MAYOR COUNSEL, THIS PARTICULAR ORDINANCE IS, UH, BROUGHT TO YOUR ATTENTION DENIED, UH, KENNY STEVENSON OR ANIMAL WELFARE SUPERVISOR IS HERE.

UH, OUR EXISTING, UH, MUNICIPAL CODE TITLE SEVEN DEALS WITH ANIMALS.

AND WE HAVE A PARTICULAR SECTION DEALING WITH THE APPROPRIATE TREATMENT AT AN OUTDOOR SHELTER FOR ANIMALS IN OUR COMMUNITY.

UH, KENNY BROUGHT IT TO MY ATTENTION THAT, THAT WE NEEDED TO MAKE SOME ADDITIONS TO OUR EXISTING CODE TO PROVIDE FOR LANGUAGE THAT SHELTER FOR A DOG OR CAT SHOW CONSIST OF A MOISTURE PROOF AND WINDPROOF STRUCTURE AND SUITABLE SIZE TO ACCOMMODATE THE ANIMAL AND TO ALLOW RETENTION AND BODY HEAT.

ALSO, UH, DEALING WITH DOGS, THE ANIMALS NEED TO MAKE SURE THAT THERE'S A SUFFICIENT STRUCTURES, UM, AND FOR OUTDOOR DOG HOUSES AND SIMILAR STRUCTURES, UH, TO PROVIDE AN INDEPENDENT SOURCE OF HEAT, UH, THAT IS SAFE FOR USE AND OUTDOOR STRUCTURES AND DOES NOT POSE A DANGER, UH, TO THE ANIMAL.

THE ANIMAL'S BODY HEAT'S NOT A SUFFICIENT SOURCE WHEN THE TEMPERATURE IS BELOW 32 DEGREES IN OUR CITY AND A VEHICLE SHALL NOT BE CONSIDERED, UH, AN ADEQUATE SHELTER, UH, AND SHALL BE PROHIBITED.

UM, AND IT SHALL BE UNLAWFUL, UH, AND A VIOLATION FOR ANY PERSON TO LEAVE ANY DOG OUTDOORS AND UNATTENDED FOR A PERIOD OF ONE HALF HOUR OR LONGER WHEN THE TEMPERATURE IS BELOW 32 DEGREES.

SO THIS LANGUAGE, UH, KENNY, BROUGHT TO OUR ATTENTION, OKLAHOMA CITY, HAS A SIMILAR LANGUAGE AND HE'S HERE TO ANSWER ANY QUESTIONS THAT YOU MIGHT HAVE.

I'LL BE REALLY SHORT AS FAR AS THE REASON WHY I REQUESTED THIS CHANGE IN THE CITY ORDINANCE.

UH, BASICALLY IT CAME ABOUT LAST YEAR, UH, WHEN WE HAD SIGNIFICANT INCREASES AND HAD SOME, UH, REALLY SIGNIFICANT WEATHER EVENTS, ARCTIC COLD FRONTS THAT CAME IN, AND THE TEMPERATURES DROPPED TO RECORD SETTING LEVELS.

AND, UM, LAST JANUARY, OKLAHOMA CITY, UM, WENT TO THE CITY COUNCIL AND ASKED FOR AN EMERGENCY ORDER TO CHANGE NURSE CITY ORDINANCE SIMPLY BASED ON, UM, IT CAN BE A LITTLE BIT OF A CHALLENGE WHEN THE TEMPERATURES CAN BE ZERO DEGREES, WIND CHILLS, MINUS NEGATIVE SNOW, ICE AND SO FORTH.

UH, BUT THEY BASICALLY REQUESTED AN EMERGENCY ORDER TO PUT THAT 32 D 32 DEGREE HARD TEMPERATURE IN THE CITY ORDINANCE TO MAKE EVERYTHING MORE CONSISTENT.

TO GIVE EVERYBODY, AS WELL AS LIKE MY OFFICERS AS WELL AS THE COMMUNITY MEMBERS, UH, BASICALLY SOMETHING THAT THEY KNOW AS MORE DEFINITIVE, UH, AS FAR AS BEING ABLE TO ADDRESS THOSE ISSUES WHEN WE HAVE TO RESPOND TO WELFARE, UH, CHECKS AS FAR AS THAT.

ALSO, WE KIND OF ALSO WANTED TO ADDRESS AS FAR AS, UM, THE STRUCTURES IN OUR CURRENT CITY ORDINANCE.

IT DOESN'T REALLY ADDRESS HAVING THE HEAT SOURCE OR SO FORTH INSIDE THAT HOUSE TO BE ABLE TO, UH, PROTECT THAT ANIMAL.

ONE THAT'S SAFE AND THAT'S ACTUALLY APPROVED TO BE INSIDE THAT STRUCTURE.

UM, AND THAT'S WHY WE ALSO ADD FOR THAT ADDITIONAL, UH, PART IN THE CITY ORDINANCE.

UM, ALSO, WE DID HAVE A FEW INSTANCES LAST YEAR AS WELL AS THIS YEAR WHERE PEOPLE WOULD USE THEIR VEHICLES THAT ARE NOT OPERATIONAL TO PLACE THEIR ANIMALS IN THEIR, IN INCLEMENT WEATHER.

IN PARTICULAR, THEIR FREEZING WEATHER.

AND THAT'S NOT SUFFICE CAUSE IT COULD NOT PROVIDE ANY, UH, HEAT SOURCE AS FAR AS INSIDE

SO WE FEEL LIKE THIS IS GOING TO BE BETTER AS FAR AS BEING ABLE, BEING CONSISTENT WITH OUR NEIGHBORS, OKLAHOMA CITY, YUKON, MUSTANG, AND ALL THOSE OTHER PLACES THAT I WORK WITH ON A REGULAR BASIS.

UM, SO THAT'S THE REASON WHY.

THE P U D WILL ALLOW FOR THE DEVELOPMENT OF THE SITE WITH 216 APARTMENTS AND 12 TOWN HOMES WITH A MAXIMUM GROSS DENSITY OF 20 DWELLING UNITS PER ACRE.

UH, THE P U D COMMITS TO THE BUILDINGS BEING 70% BRICK STUCCO STONE OR MASONRY BOARD WITH WOOD AND METAL ACCENTS, UH, AND NO MORE THAN 42 FEET IN HEIGHT AND WILL HAVE A 20 FOOT LANDSCAPE BERM ALONG THE PERIMETER OF THE SITE.

UH, THE LIGHT GREEN THAT'S SHOWN ON THIS EXHIBIT IS THE AREA WE ARE COMMITTING TO PRESERVE.

THAT IS ON OUR SITE.

THERE'S ADDITIONAL TREE CANOPY AND COVERAGE, UH, OUTSIDE OF OUR SITE, UH, THAT WE'VE WORKED WITH THE PROPERTY OWNER, UH, MR. CLAY FARRA TO ALSO, UH, PRESERVE.

AND SO WHAT THAT MEANS TODAY IS A 50 FOOT TALL HOTEL AND OFFICE, UH, DEVELOPMENT.

BUT IT WOULD ALSO ALLOW, UH, INDUSTRIAL USES WITH BAY DOORS, UH, TRUCKS BACKING UP, UH, WITH LITTLE LIMITATION ON LIGHTING, UH, AND, AND OTHER, UH, ITEMS LIKE THAT.

THE HARD CORNER WAS ALWAYS INTENDED FOR COMMERCIAL AND RETAIL.

AND ALONG 33RD AT THE ENTRANCE, UH, ACROSS FROM THE NEIGHBORHOOD IS ALSO ZONED FOR COMMERCIAL AND RETAIL.

SO THE USES HERE WAS ALWAYS INTENDED TO BE MIXED USE.

AND AGAIN, THE CONNECTIVITY WAS PLANNED FROM THE VERY BEGINNING OF THE PROJECT.

THIS IS OUR SITE PLAN.

IT'S, UH, MEANT TO BE A FAIRLY WALKABLE INTERNAL DEVELOPMENT.

UH, AND YOU CAN SEE THAT BY THE WAY THAT THE PARKING LOT IS LAID OUT.

IT'S DIFFERENT THAN MOST, UH, WHAT I WOULD CONSIDER SUBURBAN WALKUP APARTMENTS.

IT'S SET UP ALMOST LIKE A STREET GRID.

UH, SO ALL OF OUR LIGHTING AND OUR ACTIVITIES ARE REALLY FOCUSED INWARD ON THE DEVELOPMENT AND CENTERED AROUND A CENTRAL COURTYARD.

ONE OF THE UNIQUE THINGS THAT THIS DEVELOPER'S DOING, WHICH REALLY CAME OUT OF COVID, UH, WAS ONE OF THEIR AMENITIES IS A CO-WORKING SPACE.

SO WITH MORE AND MORE PEOPLE WORKING FROM HOME NOW, ONE OF THESE AMENITIES IS, IS A, IS BANKS OF COMPUTERS PRINTER AREAS, SO THAT RESIDENTS WORKING FROM HOME HAVE A SPACE OUTSIDE OF THEIR APARTMENT TO GO UTILIZE.

THIS ALSO PREVENTS THEM FROM HAVING TO LEAVE THE APARTMENT AND POTENTIALLY PAY FOR A CO-WORKING SPACE OUTSIDE OF THE DEVELOPMENT.

UH, HERE'S A SIMILAR GRAPHIC TO THE TREE PRESERVATION ONE.

UH, THROUGH OUR CONVERSATIONS WITH THE NEIGHBORS AT OUR MULTIPLE MEETINGS, A LOT OF CONVERSATIONS CAME UP ABOUT THE PROXIMITY OF OUR PROJECT TO THEIR PROPERTY LINES.

UH, ONE THAT HELPS STRENGTHEN TO KNOW THAT, YOU KNOW, AS OUR PROJECT MOVES MOVE FORWARD, THOSE BUILDINGS CAN'T SHIFT THAT DRAMATICALLY.

OUR SITE PLAN APPLICATION IS CURRENTLY IN, SO WHAT YOU'RE SEEING ON THE SCREEN IS WHAT WE'VE PROPOSED AND WE'RE WORKING WITH STAFF NOW ON SOME OF THOSE DETAILS.

SO WHAT WE'VE DONE IS WE CREATED SOME RENDERINGS AND SOME CROSS SECTIONS TO SHOW, UH, THE TYPICAL RESIDENTIAL HOUSE THAT'S IN THE AREA.

HOW FAR AWAY, UH, ARE WE FROM THEIR PROPERTY, AND THEN WHAT'S IN BETWEEN.

SO THIS SITE IS FORTUNATE THAT THERE IS A SIGNIFICANT AMOUNT OF VEGETATION BETWEEN OUR PROPERTY AND THE RESIDENTIAL.

SO IN, UH, IN THIS IMAGE, WHAT YOU CAN SEE IS WE HAVE 200 FEET OF VEGETATION BETWEEN US.

WE TOOK IT A STEP FURTHER AND WE'VE AGREED THAT ON OUR PERIMETER OF OUR PARKING AND OUR DEVELOPMENT, WE, WE'VE AGREED TO A 20 FOOT WIDE BERM WITH VARIOUS TYPES OF LANDSCAPING ON THAT BERM.

SO IT ADDS TO THE TREE, UH, TREE PRESERVATION AREAS.

WE BROUGHT THAT DOWN TO 228.

WE'VE ADDED THE 20 FOOT LANDSCAPE BERM.

WE'VE RESTRICTED ACCESS TO OUR NORTH AND TO OUR WEST.

THAT WAY IF ANYONE SOUGHT TO PROPOSE A STREET ONE DAY, OUR PROJECT WOULD NOT PUSH TRAFFIC OUT NORTH OR TO THE WEST INTO THE NEIGHBORHOOD.

WE'VE ADDED THAT NO AMENDMENTS TO THE PUD SHALL BE MADE WITHOUT CITY COUNCIL APPROVAL.

UH, AND A PUBLIC NOTICE WITH THAT.

THERE WAS CONCERN WITH THE NEIGHBORS THAT WHAT WE AGREE TO MAY BE ADMINISTRATIVELY AMENDED LATER.

I THINK YOUR CODE RESTRICTS A LOT OF THAT, BUT IT WAS A BIT OF A BELT AND SUSPENDERS APPROACH.

BUT WE JUST WANNA MAKE SURE THAT AT NO POINT WOULD SOMEONE BE AMENDING THIS WITHOUT YOUR APPROVAL AND THEIR NOTIFICATION.

WE LOOKED AT THE STREETS AND THE SIGNALS AND WE ACTUALLY DID A 24 HOUR COUNT ON 33RD, UH, AT, UH, HIDDEN PRAIRIE WAY.

THAT'S THE, THE STREET ON THE SOUTH.

IT DOES NOT HAVE A SIGNAL.

IT SAYS, AS YOU CAN SEE BY THIS GRAPHIC THAT, UH, UH, THE LIKELY EXIT FOR ANY OF OUR, UH, UH, PEOPLE IN THE, IN THE PRO IN THE PROJECT WOULD BE TO KELLY.

IT JUST MAKES SENSE.

IT'S A SHORTER DISTANCE.

THEY'RE SIGNALED IF YOU WANT TO GO NORTH, YOU CAN EASILY GO NORTH FROM EITHER ONE OF THOSE.

A SIGNIFICANT INCREASE IN, IN IMPACT.

UM, AND WE, WE THINK THAT, UH, HIDDEN PRAIRIE, WHERE IS WELL DESIGNED, IT'S GOT UNDULATIONS IN IT, IT WAS DEFINITELY DESIGNED WITH, UH, THE EFFORT TO TRY AND SLOW THE TRAFFIC DOWN.

EVEN JUST THE RESIDENTS.

SO I, JUST CHECKING ON THAT CUZ UM, THAT SPECIFIES A MAXIMUM HEIGHT OF 35 FEET OF ANY BUILDINGS IN THOSE TYPE OF ZONED AREAS.

SO I DON'T UNDERSTAND HOW THAT'LL WORK IF THEY'RE PLANNING A 42 FOOT, UM, BUILDING.

IT HAS BEEN DEMOCRACY AND ACTION.

IN THESE TWO RECENT VOTES, THE HAER PARK LAND VOTE, WE VOTED TO RAISE OUR TAXES AND PAY MORE MONEY.

SO THERE WILL BE LESS, LESS HOUSES, APARTMENTS, RETAIL, TRAFFIC, CRIME, HOMELESSNESS, POLLUTION, 81% LANDSLIDE VOTE.

THE MEMORIAL ROAD VOTE ON I 35.

THAT WAS AGAINST APARTMENTS.

69% LANDSLIDE VOTE.

BOTH OF THESE VOTES WERE FOR TINE GROWTH.

THE PEOPLE SPOKEN ON THESE KINDS OF MATTERS.

TV NEWS MONTHS AGO SAID POPULATION MAY GROW BY 40,000 OVER THE NEXT 30 YEARS.

DO WE WANT THAT? ALL OF YOU FIVE BELIEVE IN DEMOCRACY.

I CAN ASSUME AND LET'S PUT THAT POSSIBLY TO A VOTE OF THE PEOPLE.

DO WE WANT TO GROW BY THAT MUCH? OVER THE NEXT DECADES, THE PLANNING AND ZONING DEPARTMENT CAN REGULATE, MODIFY, AND CONTROL GROWTH WITH RESTRICTIONS.

COUNCILMAN MOORE, YOU SAID IN A RECENT MEETING THAT PEOPLE, SIR, CAN WE, UH, ADDRESS THE ENTIRE COUNCIL? IT'S, IT'S IN COUNCIL.

YOU DON'T, YOU DON'T SINGLE OUT ANY COUNCIL.

OKAY, WELL I WAS JUST SAYING THAT AT A RECENT MEETING.

HE SAID THAT PEOPLE IN HIS AWARD WERE COMPLAINING ABOUT SMALL LOTS.

OKAY, THEN STOP IT.

JUST BECAUSE SOMEONE OWNS 20 OR 200 ACRES DOESN'T MEAN THAT THEY CAN DEVELOP IT ANY WAY THEY WISH.

CITY GOVERNMENT CAN RESTRICT AND CONTROL LAND AND GROWTH IN WARD TWO.

UH, IT WOULD BE NICE TO KNOW EXACTLY WHAT THE PLAN IS CUZ THAT'S MOSTLY WHERE THE GROWTH IS GONNA BE.

LET'S ALL DO SOME THINKING ABOUT THE INTERSECTION OF SECOND AND BRYANT, THAT CORNER THERE, INTERSECTION HAS ALL THE UGLY CRAFT COMMERCIALISM AND OUR CON ECONOMY CAN MUSTER.

DO WE REALLY WANT A BUNCH OF THOSE INTERSECTIONS SCATTERED THROUGHOUT HIS WARD IN THE FUTURE? LET'S PUT THAT TO A VOTE OF THE PEOPLE OF THE CITIZENS OR JUST OF HIS WARD.

WOULD IT BE 81% OR 69% LANDSLIDE VOTE AGAINST GROWTH? U FIVE HAVE THE POWERFUL ROLES OF LEADERSHIP IN OUR CITY.

THE DECISIONS YOU MAKE PRESENTLY WILL GIVE US THE EDMOND OF THE FUTURE.

DO WE WANT TO RAISE TAXES FOR MORE ROADS, POLICE, FIRE IN THE FUTURE? DO WE WANT TO RAISE PROPERTY TAXES FOR MORE SCHOOLS IN WARD TWO? I URGE THE FIVE OF YOU TO LISTEN TO THE WILL OF THE PEOPLE IN THESE TWO RECENT VOTES AND RESTRICT AND CONTROL GROWTH.

WE WANT QUALITY OF LIFE, NOT QUANTITY OF GROWTH.

A NEW URBAN MODEL FOR LIMITING GROWTH IS WITHIN OUR REACH.

IF WE THINK ABOUT THE FUTURE, A HUNDRED THOUSAND CITIZENS IN OUR CITY IS PROBABLY ABOUT ENOUGH.

UM, MY QUESTION IS, OR MY CONCERN IS, IS THAT I'M A LONGTIME RESIDENT HERE IN, IN, UH, IN EDMOND AND I LIVE IN OAK TREE.

AND, UH, UH, IN THE LAST COUPLE OF YEARS, OR LAST TWO YEARS OR SO, I'VE HAD A VERY, VERY DIFFICULT TIME.

MAYBE NOT ONLY FINANCIALLY, BUT JUST THE TIME TO PAY MY, UH, UTILITY BILLS.

AND, UH, THE MORE OFTEN I ENGAGE IN TALKING

TO THE UTILITY DEPARTMENT, THE MORE, UM, ALMOST, UM, DISAPPOINTED I GET BECAUSE THEY HAVE, UM, ALWAYS CONSTANTLY MOVED THE GOAL LINE WHEN IT COMES TO PAYING YOUR BILL.

THEY USED TO HAVE A, UM, A A COUNTER OF PEOPLE THAT WOULD TAKE YOUR, TAKE YOUR UTILITY BILL SO YOU COULD PAY THEM ON THE SPOT.

THEN THEY CHANGED THAT, AND THEN THEY CHANGED IT WHERE YOU HAD TO, UM, UH, PAY ONLINE AND THEN THEY, UH, THEN THEY MADE IT WHERE YOU COULDN'T PAY ONLINE.

UH, THEN THEY'RE GETTING READY TO CHANGE THE, UH, UTILITY DEPARTMENT TO ANOTHER LOCATION.

THEY HAVE A KIOSK, WHICH IS VERY, VERY DIFFICULT TO, UM, NAVIGATE.

AND I SPENT A LOT OF TIME TRYING TO PAY MY BILLS THERE.

I ENDED UP RESORTING TO, UH, GOING TO WALMART TO PAY MY BILL AND THEN THEY WOULDN'T ACCEPT A CERTAIN CASHIER'S CHECK FROM CITIZEN'S BANK.

UM, THE KIOSK IS VERY, YOU KNOW, THEY DON'T HAVE A CHAIR IN THERE.

THERE'S NOT HARDLY ANY LIGHT.

AND, UM, I JUST FEEL AS THOUGH THAT THERE'S MANY PEOPLE THAT ARE HAVING JUST AS MUCH OF A STRUGGLE PAYING THEIR UTILITY BILLS.

AND I JUST FELT LIKE THAT THE, UH, CITY SHOULD MAKE IT MUCH EASIER FOR SENIOR CITIZENS TO PAY THEIR BILLS RATHER THAN GOING HOPSCOTCHING AROUND TO TRY TO GET SOME SORT OF RELIEF.

YOU KNOW, IT IS HUMILIATING , YOU KNOW, I'VE, I'VE TALKED TO THEM AND THEY'RE WELL AWARE OF WHO I AM AND, UM, EVERY TIME I TALK TO 'EM, I GET A NEW, YOU KNOW, UH, UTILITY DEPARTMENT REPRESENTATIVE.

THERE'S NO CON CONGRUENCY CONGRUENCY THERE.

AND I WOULD HOPE THAT, YOU KNOW, IF THERE WAS ANY KIND OF SUGGESTION, YOU KNOW, TO MAKE THINGS EASIER BY JUST MERELY HAVING THE, UH, NEW DEPART.

COUNCIL, DO WE HAVE ANY COMMENTS FROM THE MAYOR AND CITY COUNCIL? I JUST WANTED TO TAKE AN OPPORTUNITY TO THANK, UM, ALL OF THE RESIDENTS WHO SERVE ON OUR 26 BOARDS AND COMMISSIONS, UM, THAT DO A LOT OF WORK BEHIND THE SCENES THAT FOLKS DON'T NECESSARILY SEE, INCLUDING THE CITIZENS PARTICIPATION COMMITTEE.

UM, A GROUP OF RESIDENTS WHO, UM, UH, EXAMINE WHICH NONPROFITS IN OUR COMMUNITY THAT ARE PROVIDING SERVICES TO OUR RESIDENTS AND DOING IT REALLY WELL TO FIND OUT HOW TO INVEST, UH, THAT PORTION OF OUR BUDGET.

UM, BUT A LOT OF REALLY GREAT WORK HAPPENING ON THESE 26 BOARDS AND COMMISSIONS.

AND IF FOLKS ARE INTERESTED IN SERVING, THERE'S AN ONLINE APPLICATION AND ENCOURAGE PEOPLE TO, UH, CHECK THAT OUT AND THANK THE FELLOW CITIZENS WHO ARE SERVING.

BUT I ALSO, I WAS READING THE LIST OF CITIZENS AND RESIDENTS AND STAKEHOLDERS THAT WERE INVOLVED IN INTERVIEWED, AND I THINK IT WAS, I THINK I COUNTED 101, BUT I'M JUST GONNA SAY APPROXIMATELY 100 PEOPLE THAT WERE INVOLVED IN GIVING THEIR OPINIONS AND, UM, AND SHARING THEIR INFORMATION WITH THAT STUDY.

UH, AND IT WAS, I THINK THEY, THE ULI PANEL MENTIONED IT SEVERAL TIMES HOW THAT WAS INTRODUCED INTO THE, INTO THEIR PRESENTATION AND THEIR FINDINGS.

UH, IT REMINDS ME A LOT OF THE 18 MONTH EAST EDMOND 2050 STUDY THAT WE DID, UH, THAT HAD MULTIPLE RESIDENTS FROM ALL OVER THE CITY, UH, INVOLVED IN THAT, THAT TALKED ABOUT HOW WE WERE GOING TO PLAN THE GROWTH FOR EAST EDMOND, UH,

FIND A BALANCE.

THE WORD BALANCED WAS USED SO MANY TIMES, UH, BETWEEN, UH, BETWEEN DEVELOPMENT, NEW DEVELOPMENT AND ALSO RURAL, UM, DEVELOPMENT.

AND SO REMINDS ME THAT I, I, I DON'T KNOW IF I CAN THINK OF ONE STUDY THAT WE'VE DONE WHILE I'VE BEEN ON COUNCIL THAT HASN'T INVOLVED, UM, AS LARGE A GROUP OF PEOPLE AND CITIZENS AND RESIDENTS AS WE CAN.

THE, THE LARGEST GROUP I'VE EVER WORKED ON WAS THE TOMORROW ED EDMOND PROJECT, WHERE IT HAD ALMOST AT THAT TIME ALMOST EVERY CITY COUNCIL PERSON, PREVIOUS MAYORS AND ALL THAT.

BUT YOU'RE RIGHT, IT'S, IT'S BEEN, IT'S BEEN, YEAH.

AND ON THE, YOU KNOW, NOT ONLY THE, THE COMMITTEE MEETINGS AND, AND MEETINGS DURING THE 2050 EAST EDMOND STUDY THAT HAPPENED, BUT ALSO THE, THE MULTIPLE PUBLIC MEETINGS AND OPPORTUNITIES FOR PUBLIC COMMENT, UH, THAT WE HAD DURING THAT STUDY AS WELL.
