONLY ITEM ON YOUR AGENDA IS RIGHT HERE.

THE APPROVAL OF THE CMAR CONTRACT WITH FLINTCO.

UM, SO THERE YOU GO.

SO LOTS MORE, LOTS MORE CONVERSATIONS WITH YOU ALL AND THE COMMUNITY TO COME ON THIS VERY EXCITING PROJECT.

IT'S INCREDIBLE.

WE'VE COME FAR WITH THIS.

YEAH, I'M READY FOR THE GUARANTEED MARKET PRICE.

GUARANTEED THAT, THAT IS ONE OF THE MAJOR ADVANTAGES OF USING THIS PROJECT.

AND THIS, THE CMAR, THE CONSTRUCTION MANAGER FEES ARE WITHIN THIS COST RIGHT HERE.

MM-HMM.

.

SO NOT IN ADDITION TO, THEY'RE WITHIN THAT COST RIGHT THERE.

SO.

GREAT.

GOOD.

A LOT OF DISCUSSION AND A LOT MORE TO GO.

YEAH.

THANK YOU.

MM-HMM.

.

THANK YOU VERY MUCH, ANDY.

WELL, WE'RE GONNA HAVE A PRESENTATION ON THE, UH, CONVERSATION.

OKAY.

ALRIGHT.

THANK YOU.

NOW WE, AND ALSO STILL UNDER PURCHASES

[11. Approval of Disposal Disposition of Used Vehicles. (Citywide)]

APPROVAL OF DISPOSAL, DISPOSITION OF USED VEHICLES.

[12. Approval of donation of surplus Holmatro equipment to the Oak Cliff Fire Department. (Citywide)]

AND THEN NUMBER 12 IS APPROVAL OF DONATION OF SURPLUS HOMA EQUIPMENT TO THE OAK CLIFF FIRE DEPARTMENT.

[13. Approval of utilization of American Rescue Plan Act (ARPA) funds for the Advisory Services Agreement with the Urban Land Institute (ULI) for Edmond, Oklahoma; $135,000. (Citywide). ]

AND THE LAST ITEM IS APPROVAL OF UTILIZATION OF AMERICAN RESCUE PLAN ACT.

ARPA FUNDS FOR THE ADVISORY SERVICES AGREEMENT WITH THE URBAN LEAGUE INSTITUTE, ULI FOR EDMOND, OKLAHOMA FOR 135,000.

COUNSEL.

THAT AS USUAL, A LOT OF OUR PURCHASES FOR THE CITY OF EDMOND.

A LOT OF DISCUSSION.

WHAT WOULD YOU LIKE TO DO? I'D LIKE TO MAKE A MOTION THAT WE SPEND THE MONEY.

SECOND, YOU HAVE A MOTION.

SECOND, PLEASE CAST YOUR VOTE.

THOSE PURCHASES HAVE BEEN APPROVED.

THANK

[A. Discussion and consideration of Resolution No. _____ establishing a Vision Zero Policy. (Citywide)]

YOU.

NOW WE HAVE CONSIDERATIONS IN ORDINANCE OF ORDINANCE AND RESOLUTION.

FIRST ONE IS DISCUSSION AND CONSIDERATION OF RESOLUTION NUMBER 39 DASH 2239 DASH 22, ESTABLISHING A VISION ZERO POLICY CITYWIDE MR. BRYAN.

ALL RIGHT.

HI, GOOD EVENING.

MY NAME IS KEN BRYAN.

I'M THE LONG RANGE PLANNER FOR THE CITY OF EDMOND.

THANK YOU FOR INCLUDING ME ON YOUR AGENDA THIS EVENING.

PART OF MY RESPONSIBILITIES INCLUDE FACILITATING THE IMPLEMENTATION OF THE CITY'S LONG-RANGE PLANS, INCLUDING THE RECENTLY APPROVED EDMOND SCHIFF LONG-RANGE MOBILITY PLAN.

AN ITEM THAT WAS IDENTIFIED AS FOR IMMEDIATE ACTION WAS THE ADOPTION OF A VISION ZERO RESOLUTION.

SO TOGETHER WITH POLICE AND ENGINEERING PLANNING WORKED ON, UH, PREPARING THIS RESOLUTION FOR YOUR CONSIDERATION.

SO WHAT IS VISION ZERO? UH, IT'S RELATIVELY SIMPLE ON ITS FACE.

IT'S A JURISDICTION'S COMMITMENT TO ELIMINATE TRAFFIC RELATED DEATHS AND SERIOUS INJURIES, OFTEN WITHIN A SPECIFIED TIMEFRAME.

OFTEN THIS REQUIRES CHANGES IN THE APPROACH TO MOBILITY.

UH, THE GRAPHIC HERE WAS BORROWED FROM THE VISION ZERO NETWORK, AND YOU CAN SEE A FEW DIFFERENCES IN THE APPROACHES.

UM, THIS TABLE SHOWS, UH, THE KEY COMPONENTS OF A STRONG COMMITMENT TO VISION ZERO SAFETY AS IT RELATES TO YOUR MOBILITY NETWORK.

UM, MANY OF THESE COMPONENTS WILL BE RECOGNIZABLE BECAUSE EDMOND IS ALREADY, UH, USING MANY OF THESE.

UM, THAT MEANS WE'RE TRENDING IN A POSITIVE DIRECTION, SO ONLY SLIGHT ADJUSTMENT MAY BE NEEDED.

SOME OF THOSE ADJUSTMENTS MIGHT BE ADOPTING OR AMENDING POLICIES OR STANDARDS SUCH AS THE POLICY IN FRONT OF YOU THIS EVENING.

UH, PROVIDING CLEAR COMMUNICATION

[01:00:01]

ABOUT THE PERFORMANCE OF THE MOBILITY NETWORK AND THE SAFETY THEREOF, LEVERAGING DATA AND ANALYSIS, MULTIDISCIPLINARY INVOLVEMENT, FOR EXAMPLE, IN THE DECISION MAKING PROCESS, FOCUSING ON MAINTENANCE AND IMPROVEMENT IN THE, UH, COMMUNITY ENGAGEMENT PROCESS.

IMMEDIATE IMPACTS, UM, THAT WE ANTICIPATE, UH, IN COMBINATION WITH THE EDMUND SHIFT PLAN, THE VISION ZERO RESOLUTION CREATES WHAT U S D OTS, SS FOUR A, WHICH IS SAFE STREETS FOR ALL PROGRAM IDENTIFIES AS A SUBSTANTIALLY SIMILAR ACTION PLAN.

SO THAT'S A LOT OF GOVERNMENTAL WORDS, BUT BASICALLY WHAT IT MEANS IS WE'RE ELIGIBLE TO APPLY FOR PROJECT, UH, GRANT FUNDING AS OPPOSED TO PLAN GRANT FUNDING.

SO THE SS FOUR A PROGRAM INCLUDES THOSE TWO MAJOR CATEGORIES FOR FUNDING.

UH, THE FIRST ROUND OF GRANT APPLICATIONS WERE DUE THIS PAST FALL.

WE WERE FAR ENOUGH ALONG IN THE EDMOND SHIFT PROCESS THAT WE WERE ABLE TO APPLY FOR A SERIES OF PROJECTS UNDER THAT PROGRAM.

THEY ANTICIPATE ANNOUNCING AWARDS HERE IN THE NEXT MONTH OR SO.

SO WE'RE EXCITED ABOUT THE POSSIBILITIES RELATED TO THAT.

UM, AND THEN FINALLY, A FEW KEY, UH, COMPONENTS INCLUDED IN THE RESOLUTION ARE SHOWN HERE, BUT BASICALLY A REPRIORITIZES SAFETY AS THE MOST IMPORTANT CONSIDERATION FOR POLICIES, REGULATIONS, ENFORCEMENT, FUNDING, PROJECT SELECTION AND DESIGN.

AND THEN LASTLY, UH, THE VISION ZERO NETWORK HAS PROVIDED THIS MAP SHOWING COMMUNITIES ACROSS THE COUNTRY THAT HAVE ADOPTED SUCH RESOLUTION AND ARE MOVING FORWARD WITH THEIR VISION ZERO INITIATIVES.

UM, ADDITIONAL COMMUNITIES TO BE ADDED, INCLUDE KANSAS CITY AND DALLAS.

AND THEN YOU'LL NOTICE THAT EDMOND WILL BE THE FIRST JURISDICTION IN THE STATE TO, UH, ADOPT SUCH A RESOLUTION.

THAT CONCLUDES MY COMMENTS.

I'M HAPPY TO TRY TO ANSWER ANY QUESTIONS YOU MAY HAVE GOOD QUESTIONS.

THIS IS SOMETHING YOU, HE'S DEFINITELY NEEDED AS OUR CITY CONTINUES TO GROW AND HOW, I THINK IT'S EXCITING, WE'RE IN THE FOREFRONT.

HOW DO WE, WITH THE STRATEGIC PLAN THAT WE'VE KIND OF APPROVED TONIGHT AND MOVING FORWARD WITH, WE'VE GOT DANFORTH AND KELLY, WE'VE GOT SIDEWALK GAPS.

DO WE, KEN, DO WE, WITH OUR, WITH OUR VISIONING AND STRATEGIC PLANNING, ARE WE, ARE WE MATCHING UP WITH WHERE YOU'RE AT ON THIS? OH, YEAH.

THAT'S A GREAT QUESTION.

AND SO YOU'VE, YOU'VE NOTICED THAT I POINTED OUT WE'RE ALREADY, LIKE, TRENDING RIGHT? IN A POSITIVE DIRECTION.

AND SO THE DANFORTH AND KELLY PROJECT IS A GREAT EXAMPLE BECAUSE, UM, WITH THE, THE MEDIANS THAT ARE GONNA BE ADDED TO THAT AREA, YOU KNOW, THAT LIMITS THOSE LEFT TURNING AND IT'S OUR MOST DANGEROUS INTERSECTION RIGHT, RIGHT NOW.

SO YEAH, PART OF THE WORK WAS TO IDENTIFY A HIGH INJURY NETWORK, UM, WHICH IS BASED ON CRASH DENSITY.

MM-HMM.

, UM, THE EDMUND SCHIFF PROJECT DIDN'T ACTUALLY INCLUDE DANFORTH AND KELLY.

I MEAN, OBVIOUSLY IT SHOWED IT ON THE MAP, BUT WE, WE, SINCE WE WERE ALREADY DOING THAT PROJECT, WE WERE ABLE TO MOVE TO FOUR OTHER OF OUR HIGHEST INJURY LOCATIONS.

AND THOSE ARE THE ONES THAT WE'VE, WE'VE TARGETED FOR SOME OF THAT GRANT FUNDING.

UM, BUT YEAH, LIKE I SAID, WE'RE JUST, WE'RE PROBABLY JUST NEED TO TWEAK A FEW THINGS HERE AND THERE AND, AND NUDGE IN THE RIGHT DIRECTION.

BUT YEAH, WE, WE ARE DOING A LOT OF THINGS, UM, ALREADY RELATED TO SAFETY.

THE OTHER THING THAT I'LL SAY IS KEN HAS TAKEN A LOT OF THE STUFF FROM THIS PLAN AND THE MOBILITY PLAN TO THE BICYCLING GROUP AND TO THE TRANSPORTATION THAT CAR AND I SET ON.

AND, AND SO THEY HAVE BROUGHT THINGS TO YOU TOO, AS A PART OF THIS.

SO IT'S BEEN COMING AND THEY'VE BEEN WORKING ON IT, AND IT'S, IT'S GETTING THERE.

WE GUYS HAVE DONE SO MUCH WITH EDMUND SCHIFF AND, AND, UH, JUST THAT ENTIRE WORLD.

I WANNA FOR, FOR MY VOICE ON COUNCIL, I WANNA MAKE SURE WE'RE, WE LOOK LIKE WE'RE, WE'RE DOING THE SAME THING WITH YOU.

ZERO'S A HARD NUMBER, RIGHT? RIGHT, RIGHT.

BUT NOT YOU.

AND WE KNOW IT'S A PROCESS AND WE KNOW IT TAKES TIME.

BUT ANYWAY, WHAT I'M, I DON'T WANT YOU TO FEEL LIKE WE'RE IN ANY WAY NOT MAKING IT A PRIORITY AS WELL IN OUR STRATEGIC PLAN.

SO THAT'S REALLY JUST KIND OF HIT ME.

ARE WE, UM, ARE WE KEEPING UP TO THAT MARK WITH YOU? AND, AND IF WE'RE NOT, IF, IF YOU FEEL LIKE AT SOME POINT WE'RE NOT, THEN PLEASE, PLEASE TELL US.

YEAH.

OKAY.

MAYBE NOT IN THIS FORUM, BUT YEAH.

RIGHT.

, CALL ME OR LEAVE A NOTE, A DIRTY NOTE OR SOMETHING.

VERY GOOD.

ANY OTHER QUESTIONS, COMMENTS? APPRECIATE YOU.

THANK YOU VERY MUCH.

THANK YOU.

[01:05:02]

THAT ITEM

[1. Acceptance of Bid and Approval of Agreement for the 2.0 MG Elevated Storage Tank at the 33rd Street Water Complex for the Engineering Department; $10,056,000.00. (Citywide)]

IS APPROVED.

NOW WE HAVE THE APPROVAL OF PURCHASES UNDER THE E P W A.

WE HAVE A ACCEPTANCE OF BID AND APPROVAL OF AGREEMENT FOR THE TWO, UH, MG ELEVATED STORAGE TANK AT THE 33RD STREET WATER COMPLEX FOR THE ENGINEERING DEPARTMENT FOR $10,056,000 SHORT.

WE HAVE A SHORT PRESENTATION.

SHORT, HE ONLY WORKS IN MILLIONS.

YES.

.

GOOD EVENING, MR. CHAIRMAN AND AUTHORITY MEMBERS.

STEVE LAWRENCE.

UH, SENIOR CITY, UH, CIVIL ENGINEER, AND, UH, SOON TO BE INTERIM CITY.

INTERIM.

OH, CITY ENGINEER.

YOU'VE ALREADY LOST YOUR HAIR.

TOO MUCH TO DO KEN LUCK.

I'M GONNA TALK TO YOU VERY BRIEFLY ABOUT THE 33RD STREET WATER STORAGE PROJECT.

UH, IN THE 2013 EDMOND WATER SYSTEM MASTER PLAN.

UH, WE IDENTIFIED THE NEED FOR INCREASED STORAGE OVERALL THROUGHOUT THE WATER SYSTEM.

AND WITH THAT ELEVATED STORAGE, UH, ADDS SOME RESILIENCE, UH, TO THE WATER SYSTEM, AS WELL AS SOME FLEXIBILITY, UH, TO BE ABLE TO PUMP DURING OFF PEAK DEMANDS.

UH, THE DESIGN OF THIS TOWER, THAT'LL BE AT 33RD STREET, UH, ABOUT A QUARTER MILE NORTH OF THE EXISTING THIRD, THIRD STREET WATER TOWER.

UH, JUST ON THE WEST SIDE OF THE RAILROAD TRACKS.

UH, IT'S SIMILAR DESIGN WITH THE OTHER TWO THAT WE'VE BUILT IN THE LAST SIX YEARS.

UH, VERY SIMILAR.

IT'S A 2 MILLION GALLON COMPOSITE, UH, STORAGE TANK.

AND, UH, LET'S SEE HERE.

GOT A RENDERING OF IT HERE AS SEEN FROM TECHNOLOGY DRIVE.

UM, WE'VE GOT FOUR BETTERS ON THE PROJECT.

SO IT'S, IT'S PRETTY MUCH EVERYBODY IN THE UNITED STATES THAT CAN BUILD ONE OF THESE TOWERS.

WE GOT A BIT BIT FROM, SO THAT WAS GOOD.

UH, LOW BED WAS 10 MILLION, 56,000.

AND IT'S LANDMARK TOWERS, WHICH HAS DONE ALL THE PREVIOUS WATER TOWERS IN EDMOND, UH, FOR THE LAST SIX YEARS.

UH, VERY GOOD CONTRACTOR, UH, PROJECTS IS SCHEDULED TO BE COMPLETED IN TWO YEARS.

IT'S 720 CALENDAR DAYS.

WE DID INCLUDE A THOUSAND DOLLARS A DAY INCENTIVE TO TRY TO WRAP THAT CONSTRUCTION UP A LITTLE BIT EARLY.

UM, WE'LL SEE HOW THAT GOES.

UH, WE STILL HAVE ALL THE REGULAR SUPPLY CHAIN ISSUES, STEEL, EVERYTHING ELSE.

SO, UH, TWO YEARS IS, IS WHAT WE'RE HOPEFUL FOR.

UH, PROJECT'S GONNA BE FUNDED THROUGH, UH, STATE REVOLVING FUND, WHICH DOES INCLUDE ALL OF THE AMERICAN IRON AND STEEL AND ALL THE OTHER, UH, FEDERAL, UH, REQUIREMENTS THAT WE HAD TO GO THROUGH FOR THAT.

AND IT'LL BE PACKED BACK PAYBACK OVER A PERIOD OF 30 YEARS, UM, TO MINIMIZE THE IMPACT TO THE RATE PAYERS.

AND REMINDER NING, PUT THIS ON THERE.

REMINDER MONTHLY PROJECT UPDATES OR ON THE WEBSITE.

ANY QUESTIONS? ANOTHER WATER PROJECT? YES.

REMEMBER THE ONE NOT ON COBEL, OR NO, IT WAS ON DANFORTH.

THERE WAS THE, THERE'S THE RISING, YOU REMEMBER, ARE WE GONNA HAVE ANOTHER ONE OF THOSE? YES.

IT MAY BE A LITTLE BIT MORE DIFFICULT.

UH, THIS ONE IS KIND OF TUCKED AWAY, UH, WHERE WE DON'T HAVE GREAT PUBLIC ACCESS FOR VIEWING, BUT, UH, YEAH, THAT WAS AND THE ONE ON COFFEE CREEK TOO.

YES.

WILL YOU KEEP THE CURRENT ONE THAT'S ON 33RD? UH, WE WILL, FOR A SHORT PERIOD OF TIME, THIS WILL REPLACE IT.

WE HAVE WIRELESS SERVICE PROVIDER LEASES THAT WE HAVE TO GET OUT OF.

UH, AND THIS WILL REPLACE THAT ONE.

OKAY.

AND EVENTUALLY WHEN WE GET ALL THE WIRELESS SERVICE

[01:10:01]

PROVIDERS MOVED TO THE NEW TOWERS OR WITH OTHER ARRANGEMENTS, THEN WE'LL DECOMMISSION THE OTHERS AND, UH, REMOVE 'EM FROM SERVICE.

OKAY.

ONE, WE'RE ACTUALLY, WE'RE LOOKING AT FEASIBILITY OF ACTUALLY MOVING ONE OF THE WATER TOWERS, UH, FOR A SHORT PERIOD OF TIME.

WOW.

OKAY.

I WANNA SEE THAT.

I DO TOO.

.

I DO TOO.

FEASIBILITY IS THE KEY HELICOPTER FEASIBILITY.

YEAH.

WE HAVE TO TRULY SHUT DOWN THE CITY.

OH, THAT'LL BE INTERESTING TO MOVE THAT.

ANY OTHER QUESTIONS? THANK YOU VERY MUCH.

THINGS WE MUST DO AS FOR A GROWING CITY, UH, WHERE ARE WE

[2. Approval of Change Order to the Agreement with Power Engineering for Cityworks and GIS Professional Services not to exceed $65,742. (Citywide)]

THEN? WE HAVE THE APPROVAL OF CHANGE ORDER TO THE AGREEMENT WITH THE POWER ENGINEERING FOR CITY WORKS AND THE GIS PROFESSIONAL SERVICES, NOT TO, NOT TO EXCEED $65,742.

PULL

[4. Approval of First Amendment to Development and Financing Assistance Agreement with Fifth Street Partners LLC; $110,000. (Ward 1)]

NUMBER THREE.

WE'RE GONNA PULL NUMBER THREE, AND THEN WE'RE GONNA, UH, DO NUMBER FOUR, APPROVAL OF FIRST AMENDMENT TO THE DEVELOPMENT OF FINANCING ASSISTANT AGREEMENT WITH FIRST FIFTH STREET PARTNERS, LLC FOR 110,000.

WE NEED TO JUST VOTE RIGHT NOW ON FIVE EIGHT B ONE, TWO AND FOUR.

PERFECT.

MOVE TO APPROVE B ONE TWO AND FOUR.

ONE SECOND.

MOTION SECOND.

PLEASE CAST YOUR VOTE.

THOSE ITEMS HAVE BEEN APPROVED.

AND

[3. Approval of a Change Order with Milhaus Properties LLC for an Infrastructure Agreement for the Silos Project; $20,747. (Ward 1)]

WE, NEXT WE HAVE THE APPROVAL OF CHANGE ORDER WITH MILLHOUSE PROPERTIES, LLC FOR THE INFRASTRUCTURE AGREEMENT FOR THE SILOS PROJECT FOR $20,747.

MOVE TO APPROVE B3.

HAVE A MOTION.

SECOND.

SECOND.

PLEASE CAST YOUR VOTE.

THAT ITEM HAS BEEN APPROVED.

[ <Adjourn Edmond Public Works Authority Meeting and Reconvene Edmond City Council Meeting>]

NOW WE NEED A MOTION TO ADJOURN THE EDMOND PUBLIC WORKS AUTHORITY MEETING AND RECONVENE THE EDMOND CITY COUNCIL MEETING.

SO MOVED.

SECOND.

MOTION.

SECOND.

PLEASE CATCH YOUR VOTE.

WE NOW WE'RE BACK IN THE CITY COUNCIL MEETING.

I HAVE TO ASK ONE QUESTION.

HOW'S MY LEADERSHIP ADMIN CLASS DOING

[A. Case #ES22-00017 Public Hearing and Consideration of Ordinance No. ______ closing a portion of a Public Way Closing (Alley and Campbell Street) for Broadway Lofts/Campbell Apartment project to be located north of Hurd and east of the railroad. (Broadway Lofts, LLC) (Ward 1)]

PLANNING? DISCUSSION ITEMS? THESE ITEMS, UH, REQUIRE A SEPARATE VOTE.

FIRST ITEM IS CASE NUMBER E S 22 DASH 17, PUBLIC HEARING CONSIDERATION OF ORDINANCE NUMBER 39 31.

39 31, CLOSING A PORTION OF A PUBLIC WAY, CLOSING, UH, ALLEY AND CAMPBELL STREET FOR A BROADWAY LOFT, UH, SLASH CAMPBELL APARTMENTS PROJECT TO BE LOCATED NORTH OF HERD AND EAST OF THE RAILROAD BROADWAY LOFTS.

LSC IS THE APPLICANT.

IS THE APPLICANT HERE, OKAY.

YES.

THANK YOU.

AS YOU SAID, THE APPLICANT IS SEEKING TO CLOSE APART THE CAM OF CAMPBELL, THE AREA SHOWN IN ROAD RIGHT THERE, AND THE EAST WESTS ALLEY ON THE BLOCK BETWEEN THE RAILROAD CAMPBELL HERD AND BROADWAY.

SO THE AREA AND THE RED HATCH RIGHT THERE, UH, BOTH RIGHT OF WAYS, DEAD END, AND THEN THE BERLIN, UH, INTO THE BURLINGTON NORTHERN SANTA FE, RIGHT OF WAY TO THE WEST, ACTUALLY, THAT RIGHT OF WAY LINE IS RIGHT HERE.

SO THE STREET DOES NOT CARRY THROUGH, NOR DOES THE ALLEY, UH, THE PARCEL LINES THERE ARE INCORRECT.

THE, UH, THE APPLICANT OWNS LAND ON BOTH SIDES OF THE ALLEY AND A PORTION OF CAMPBELL STREET INCLUDED IN THE REQUEST.

UH, THERE ARE A COUPLE OF SMALL UNDEVELOPED TRACKS THAT THE CITY OWNS OR MAY OWN, THAT THE APPLICANT HAS AGREED TO PROVIDE ACCESS EASEMENTS TO AS WELL AS EASEMENTS FOR ANY EXISTING UTILITIES.

AND ON STREET PARKING ON CAMPBELL.

UH, THE APPLICATION IS IN THE MIDDLE OF SITE PLAN REVIEW FOR A SERIES OF APARTMENTS AND TOWN HOMES ON THE MAJORITY OF THE BLOCK.

UH, THEY HAVE ALSO BEGUN DISCUSSIONS, UH, ABOUT A DEVELOPMENT AGREEMENT, WHICH COULD INCLUDE PUBLIC PARKING, UH, FOR THE AREA, WHICH, UH, WILL BE CONSIDERED CITY, UH, BY CITY COUNCIL WITH THE SITE PLAN IN THE FUTURE, UH, PLANNING COMMISSION REVIEWED AND RECOMMENDED APPROVAL AT THEIR NOVEMBER 22ND MEETING.

I'M HAPPY TO ANSWER ANY QUESTIONS YOU MIGHT HAVE.

SO I SAW THAT IN THE PACKET.

STAFF WAS RECOMMENDING IT NOT BE FILED OR ACTUALLY TAKE PLACE UNTIL, UNTIL LATER.

DOES THAT NEED TO BE PART OF THE MOTION? SO THERE'S TWO STEPS TO ANY CLOSING.

SO ONE, YOU HAVE TO CLOSE IT.

OKAY.

AND THEN THEY HAVE TO GO TO, TO DISTRICT COURT TO VACATE IT.

UH, WE AT THAT TIME ARE ASKED BY, UH, THE COUNTY IF WE ARE STILL OKAY WITH THAT.

IF NOT, WE HAVE THE OPTION THEN TO TRY TO REOPEN IT, I BELIEVE SO.

YOU COULD MAKE IT A PART OF THE MOTION.

UH, WE, THERE ARE OTHER STEPS ALONG THE WAY WHERE WE COULD REQUIRE THAT EASEMENT BE SUBMITTED.

THOSE ARE THE EASEMENTS.

WELL, THE WAY IT WAS WRITTEN IN THE RECOMMENDATION, IT IS RECOMMENDED THAT VACATING THE PUBLIC EXCESS BE DELAYED UNTIL THE APPLICANT'S ASSOCIATED SITE PLAN APPLICATION AND FUTURE BUILDING PERMITS ARE APPROVED TO ENSURE THE PROJE REQUIRING THIS CLOSING OF, UH, OF THE PUBLIC WILL BE WAY, WILL MOVE FORWARD.

AS I, I MEAN, IT KIND OF SOUNDED IT'S NOT, IT'S NOT IN THE ACTUAL AGENDA ITEM.

ALL YOU'RE VOTING ON RIGHT NOW IS THE CLOSING THE FIRST STEP? CORRECT.

OKAY.

[01:15:02]

OKAY.

ANY, UH, ADDITIONAL QUESTIONS FOR NO ? OKAY.

CLOSING IS DIFFERENT THAN A VACATION.

A VACATION IS A DISTRICT COURT ACTION.

MM-HMM.

, THE CLOSING IS WHERE THE CITY OF EVAN WILL ADOPT, CONSIDER ADOPTING AN ORDINANCE, MAKE ANY STATEMENT THAT WE NO LONGER NEED THAT FOR PUBLIC USE PURPOSES, SUBJECT TO E THE ORDINANCE THAT SAYS THAT WE ALSO NEED EASEMENTS AND WILL ALSO NEED TO BE ABLE TO PROVIDE FOR PARKING IN THOSE LOCATIONS THAT WILL BE CLOSED OR CONSIDERED TO BE COMPOSED BY THE CITY COUNCIL.

BUT I THINK THE POINT OF RANDY'S COMMENT WAS THAT WE HAVE A LOT OF OTHER STEPS THAT WE NEED TO COMPLY WITH OR GO THROUGH IN ADDITION TO DISCUSSING WITH THE APPLICANT, UH, DEVELOPMENT AGREEMENTS AND SEE IF THAT'LL MAKE THEIR PROJECT WORK THE WAY THEY WANT IT TO WORK.

BUT I THINK THERE WERE A LONG WAY FOR THEM GOING TO DISTRICT COURT TO ACTUALLY VACATE THE PROPERTY.

MM-HMM.

, IT'S NOT GONNA HAPPEN AT ALL.

OKAY.

ANY OTHER QUESTIONS FOR STAFF RIGHT NOW? DOES THE APPLICANT HAVE ANYTHING THEY WOULD LIKE TO ADD? RIGHT NOW, WE'RE AVAILABLE FOR ANY QUESTIONS WE HAVE.

OKAY.

UH, COUNSEL, ANY QUESTIONS FOR THE APPLICANT RIGHT NOW? NO.

SINCE THIS IS A, UH, PUBLIC HEARING IN CONSIDERATION, ARE THERE ANY, UH, QUESTIONS, COMMENTS FROM THE AUDIENCE? YES, PLEASE COME ON DOWN AND INTRODUCE YOURSELF.

GOOD EVENING, COUNSEL.

MY NAME IS KARO.

I RESIDE AT 5 0 4 NORTH BOULEVARD HERE IN EDMOND.

UM, I AM HERE TODAY.

OUR COMPANY OWNS, UH, TWO LOTS HERE, KIND OF NESTLED HERE IN THE CENTER OF THE, UH, UM, DEVELOPMENT THAT IS GOING FORWARD ON CAMPBELL STREET JUST TO THE WEST OF THE, UM, ALLEYWAY THERE.

UM, OUR TWO MAIN CONCERNS ARE THAT, UM, MAINTAINING THE ACCESS TO OUR PROPERTY, UTILIZING THE EAST WEST ALLEYWAY AND MAINTAINING PUBLIC PARKING ON THE STREET AND IN THE PROPOSED PARKING LOT ON WHAT MAY BE LAND OWNED BY THE, UH, CITY OF EDMOND.

UM, ONE OF THE HALLMARKS OF DOWNTOWN EDMOND HAS BEEN, IT'S AVAILABLE ON STREET FREE, AVAILABLE ON STREET PARKING, UM, IN LIGHT OF THERE NOT BEING A DEVELOPMENT AGREEMENT CURRENTLY IN PLACE TO BE REVIEWED BY THE PUBLIC, UH, AT THE TIME OF THIS VOTE.

UH, CONFUSING AND CONFLICTING INFORMATION REGARDING THE LOCATION OF THE SUBJECT MATTER AND THE, UH, OWNERSHIP OF LAND BEING IN QUESTION.

UH, WE FEEL THAT IT'S BEST, UH, IN THE BEST INTEREST OF THE PUBLIC, UH, TO CONTINUE THIS MATTER, UH, UNTIL THE, THE FACTS OF THE MATTER ARE MORE CONCRETE AND WE HAVE A DEVELOPMENT AGREEMENT THAT COULD BE EXAMINED.

UM, THIS AREA HERE THAT'S BEING CLOSED ON THE STREET WOULD, UM, ELIMINATE ALIEN EIGHT NEWLY CONSTRUCTED PUBLIC PARKING SPACES ALONG CAMPBELL STREET.

UH, THESE ARE PUBLIC PARKING SPACES THAT ARE ESSENTIAL TO THE EXISTING RETAIL AND OFFICE USERS AND BUSINESSES IN THE SURROUNDING AREAS ON CAMPBELL AND ON BROADWAY.

AND IT SHOULD NOT BE CLOSED TO THE PUBLIC.

UM, THESE PROPERTIES, UH, THAT ARE OWNED ON, UH, CAMPBELL STREET BY OUR COMPANY, UM, N NEED TO UTILIZE THE, UH, EAST WEST ALLEYWAY AND THE ACCESS THROUGH THE ALLEYWAY TO, UM, UH, SERVE THE, THE REAR OF THE PROPERTY.

AND BROADWAY LOFT SHOULD NOT HAVE THE RIGHT TO, UH, CLOSE THIS ALLEYWAY, WHICH WOULD IMPEDE OUR PUBLIC USE OF THIS AREA.

AND, UM, LARGE DELIVERY TRUCKS AND CITY SERVICE TRUCKS WOULD HAVE, UM, AN ISSUE SERVICING DUMPSTERS IN THE REAR OF OUR PROPERTY.

WHEN IT'S DEVELOPED, IT WOULD NOT BE ABLE TO TURN AROUND OR GO BACKWARDS.

UM, AND, UH, ACCORDING TO THE CENTRAL EDMOND HERMAN DEVELOPMENT BOARD AGENDA FROM DECEMBER 13TH, 2022, THE OWNERSHIP OF THE PROPERTY, UH, TO BE CLOSED IS IN QUESTION.

AND THE CITY AND THE DEVELOPER ARE IN DISCUSSIONS REGARDING THE DEVELOPMENT AGREEMENT.

AND WE REALLY FEEL THAT THIS AGREEMENT BETWEEN THE CITY AND THE OWNER SHOULD BE SETTLED AND IN PLACE, UM, FOR INPUT BEFORE THIS PROJECT IS PRESENTED AND APPROVED BY, UH, CITY COUNCIL.

AND, UM, FURTHER THE CLOSING OF THE LAND, WHICH MAY BE OWNED BY THE CITY OF EDMOND, UH, THROUGH QUIET TITLE ACTION.

UH, IF THIS PROPERTY IS OBTAINED THROUGH QUIET TITLE ACTION, WE FEEL THAT IT'S BEST IF THAT PROPERTY SHOULD REMAIN AVAILABLE FOR PUBLIC PARKING USE.

UM, SO IN CLOSING, OUR, OUR TWO MAIN CONCERNS ARE THAT THE, UH, DEVELOPMENT AGREEMENT HAS NOT BEEN DRAFTED.

AND SO WE REALLY DON'T KNOW WHAT THAT LANGUAGE WOULD SAY AT THIS TIME.

AND UNTIL THESE ISSUES ARE MADE, KNOWN AND HASHED OUT, WE THINK IT'S IMPORTANT TO, TO CONTINUE THE VOTE, TO KNOW EXACTLY WHAT THAT AGREEMENT WOULD STATE.

AND THESE TWO CONCERNS ARE JUST TO MAINTAIN ACCESS TO OUR PROPERTY THROUGH THE EASTWEST ALLEYWAY, AND TO MAINTAIN THE, THE PUBLIC PARKING ON STREET AND IN THE PROPOSED PARKING LOT IN, UH, ON THE LAND THAT MAY BE OWNED BY THE CITY OF EDMOND.

AND IF THESE TWO ISSUES WERE SATISFIED, WE REALLY WOULD HAVE NO OBJECTIONS.

THANK YOU, COUNSEL.

THANK YOU VERY MUCH.

YES, SIR.

COME ON DOWN AND INTRODUCE

[01:20:01]

YOURSELF.

GEORGE WINTERS STUDIO ARCHITECTURE.

I AM CROCI ARCHITECT.

UH, THERE'S A COUPLE OF POINTS THAT I'D LIKE TO ALSO BRING UP FROM THE DESIGN STANDPOINT.

UH, AS YOU LOOK AT THE PLANS THAT THEY'VE SHOWN US, UH, FIRST IT DOESN'T LOOK LIKE THERE'S ANY BENEFIT BY CLOSING THIS PROPERTY.

IT'S STILL A ROAD, IT'S STILL PARKING.

IT'S VERY SIMILAR TO WHAT WE HAVE NOW.

SO THERE'S A QUESTION OF WHY WOULD YOU GO AHEAD AND, AND CHANGE THAT, UH, SO THAT YOU PUT IT INTO THE PROPERTY WHEN IT'S ALREADY SHOWN TO BE USED, VERY SIMILAR TO, TO WHAT IT IS NOW.

UH, THE OTHER PIECE THAT'S A LITTLE CONCERNING IS ALL THE PUBLIC, UH, CORRESPONDENCE AND NOTIFICATION BEFORE THIS MEETING WAS SUBSTANTIALLY DIFFERENT THAN WHAT'S BEING PRESENTED TONIGHT.

BASED ON THOSE AND THE CONFUSION OF THESE VARIOUS COMPONENTS, UH, BRING SOME QUESTIONS OF INQUIRING, ARE WE ACTUALLY CLOSING THIS AREA DOWN? UH, AND WE'D LIKE FOR TO GO THROUGH AND DO THE CONTINUATION, VERY MUCH SUPPORTING OF THE PROJECT AND THE DEVELOPMENT OF THIS.

BUT THIS WOULD LIKE TO BE CLEAR ON EXACTLY WHAT'S GOING ON AND, AND THE PIECES THAT WE'RE TRYING TO APPROVE THAT YOU'RE GOING TO START DOWN THIS ROAD.

AND YES, YOU CAN CHANGE YOUR MIND, BUT GOING BACKWARDS ALWAYS IS DIFFICULT AND HARDER TO DO THAN JUST GETTING IT RIGHT THE FIRST TIME.

SO WE'RE ASKING YOU TO CONSIDER GETTING IT RIGHT THE FIRST TIME, AND LET'S GO FROM THERE.

UH, THANK YOU FOR YOUR TIME.

THANK YOU VERY MUCH.

ANY OTHER COMMENTS FROM THE AUDIENCE? NO.

ONE SECOND.

OH, THE APPLICANT? YES, PLEASE COME ON DOWN.

INTRO, INTRODUCE YOURSELF.

GOOD EVENING.

PERVY PATEL WITH WALLACE DESIGN COLLECTIVE REPRESENTING THE APPLICANT.

MY ADDRESS IS FOUR 10 NORTH WALNUT AVENUE.

UM, WE ARE REQUESTING THE CLOSING OF THE ALLEY AS WELL AS PART OF CAMPBELL RIGHT OF WAY TO INCORPORATE THAT PROPERTY INTO OUR, TO INCORPORATE PROPERTY INTO OUR PROJECT.

THE ALLEY CURRENTLY, AS IT SITS AS 20 FOOT WIDE THROUGH OUR PROJECT, WE'LL BE MAKING THAT ALLEY AREA 26 FOOT WIDE.

SO THERE'LL BE PLENTY OF ROOM FOR TRUCKS AND DUMPSTER OR TRASH TRUCKS AND FIRE TRUCKS TO MOVE THROUGH THERE.

UM, ADDITIONALLY, IF YOU NOTICE IN THE ORDINANCE THE WAY IT WAS WRITTEN, THEY, THE CITY WILL RESERVE THE RIGHTS TO THE UTILITY PARKING AND CROSS ACCESS EASEMENTS THROUGH THIS CLOSING.

SO I BELIEVE SOME OF THE CONCERNS THAT WERE BROUGHT UP HAVE BEEN ADDRESSED IN THE ORDINANCE ITSELF, AND WE DO AGREE WITH STAFF AS WELL AS THE CITY ATTORNEY FILING FOR THE VACATION OF THIS AREA WILL NOT BE DONE UNTIL AFTER THE PROJECT HAS BEEN APPROVED AND THE CONSTRUCTION COMMENCE.

CAN I ASK, HOW DOES IT, HOW DOES THIS HELP YOU IN THE CAMPBELL AREA SPECIFICALLY? SO OUR SITE, THE WAY IT'S, UH, PROPOSED WOULD BE ENTRANCE.

YOU'D HAVE ACCESS THROUGH CAMPBELL AND COME SOUTH ON THAT PIECE OF PROPERTY.

UM, THAT'S KIND OF NESTLED BETWEEN CITIES, THE TWO CITY PROPERTIES.

OKAY.

SO CURRENTLY BROADWAY LOFT OWNS THIS AS WELL.

SO THE CIRCULATION FOR THE SITE WOULD WORK THIS WAY AS WELL AS IT'D BE AN ENTRANCE OFF OF HERD AND THIS ALLEY WOULD BE MAINTAINED AS WELL, I'M ASSUMING THIS.

SO SITE PLAN AND THE SITE PLAN PROCESS WILL PROBABLY MAKE IT LOOK, ANSWER A LOT OF QUESTIONS.

YES, SIR.

UM, IT IS BEING PRESENTED AT THE URBAN BOARD TOMORROW EVENING.

OKAY.

AND HOW MUCH, DO YOU MIND IF I ASK HOW MUCH PROPERTY THIS PARTICULAR PROPERTY OWNER CONTROLS IN THE AREA? UM, ARE YOU, UH, BROADWAY LOFTS OWNS THIS PIECE RIGHT HERE.

UHHUH , THIS PIECE HERE, AND THEN ALL OF THIS UHHUH AS WELL AS THIS PROPERTY NORTH HERE AND ONE, TWO, AND THREE AND A A LITTLE BIT RIGHT THERE.

I THINK THE PROPERTY LINES AREN'T ACCURATE.

SO YOU'D SAY IT, WHAT YOU CAN SEE IN THAT KIND OF SQUARE AREA WOULD BE AT LEAST 80% OF IT? YES, SIR.

OKAY.

UM, SOONER, LLC IS THE ONLY ENTITY THAT OWNS THIS LOT RIGHT HERE.

MM-HMM.

ON THE SOUTH SIDE OF CAMP.

AND THEN, UM, ANOTHER PROPERTY OWNER OWNS A, A SMALL 50 FOOT WIDE PORTION RIGHT THERE ON HERD.

OKAY.

THANK YOU.

I THANK YOU VERY MUCH.

ANY OTHER QUESTIONS? UH, MAYBE TO MR. MURDOCH, I, IS THERE ANY CONFUSION ABOUT LAND OWNERSHIP NOT IN THERE THAT WAS MENTIONED? NOT IN THE AREAS.

IT'S MARKED WITH THE RED HATS MARKS.

OKAY.

THE NO CONFUSION THERE.

THERE MAY BE, THERE'S NOT NECESSARILY A CONFUSION.

IT'S, THE TITLE IS NOT CLEAR ON PARCELS CLOSER TO THE RAILROAD.

UH, THAT'S THE CITY OF EDMOND HAS INDICATED AS, AS THE OWNER, HOWEVER, COULD BE NECESSARY, I BELIEVE, TO DO A QUIET TITLE ACTION, MAKE SURE THAT WE HAVE GOOD TITLES TO THAT PROPERTY BEFORE WE WOULD ENTER INTO A DEVELOPMENT

[01:25:01]

AGREEMENT AS TO A LEASE OR EASEMENT OR ANY SORT OF GRANTING OF THE USE OF THOSE AREAS FOR PUBLIC PARKING OR JOINT PUBLIC PRIVATE PARKING THAT REGARD.

SO, BUT THE AREA IS TO THE HATCHED AREAS, WHICH IS THE SUBJECT OF YOUR ITEM TONIGHT.

THERE'S NO CONFUSION AS FAR AS WE'RE CONCERNED AS WHO OWNS THE PROPERTY.

OKAY.

OKAY.

MM-HMM.

, ANY OTHER QUESTIONS? SO TONIGHT WE'RE JUST TALKING ABOUT THE HATCH AREA.

THERE MIGHT BE QUESTIONS ABOUT OTHER THINGS UP THERE.

AND I WE'RE JUST TALKING ABOUT THE HATCHED AREAS.

YOU'RE JUST TALKING ABOUT THE HASH AREAS.

YES, SIR.

AND I'M ASSUMING THAT WITH FURTHER DISCUSSION THE OTHER AREAS, THERE WILL BE SOME CLARITY WITH THOSE AS THIS PROJECT DEVELOPS.

YES, SIR.

MM-HMM.

HAS TO BE, HAS TO BE, AND CITY COUNCIL WILL SEE A DEVELOPMENT AGREEMENT IF THERE IS ONE, AND A SITE PLAN IN THE FUTURE.

MM-HMM.

.

SO THAT WHAT, SO WHAT I'M HEARING IS THAT IF, IF THERE IS A, UH, AFFIRMATIVE VOTE TONIGHT THAT THERE'S STILL A POSSIBILITY THAT THIS MIGHT NOT GO THROUGH BECAUSE THERE'S STILL MORE THINGS THAT HAVE TO BE WORKED OUT AND STILL BROUGHT IN FRONT OF COUNCIL.

SURE.

BUT IT GIVES THEM SOME, UH, UH, GIVES SOME, SOME, SOME INFORMATION UP FRONT THAT ALLOWS THEM TO, TO, TO KEEP MOVING FORWARD.

MM-HMM.

TO MOVE FORWARD WITH DESIGN WITH THEIR PROJECT.

RIGHT? MM-HMM.

, THANK YOU.

ANY OTHER QUESTIONS, COMMENTS? COUNSEL, WHAT WOULD YOU LIKE TO DO ON THIS ITEM? MOVE TO APPROVE.

I'LL SECOND.

NO.

MOTION.

SECOND.

PLEASE CAST YOUR VOTE.

ADAMS PASS.

THANK YOU VERY MUCH.

[B. Case #VA22-00020 Public Hearing and Consideration of Request for a Sign Variance for Icon Cinema, located at 1255 E Danforth Road. (Rebel Sign Company) (Ward 1)]

IS CASE NUMBER VA 22 DASH 20 PUBLIC HEARING.

CONSIDERATION OF REQUEST FOR A SIGNED VARIANCE FOR ICAHN CINEMA LOCATED AT 1 12 55 EAST DANFORD ROAD.

REBEL SIGNED C'S APPLICANT IS APPLICANT HERE.

OKAY.

THANK YOU.

OKAY.

YEAH, APPLICANT IS SEEKING ASSIGN VARIANCE FOR A SIGN, UH, ON THE FORMER KICKING BURKE THEATER SITE.

UH, THE THEATER HAS BEEN PURCHASED AND IS BEING REMODELED.

UH, AS A RESULT, THE NEW OWNERS REPLACING THE SIGNS ASSOCIATED WITH THAT THEATER.

UH, THE SIGN ABOVE THE MAIN ENTRANCE, UH, EXCEEDS THE SQUARE FOOTAGE ALLOWED BY THE ORDINANCE IN THE VARIANCE.

SO THAT, JUST TO GIVE YOU AN IDEA OF WHERE THAT IS, IT'S NEXT CORNER RIGHT THERE.

UH, IT'S CALCULATED UNDER THE ORDINANCE.

UH, THE SQUARE FOOTAGE OF THE SIGN ALLOWED IS 80 SQUARE FEET.

THAT'S BASED ON THE LENGTH OF THE WALL, WHICH IS THAT WALL RIGHT THERE, THAT ANGLED WALL, AND THEN THE DISTANCE FROM THE PROPERTY LINE.

NOW THE THEATER SITS ON ITS OWN PARCEL, SO THAT PROPERTY LINE IS APPROXIMATELY RIGHT THERE, BUT 30 FEET.

SO IN TOTAL, THAT GIVES 'EM 80 SQUARE FEET THEY COULD HAVE FOR THAT SIGN.

UH, THE SIGN IS PROPOSED IS 242 SQUARE 5, 242 SQUARE FEET, WHICH IS THAT ONE RIGHT THERE ABOVE THE DOOR.

UH, THE APPLICANT'S JUSTIFICATION IS THE WAY THE BUILDING AND LOTS LAYOUT, THE ADDITIONAL SQUARE FOOTAGE IS NEEDED TO BE SEEN FROM DANFORTH, UH, PLANNING COMMISSION REVIEWED AND RECOMMENDED APPROVAL AT THEIR NOVEMBER 22ND MEETING.

THANK YOU VERY MR. COUNSEL, ANY QUESTIONS FOR STAFF? WAS THERE ANY COMMENTS FROM ANYBODY ELSE IN THE, IN THE MALL? UH, I BELIEVE THERE WERE A COUPLE OF LETTERS OF SUPPORT IN YOUR PACKET.

MM-HMM.

MM-HMM.

, NO QUESTIONS FOR STAFF, UH, APPLICANT.

WOULD YOU HAVE ANYTHING YOU WANNA ADD RIGHT NOW? SURE.

THANK YOU VERY MUCH.

MY NAME IS JEFF VIRTUAL.

I'M THE OWNER OF REBEL SIGN COMPANY.

UM, AS IT'S DESCRIBED IN THE BACKGROUND, THE, THE BIGGEST ISSUE IS THE PROPERTY LINE AND THE ANGLE THAT IT'S KIND OF 45 DEGREE AND THEY DON'T HAVE GOOD ACCESS COMING FROM, FROM, UH, WEST WESTBOUND TRAFFIC.

SO WE'RE JUST TRYING TO GIVE THEM THE, THE BEST POSSIBILITY FOR SUCCESS.

WE ALSO BELIEVE THAT THE SIGNAGE IS GONNA JUST BRING MORE BUSINESS TO THE SHOPPING CENTER AS A WHOLE.

JUST BEING REAL ATTRACTIVE.

AND, UH, WE THINK THAT IT'S, IT, IT'S NOT OUTLANDISH.

IT'S NOTHING OUT OF THE NORMAL.

IT'D BE HIGH QUALITY SIGN THAT WILL MAKE A DIFFERENCE FOR THEM.

THAT'S ALL I HAVE.

ANY QUESTIONS? IS THERE STILL A SIGN ON THE SOUTH SIDE OF THE BUILDING? YES, THERE IS.

IT'S, EXCUSE ME, MORE OF A MARQUEE STYLE, BUT WE ARE CHANGING THAT ONE AS WELL.

MM-HMM.

, BUT THAT ONE DOESN'T REQUIRE VARIANCE, RIGHT? THAT ONE, NOT THE COVER.

MM-HMM.

OBJECT.

OKAY.

THANK YOU.

ANY QUESTIONS, COUNSEL FOR THE APPLICANT? LOOKS LIKE A MOVIE THEATER SIGNED TO ME.

.

OH, I'LL BE CAREFUL WITH YOU IN A SECOND.

NO, SEE, NOW YOU LOST MY QUESTION.

NO QUESTIONS.

NO QUE ANY QUESTIONS FROM THE AUDIENCE OR WERE YOU WITH THE APPLICANT? I AM.

I'M THE OKAY.

WELL YOU'D LIKE TO ADD? YES.

COME ON.

I GET THIS GROUP PASS OUT, BUT I HAVE SOME, UH, PICTURES OF THE ORIGINAL SIGNS AS WELL AND WHAT WE'RE PROPOSING NOW, THERE'S FIVE, I WOULDN'T MANY HERE.

[01:30:01]

SO WE'RE GOING IN THE, THE SAME SPACE.

WHO ARE YOU SAYING ED EDWIN SNELL, OWNER OF ICONN CINEMAS.

SO IN THE AREA, YOU CAN SEE FROM THE ORIGINAL SIGN WHERE THE KICKING BIRD WAS, WE'RE GOING RIGHT IN THAT SAME SQUARE.

IT'S THE SAME DESIGN.

WE'RE TAKING UP THE SAME SQUARE FOOTAGE.

OUR SIGN, UH, WAS BEFORE JUST KICKEN BIRD CINEMAS, BUT WE RAN OUR, OUR CINEMAS AS ICON CINEMAS, V I P SEATING.

SO JUST IN THE SAME SENSE AS WE TAKE UP MORE SPACE, CUZ WE HAVE A LOT MORE LETTERS IN OUR SIGN AND WE'RE NOT GOING ANYTHING GRANDIOSE, SO, OR ANYTHING, YOU KNOW, OVER THE TOP IS WHAT WE FILL THAT ARE JUST ACTUALLY FILLING IN THE SPACE.

AND YOU CAN SEE THERE'S ACTUALLY A OLD BORDER WHERE THE KICKEN BIRD SIGN WAS THAT GOES AROUND THAT WE'RE NOT EXTENDING PAST ANYTHING OF WHAT WAS ORIGINALLY.

WE'RE JUST KIND OF FILLING IN THAT SPACE A LITTLE BIT BETTER AND WE'RE PUTTING A VERY HIGH END SIGN THERE TO MAKE IT LOOK VERY NICE FOR THE COMMUNITY AND THE SHOPPING CENTER AS WELL.

AND WE JUST FEEL THAT IT'S GONNA HELP ATTRACT BUSINESS AND LET PEOPLE KNOW THAT THAT HOMETOWN CINEMA'S REOPENED AND OPERATIONAL AND WE FEEL THAT IT'S GONNA BRING A LOT OF EXTRA TAX AS WELL.

SO, UM, YEAH, THE OTHER SIDE AND SIGN'S ALREADY GOOD, BUT WE REALLY THINK THAT THAT'S GONNA HELP THE TRAFFIC SEE, BE ABLE TO SEE US FROM BACK IN THERE.

IF THERE'S ANY QUESTIONS OR ANYTHING, I'D BE HAPPY TO TALK AND ANSWER.

THANK YOU FOR OPENING IN OUR SETTLEMENT.

RIGHT.

APPRECIATE, WE'RE EXTREMELY, TRULY EXCITED.

SO GOOD.

WE'RE, WE'RE HOPING TO OPEN MID, MID JANUARY, MID JANUARY.

YES, SIR.

SO I HAD ONE QUE SO THE ORIGINAL, THE, THE WHITE OUT, THAT'S NOT THE SIGN.

THE WHITE IS NOT, IT'S JUST THE LETTERS.

THE, THE WHITE IS, IT'S JUST THE LETTER IS PART OF THE OH, OKAY.

YES SIR.

SO IT'S JUST THE LETTERS THAT WE'RE DOING IN THAT ORIGINAL, WHERE IT'S SHOWING WHITE IN THERE.

MM-HMM.

THE BRICK.

THAT'S WHERE THE ORIGINAL KICKING BOARD WAS.

MM-HMM.

IN THAT EXACT SQUARE.

WE JUST PAINTED IT AND THEN WE'RE PUTTING A SIGN OVER THE TOP.

OKAY.

SO YEAH.

YEAH.

RIGHT.

WELL I'M THINKING THAT THE ORIGINAL OUTLINE WAS THE SIGN.

THE SIGN.

YES.

SO WE, WE JUST PAINTED THE BACKDROP AND THEN WE'RE PUTTING OUR SIGN OVER IT TO MAKE YOU GIVE A LITTLE EXTRA POP ON THERE.

VERY GOOD.

THANK YOU VERY MUCH.

THANK Y'ALL VERY MUCH.

ANY QUESTIONS FROM THE AUDIENCE? COMMENTS? YES SIR.

PLEASE COME ON DOWN AND INTRODUCE YOURSELF.

WELL, UH, I'M RAY HIBBARD, PUBLISHER EVAN LIFE LEISURE, BUT I'M SWITCHING HATS THROUGH REPRESENTING THE FREEMAN FAMILY.

AND, UM, ONE OF THE, ONE OF THE FOLKS AT THE PLANNING COMMISSION TOLD ME THIS WOULD'VE BEEN, INFORMATION WOULD'VE BEEN USEFUL.

JUST A LITTLE SNIPPET OF THE HISTORY, UM, ABOUT THIS.

SO IF IT IS A VARIANCE, I DON'T KNOW ENOUGH TO KNOW, BUT IT'S IF IT'S PROBABLY PRETTY SLIGHT.

AND WHY SHOULD YOU ALLOW A VARIANCE FOR ANYBODY? WELL, THE, THE HISTORY OF THIS IS THE FREEMAN FAMILY SAW IT LONG AND HARD TO FIND, UH, WHEN THEY WERE GONNA SELL THE PROPERTY A TO A MOVIE THEATER.

AND, UH, AND THE PATRIARCH TOM FREEMAN SAID THAT, UH, YOU KNOW, IT'S GOTTA BE, HE HAD A, HE HAD BETTER OFFERS .

YEAH, I KNOW.

AND I WAS PUSHING FOR THE BETTER OFFERS.

I'LL CON I'LL, I LOVE YOUR PROJECT, BUT I WAS PUSHING FOR MORE MONEY FROM MY WIFE .

UH, BUT ANYWAY, SO IT LONG STORY SHORT, UH, WHAT COULD HAVE BEEN A NON-TAXABLE, NON-PRODUCING NON MOVIE THEATER, UH, THROUGH THE DEDICATION OF THE FAMILY IS NOW A TAXABLE PROPERTY PRODUCING, INCOME PRODUCING PROPERTY THAT I THINK EVERYBODY HAS MISSED.

MM-HMM.

FROM WHAT I'M TOLD.

AND SO I WOULD ENCOURAGE YOU TO ALLOW, IF THIS IS A VARIANCE, THAT THIS WOULD BE A GOOD REASON TO ALLOW IT BECAUSE IT WENT FROM A NON-TAXABLE TO MAINTAINING IT AS A TAXABLE ENTITY FOR THE CITY OF.

THANK YOU VERY MUCH, SIR.

ANY OTHER QUESTIONS, COMMENTS FROM THE AUDIENCE? COUNSEL, WHAT WOULD YOU LIKE TO DO ON THIS ITEM? I'D MAKE A MOTION WE APPROVE THIS.

SECOND, A MOTION SECOND.

PLEASE CAST YOUR VOTE.

MAYBE HAVE EVER DONE THIS BEFORE THAT ITEM WAS APPROVED.

THANK YOU VERY MUCH.

NEXT ITEM

[C. Case #SP22-00037 Public Hearing and Consideration of a Commercial Site Plan for Stedmond Storij, located on the northwest corner of 33rd and Technology Drive. (Johnson & Associates) (Ward 3)]

IS THIS CASE NUMBER S SP 22 DASH 37 PUBLIC HEARING IN CONSIDERATION OF A COMMERCIAL SITE PLAN FOR STEADMAN STK, UH, LOCATED, LOCATED UNDER THE NORTHWEST CORNER OF 33RD AND TECHNOLOGY DRIVE.

JOHNSON AND ASSOCIATES APPLICANT.

APPLICANT HERE.

OKAY.

YES.

UM, HOLD ON, CAITLIN.

YEAH, GO AHEAD, REAL QUICK.

UH, THE APPLICANT IS SEEKING APPROVAL OF A SITE PLAN FOR A STORAGE FACILITY ON THE NORTH SIDE OF 33RD WEST OF TECHNOLOGY DRIVES AREA OUTLINED IN YELLOW THERE.

UH, THE SITE IS OWNED F1 LIGHT INDUSTRIAL, WHICH ALLOWS FOR THE STORAGE USE.

UH, THE SITE'S 4.3 ACRES AND THE PLAN SHOWS TWO 49,900 SQUARE FOOT BUILDINGS, UH, WHICH WILL CONTAIN PERSONAL STORAGE UNITS INTERIOR TO THE BUILDINGS.

UH, THE SITE IS ADJACENT TO OTHER INDUSTRIAL PARK USES, INCLUDING THE GARAGE CONDOS TO THE EAST, UH, WHICH IS ALSO STORAGE, AND ACROSS 33RD TO THE SOUTH, WHICH IS A LARGE

[01:35:01]

WAREHOUSE BUILDING.

UH, THE SITE NEEDS LANDSCAPING AND OTHER SITE DEVELOPMENT STANDARDS EXCEPT FOR A VARIANCE TO THE SETBACK REQUIRED ON 33RD.

UH, THE BUILDING, UH, INSTEAD OF BEING SET BACK 50 FEET SETS BACK 38 FEET.

UH, THAT BRINGS UP MORE IN LINE WITH THE EXISTING BUILDINGS THAT ARE ALONG 33RD, 33RD, UH, ON EITHER SIDE OF THIS SITE.

UH, PLANNING COMMISSION RECOMMENDED DENIAL OF THE SITE PLAN AND THAT WAS LARGELY DUE TO THE APPLICANT'S DESIRE TO USE ALL CERAMIC COATED METAL FOR THE EXTERIOR OF THE BUILDINGS, WHICH IS NOT ALLOWED PER THE ZONING ORDINANCE.

UH, SINCE THAT PLANNING COMMISSION MEETING, THE APPLICANT HAS AMENDED THEIR APPLICATION TO WHAT IS IN FRONT OF COUNCIL TONIGHT, WHICH SHOWS AT LEAST 50% OF THE EXTERIOR BEING BRICK OR OTHER MATERIAL OTHER THAN METAL.

UH, DUE TO THAT CHANGE, A VARIANCE IS NO LONGER NEEDED FOR BUILDING MATERIALS.

SO WITH THAT, HAPPY TO ANSWER ANY QUESTIONS.

HOPEFULLY I DID NOT CONFUSE YOU TOO MUCH.

NO.

SO NOW PLANNING COMMITTEE APPROVES IT DOESN'T GO BACK.

NO, THEY, THEY DIDN'T.

THE DENIAL STAND STRAIGHT TO YOU.

OKAY.

THAT WAS THE DISCUSSION.

THERE WAS THE MATERIALS, WHY THEY DENIED.

SO DOES STAFF HAVE AN ISSUE WITH THE SETBACK NECESSARILY? NO.

IT ALIGNS WITH THE OTHER BUILDINGS IN THE AREA.

PRETTY, AND I BELIEVE THEY'RE CHANGING ALL THOSE UTILITIES RIGHT NOW ON 33RD.

AND IT'S STILL 38 FEET.

IT'S NOT THE FOUR 50, BUT IT'S, BUT NO IN LINE WITH THE OTHER BUILDING.

NO HEARTBURN.

ANY OTHER QUESTIONS, COMMENTS FOR STAFF RIGHT NOW? APPLICANT WHEN I TELL YOU, WOULD YOU LIKE TO ADD SOMETHING? YES.

CAITLIN TURNER.

FIVE TWENTY TWO CALL COURT DRIVE ON BEHALF OF THE APPLICANT WHO WAS PRESENT.

UM, JUST TO REITERATE, THE APPLICATION BEFORE YOU IS FOR PREMIUM CLIMATE CONTROLLED STORAGE FACILITY.

AGAIN, THERE WERE PREVIOUSLY TWO VARIANCES REQUESTED.

THAT FIRST, THAT'S NOW REMOVED IS FOR THAT ALL METAL EXTERIOR.

THE SOLE ISSUE AT PLANNING COMMISSION HEARING WAS REGARDING THAT ALL METAL EXTERIOR.

NOW THAT THAT VARIANCE IS BEING REMOVED, THERE REALLY WERE NO OTHER ISSUES THAT WERE PRESENTED.

THERE HAVE BEEN NO PROTEST.

STAFF RECOMMENDS APPROVAL.

AND WITH THAT, WE ASK FOR YOUR APPROVAL AND I'M HAPPY TO ANSWER ANY QUESTIONS, ANY QUESTION, COMMENTS FOR THE, UH, ANY? THANK YOU VERY MUCH.

ANY QUESTIONS, COMMENTS FROM THE AUDIENCE? WELL, I'M TORN ON THIS ONE BECAUSE I SEE THAT'S CLEAR, BUT THEN THAT'S WHY DO I HAVE A, WHY DO WE HAVE A PLANNING COMMISSION? SO I CAN JUST TELL YOU THAT, UH, EVEN THOUGH THAT THEY INITIALLY DENIED AND IT SEEMS LIKE EVERYTHING'S BEING CLEARED.

UH, BUT I UNDERSTAND.

COUNSEL, MOVE TO APPROVE A SECOND.

HAVE A MOTION.

SECOND.

PLEASE CAST YOUR VOTE.

THAT HONOR PASS.

ALL RIGHT.

DO WE HAVE ANY CITIZEN'S COMMENTS? NO, SIR.

NO CITIZENS COMMENTS? THE NEXT ITEM IS
