I'D LIKE TO START WITH A PRESENTATION OF A PROCLAMATION, RECOGNIZING OCTOBER 31ST, 2025.

IS DAVID J. MARTIN REMEMBRANCE DAY IN THE CITY OF EDMOND? IF I COULD, COULD I GET THE FAMILY TO COME UP HERE IN FRONT FOR US? PLEASE? HAVE YOU BEEN CALLED ? NO, YOU ARE NOT .

WHEREAS OCTOBER 31ST, 2025 MARKS THE 20TH ANNIVERSARY OF THE PASSING OF UNITED STATES ARMY INFANTRYMAN DAVID J. MARTIN, THE FIRST SERVICEMAN FROM EDMOND, OKLAHOMA TO GIVE HIS LIFE IN THE GLOBAL WAR ON TERRORISM.

AND WHEREAS DAVID MARTIN GRADUATED FROM EDMOND NORTH HIGH SCHOOL IN 2002, WHERE HE PROUDLY PARTICIPATED IN THE JUNIOR RESERVE OFFICERS TRAINING CORPS AND LATER ATTENDED THE UNIVERSITY OF CENTRAL OKLAHOMA BEFORE ENLISTING IN THE UNITED STATES ARMY.

AND WHEREAS DAVID SERVED HONORABLY AS AN ACTIVE DUTY INFANTRYMAN WITH THE HUNDRED FIRST AIRBORNE DIVISION AT FORT CAMPBELL, KENTUCKY, EMBODYING THE COURAGE, DISCIPLINE, AND DEVOTION TO DUTY THAT DEFINES AMERICA'S FINEST SOLDIERS.

AND WHEREAS ON OCTOBER 31ST, 2005, WHILE ONE MONTH INTO A YEAR LONG DEPLOYMENT, DAVID AND HIS CREW MADE THE ULTIMATE SACRIFICE WHEN THEIR HUMVEE WAS STRUCK BY AN IMPROVISED EXPLOSIVE DEVICE GIVING THEIR LIVES IN FAITHFUL SERVICE TO OUR NATION.

AND WHEREAS DAVID WAS THE BELOVED SON OF RICK AND JAN MARTIN AND THE THIRD OF FIVE CHILDREN, AND HIS FAMILY'S SPIRIT OF SERVICE CONTINUES IN EDMOND THROUGH HIS BROTHERS NEIL, A VETERAN EDMOND POLICE DEPARTMENT CANINE OFFICER OF OVER 20 YEARS, AND ANDREW MARTIN, WHO PREVIOUSLY SERVED AS A CITY OF EDMOND 9 1 1 DISPATCHER AND JAILER.

AND WHEREAS DAVID'S LEGACY LIVES ON IN THE HEARTS OF HIS FAMILY, FRIENDS, FELLOW SOLDIERS, AND THE COMMUNITY OF EDMUND WHOSE GRATITUDE FOR HIS SACRIFICE REMAINS STEADFAST AND PROFOUND.

AND WHEREAS IT IS FITTING THAT THE CITIZENS OF EDMUND PAUSE TO HONOR AND REMEMBER THE LIFE, COURAGE AND SACRIFICE OF PRIVATE FIRST CLASS DAVID J. MARTIN, AND TO REAFFIRM OUR ENDURING RESPECT FOR ALL THOSE WHO HAVE SERVED AND SACRIFICED IN DEFENSE OF FREEDOM.

NOW, THEREFORE, I MARK A. NASH MAYOR, DO HEREBY PROCLAIM FRIDAY, OCTOBER 31ST, 2025 AS DAVID J. MARTIN REMEMBRANCE DAY IN THE CITY OF EDMOND.

AND I ENCOURAGE ALL CITIZENS TO JOIN IN HONORING THE MEMORY OF THIS BRAVE SON OF EDMOND, WHOSE LIFE AND SACRIFICE EXEMPLIFY THE HIGHEST IDEALS OF SERVICE AND PATRIOTISM.

[B. City Manager's Update: Sales, Use, and Lodging Tax City of Edmond and Oklahoma County Partnership Oklahoma Department of Transportation (ODOT) Construction Updates]

ITEM TWO B, CITY MANAGER'S UPDATE MR. INS.

THANK YOU, MAYOR.

UH, LET'S BEGIN WITH OUR MONTHLY SALES TAX REPORT LIKE WE USUALLY DO.

UH, THESE NUMBERS REFLECT AUGUST SALES THAT WERE REPORTED IN SEPTEMBER, AND THEN, UH, CHECK WAS SENT TO US IN OCTOBER.

SO BREAKING IT DOWN, UH, SALES TAX IS DOWN, UH, 2.02% YEAR TO DATE WITH A NEGATIVE, UH, 5.4% FOR THE MONTH OF OCTOBER.

USE TAX IS ALSO DOWN 2.9699999999999998% YEAR TO DATE.

WE WERE ALMOST EVEN FOR THE, FOR LAST MONTH THOUGH.

UH, YEAR TO DATE COMBINED SALES AND USE TAX COLLECTIONS ARE DOWN, UH, 2.18%

COMPARED TO LAST YEAR.

UH, EDMOND IS ONE OF FOUR MAJOR CITIES SEEING A DECLINE.

UH, YUKON'S DOWN 2%, UH, NO, MIDWEST CITY'S DOWN A LITTLE BIT AND AS WELL AS NORMAN.

UH, ON A MORE POSITIVE NOTE, UH, LODGING TAX SHOWS A SMALL POSITIVE.

IT'S AN UPTICK OF 0.59%.

UM, LET'S SEE.

WANTED TO TALK ABOUT OUR PARTNERSHIP WITH OKLAHOMA COUNTY.

NEXT, WE HAVE A BIG PROJECT COMING UP WITH THE, UH, REPAVING OF COFFEE CREEK ROAD.

UH, SALES TAX, UH, SUPPORTS THAT, UH, CONSTRUCTION BEGINS AT THE END OF THIS MONTH AND WEATHER PERMITTING SHOULD FINISH BY YEARS IN.

UH, THIS PROJECT INCLUDES STABILIZING THE SUBGRADE AND RESURFACING WITH A KEVLAR INFUSED ASPHALT.

IT'S ADDING TWO FOOT SHOULDERS AND, UH, SIX INCH STRIPING FOR IMPROVED SAFETY.

UH, WILL CAUSE A TEMPORARY ROAD CLOSURE WITH LOCAL ACCESS MAINTAINED.

UH, THIS IS ANOTHER EXAMPLE OF OUR SUCCESSFUL PARTNERSHIP WITH OKLAHOMA COUNTY.

UH, TOGETHER WE'VE REBUILT 65 LANE MILES OF SECTION LINE ROADS OVER 20 YEARS AT AN ESTIMATED SAVINGS OF $32 MILLION TO OUR TAXPAYERS.

UH, CURRENTLY THE STREET AND ALLEY FUND GENERATES $850,000 PER YEAR.

THAT'S ENOUGH TO RECONSTRUCT ROUGHLY ONE MILE PER YEAR.

UH, WITH ADDITIONAL FUNDING, SAY ABOUT 1.6 MILLION MORE ANNUALLY, WE COULD COMPLETE NINE LANE MILES PER YEAR AND FINISH ALL 40 REMAINING MILES IN JUST FIVE YEARS.

UH, PARTNERSHIPS LIKE THIS TRULY MAKE OUR PROJECTS, UH, MORE POSSIBLE.

AND LAST, UH, AN UPDATE ON I 35, UH, ODOT IS WRAPPING UP PHASE ONE OF ITS $18 MILLION IMPROVEMENT PROJECT BETWEEN MEMORIAL AND SECOND STREET.

UH, THOSE ARE TURNAROUND BRIDGES AT 33RD, 15TH, AND SECOND STREETS ARE EXPECTED TO BE COMPLETE THIS WEEK.

UH, THE NEXT PHASE, WHICH INCLUDES NEW RAMPS AND ONE WAY FRONTAGE ROADS WILL NOT BEGIN UNTIL SEPTEMBER OF 2027.

UH, CONSTRUCTION OF THAT PHASE IS ESTIMATED TO TAKE AROUND 18 MONTHS.

UH, JUST A REMINDER, THE GOAL OF THE PROJECT IS BOTH SAFETY AND EFFICIENCY.

UH, THE REWORKING OF THE RAMPS AND FRONTAGE ROADS, UH, WILL HELP PREVENT DANGEROUS BACKUPS ONTO THE INTERSTATE AND REDUCE CONGESTION ON I 35.

UH, ODO IS RESPONSIBLE FOR THE OVERALL PROJECT, UH, FROM PLANNING TO OVERSEEING THE CONTRACTORS.

WITH THAT, I'M HAPPY TO ANSWER ANY QUESTIONS.

IS THERE ANY CHANCE THAT ODOT MIGHT MOVE THAT WORK UP A LITTLE BIT? I, I THINK UNLESS THEY HAVE A FUNDING WINDFALL THAT WE DON'T KNOW ABOUT, THAT WILL PROBABLY NOT HAPPEN.

THAT IS, UH, TWO RAW WATER LINES AND ONE, UH, WATER TRANSMISSION LINE FROM THE WATER PLANT TO I 35.

UH, AND THEN OF COURSE, THE INTAKE TO THE

WATER PLANT.

SO, UM, THE MAIN PURPOSE OF THIS CHANGE ORDER IS TO FUND CHANGES ON THE, UM, 36 INCH TRANSMISSION LINE.

OUR MAIN LINE GOING FROM THE PLANT I 35.

THERE'S A LOT OF ADJUSTMENTS BECAUSE OF SOME UTILITIES, UH, MAINLY GAS PIPELINES AND, UH, AVOIDING SOME, UH, ADDITIONAL TREE DISTURBANCE AND SOME CERTAIN AREAS.

UM, WE'VE ALL SEEN THE TREE DISTURBANCE AND HAVE HEARD MANY COMMENTS ON IT, BUT, UM, IT IS OUR MOST CRITICAL LINE IN THE CITY.

UM, SO IN ORDER TO REALIZE THE CAPACITY OUTTA THE WATER PLANT IN THE FUTURE, THAT LINE IS NEEDED.

UH, THIS CHANGE ORDERS NEARLY 4 MILLION.

I I WON'T READ EVERY NUMBER.

3,949,000.

UH, WE REDUCED SOME OF THE SCOPE OUT OF IT, OUT OF THE PROJECT TO GET COSTS BACK CLOSER TO THE ORIGINAL.

UH, WE WILL LOOK AT, UH, BETTER WAYS AND MAYBE LESS EXPENSIVE WAYS TO GET, GET THAT, UH, WORK COMPLETED ON A FUTURE PROJECT.

SO ALWAYS LOOKING FOR WAYS TO KEEP COSTS AS CLOSE TO, UM, ZERO AS POSSIBLE WITH THE PROJECT.

BUT ANY QUESTIONS? PUBLIC COMMENT? WOULD ANYONE IN THE AUDIENCE LIKE TO ADDRESS THIS ISSUE? MR. IAN, I'VE GOT ONE QUESTION FOR YOU.

THE PROJECT'S ALREADY GONNA BE DELAYED A YEAR ON BASED ON THIS CHANGE ORDER.

SO FOR THE SAKE OF GETTING IT MOVING, IT'S ALREADY GONNA TAKE, UM, I THINK MAY OR JUNE OF NEXT YEAR BEFORE THIS STARTS PICKING BACK UP.

AND IF WE DON'T GET THE ORDER IN AND GET DRAWINGS APPROVED BEFORE THE HOLIDAYS, IT'S JUST GONNA EXTEND OUT FURTHER AND FURTHER.

SO, UH, FOR THE SAKE OF TIMELINESS, UM, WE WANTED TO GET THIS ON THE AGENDA NOW.

WE HAVE 32 CIRCUITS AROUND THE SEA OF EDMOND.

WE DO EIGHT PER YEAR.

UH, WE BID THOSE OUT.

ISSUE A PO TO THE WINNING BIDDER IN THIS CASE IS DAVY RESOURCES FOR THIS PARTICULAR CIRCUIT.

UH, AT THE END OF THE YEAR, WE TYPICALLY CLOSE OUT POS WHEN ALL THE WORK IS DONE AND COMPLETED.

WE CLOSE THE PO FOR DAVY PREMATURELY THINKING THAT ALL INVOICES HAD BEEN SUBMITTED, BUT THEY WERE NOT, THEY SUBMITTED TWO MORE FOR ONE CIRCUIT TRIM AND SOME TIME OF MATERIAL WORK FOR THE $103,000.

UH, SO WE WORKED WITH LEGAL AND PURCHASING TO OPEN A NEW PO THAT WE'RE REQUESTING TONIGHT TO PAY FOR THESE SERVICES THAT DAVEY COMPLETED FOR US.

QUESTIONS? DID WE UNDERRUN THE CONTRACT LAST YEAR BECAUSE OF THAT INVOICE NOT COMING IN? UH, NO.

TYPICALLY IT'S PRETTY FIRM.

UH, THE ONLY VARIABLE IS TYPICALLY TIME AND MATERIAL.

UM, WE USUALLY BUDGET ABOUT 150,000 A YEAR FOR LIKE, IF A CREW IS OUT DOING WORK THAT THEY NEED TRIMMING, SPECIFIC TRIMMING DONE NOT UNDER THE CIRCUIT CONTRACT OR IF STORM TREE FALLS DOWN AND THEY NEED REMOVAL SERVICES.

UM, I JUST WANNA MAKE SURE THAT WE GET THIS GRANT AND THEN IN YEARS TO COME AFTER THE GRANT MONEY IS GONE, WE'RE GONNA HAVE THE FUNDS AVAILABLE TO US.

WE'RE ALREADY THINKING THAT WAY ABOUT HOW WE'RE GONNA PAY FOR THIS.

THE GRANT, THE, UH, ROUTE AMENDMENT OR THE ROUTE CHANGE WOULD ACTUALLY ALREADY CHANGE, UH, EXISTING ROUTES.

SO ONE OF OUR ROUTES WOULD BE CHANGING AS WELL TO OFFSET THE COST OF THIS LONG TERM.

UM, THIS WOULD JUST PROVIDE US A SAVINGS FOR A COUPLE OF YEARS.

THAT, ANY OTHER QUESTIONS? I, I THINK TOO, WE, WE IDENTIFIED IN MOBILITY COMMISSION THE ADVANTAGE OF THIS PARTICULAR ROUTE'S GONNA BE PROBABLY AS MUCH OR MORE SO THAN THE OTHER SIX COMBINED IN TERMS OF ECONOMIC DEVELOPMENT.

AND HOPEFULLY AT SOME POINT IN TIME WE'LL BE ABLE TO QUANTIFY THAT.

UH, SPECIFICALLY THIS IS FOR 250 CUBIC YARDS OF TRASH REMOVED AND THEN A LARGE AMOUNT, 7,661 CUBIC YARDS OF SOIL IMPORTED.

AND THAT'S SPECIFICALLY FOR THREE OF THE FIELDS THAT SAT ON TOP OF A DEEP TRASH LAYER NEEDED TO BE BROUGHT UP.

UM, AND THAT WAS THE MOST ECONOMICAL WAY TO DO THAT.

UM, THIS WAS BID OUT AS A UNIT COST ITEM IN THE VERY FIRST EARTH EARTHWORK BID AT THE BEGINNING.

AND, UM, WE BROUGHT THIS BEFORE THE CAPITAL IMPROVEMENT PROJECT ADVISORY BOARD AT THEIR LAST MEETING AND THEY ALL APPROVED.

SO IT IS A MASSIVE PROJECT AND I KNOW LOTS OF PEOPLE WITH THEIR KIDS ARE LOOKING FORWARD TO IT BEING COMPLETED AS WELL.

AND JUST FOR THE PUBLIC AND YOUR INFORMATION, WHEN WE WERE PREPARING THIS PROJECT, WE DID LOOK AT, YOU KNOW, WHAT WOULD IT COST TO JUST REPLACE THE ENTIRE POOL? AND IT WAS SIGNIFICANTLY MORE, I THINK THE ESTIMATE WAS IN THE $12 MILLION RANGE, SO SIGNIFICANTLY LESS THAN WHAT WE'RE SPENDING, BUT WE ARE ESSENTIALLY GETTING YEAH, MOST THINGS NEW THERE AS FAR AS FAR AS POOL GOES.

I IT'S GOOD.

I I JUST, IF I WAS THE CONTRACTOR, I'D RATHER DO IT NEW THAN WHAT THEY'RE HAVING TO DO.

BOTH PROVIDE IMPORTANT RESOURCES TO THE RESIDENTS OF EDMOND.

AS I MENTIONED, 5,200 AND HAVING THEM WITHIN THE CITY LIMITS PROVIDES CONVENIENCE BY SAVING TRIPS TO OKLAHOMA CITY AND NEIGHBORING COMMUNITIES.

CITY STAFF IS WORKING OUT DETAILS WITH SERVICE OKLAHOMA ON A NEW SUBLEASE THAT WILL PROVIDE RENTAL INCOME BACK TO THE CITY OF EDMOND.

ADDITIONALLY, NOW THAT ALL CITY STAFF THAT WERE OCCUPYING THE BUILDING TO MOVED INTO THE NEW CITY HALL, CONVERSATIONS ARE BEGINNING ABOUT SUBLEASING.

THE COMPREHENSIVE PLAN DRAFT DOCUMENT WE REWARDED ITEM AR 9 0 3.

UM, THAT WAS THE ONE THAT MENTIONED, UM, HOUSING.

AND WE INCLUDED A LIST OF THE TARGET HOUSING TYPOLOGIES IN THAT ITEM.

SO IT'S PULLED STRAIGHT FROM THE EDMOND HOUSING ASSESSMENT.

WE REWORDED ITEM AR 5 36 TO BETTER ALIGN WITH THE CURRENT STATUS AND TRAJECT TRAJECTORY OF THE CITY'S ITS MASTER PLAN.

IE WE REMOVED THE WORD OVERHAUL, UM, AND THEN WE REMOVED THE LAST BULLET OF AR FOUR 13 REGARDING TRANSFER OF DEVELOPMENT RIGHTS.

UM, WE REALIZED THERE WAS SOME ALREADY SOME EXISTING OVERLAP WITH A COUPLE OF OTHER ITEMS. AND, UM, BASED ON HOW THINGS ARE GOING WITH THE DEVELOPMENT CODE, WE DIDN'T THINK IT WAS NECESSARY TO CALL OUT TRANSFERRED DEVELOPMENT RIGHTS.

UM, SO THE DOCUMENT IN YOUR PACKET INCLUDES ALL OF THOSE CHANGES.

AND NOW BECAUSE OF OUR SIZE, WE CAN JUST ASSUME JURISDICTION BY RESOLUTION.

WE ALWAYS THOUGHT IT PRUDENT TO ALSO CODIFY THAT IN MUNICIPAL CODE FOR NOTICE PURPOSES AND SO THAT PEOPLE CAN PULL IT UP ON MUNI CODE AND SEE, YOU KNOW, WHAT THE OFFENSES ARE.

SO OVER THE YEARS AS WE'VE UPDATED THE CODE AND THEN THE RESOLUTION, THEY KIND OF GOT STAGGERED AND SO THEY WEREN'T CONSISTENT WITH EACH OTHER.

AND THERE ARE SOME RESIDUAL REFERENCES TO AN INTERLOCAL AGREEMENT THAT DOESN'T EXIST ANYMORE.

SO WE'RE JUST KIND OF CLEANING UP ALL THAT LANGUAGE TO MAKE IT CONSISTENT.
